This matter came before the court on September 15, 2021 in Department 17 before The
15
Honorable Arthur A. Wick. Counsel Adam Abel appeared on behalf of Petitioner. Respondent
16
appeared on his own behalf.

The court notes that this case comes before this court as an appeal. As such, this appellate
18
hearing is being conducted as a trial de novo.

After reviewing the hours of testimony and subsequent to the review and re-reviewing of
20
the numerous admitted exhibits, the court finds based on all the evidence before this court, and
21
including the credibility of all parties and witnesses, in favor of the City and against Respondent
22
Anthony Baca.

Each and every witness called by Petitioner testified in a straight forward and credible
24
manner. These witnesses were quite persuasive, and their testimony taken alone and collectively
25
was compelling.

As to Respondent's testimony the court found it lacking truth and veracity. At times, the
27
subject testimony was simply incredulous.
