Re: Request to Withdraw an Emergency Rule

Commissioner McCord,

On October 18, 2021 the Joint Government Operations Rule Review Committee voted to
request the Department of Labor and Workforce Development to withdraw the emergency rule
regarding the Occupation Safety and Health Standards for COVID-19 Emergency Temporary
Rule, as filed by the department on August 24, 2021. This vote, in effect, is a disapproval of the
emergency rule, pursuant to Tennessee Code Annotated, Section 4-5-226.

All that to say, it would be my suggestion, pursuant to the action of the joint committee, that the
Department may satisfy the committee's request by promulgating a proposed rule to repeal the
above referenced emergency rule.
