A NATIONAL GREENING PROGRAM PARTNERSHIP AGREEMENT KNOW ALL MEN BY THESE PRESENTS: This Memorandum of Agreement made and entered into this 20" day of February 2012 atthe Office ofthe Secretary, DENR, Main Building, Diliman, Quezon City, Philippines by and among: ‘The DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES, a national government agency duly organized and existing under the laws of the Republic of the Philippines with principal office address at Visayas Avenue, Diliman, Quezon City, represented herein by its Secretary, HON. RAMON J.P. PAJE, herein referred as “DENR” and = ‘The PHILIPPINE TROPICAL FOREST CONSERVATION FOUNDATION, INC., ‘a non-stock, non-profit foundation organized and existing under the laws of the Philippines, with principal place of business at Unit 11-3A Manila Bank Building, 6772, Ayala Avenue, Makati City, 1223, represented herein by its Chairperson, Board of Trustees, DR. PACIENCIA P. MILAN, herein referred as “PTFCF” -and - ‘The FOUNDATION FOR THE PHILIPPINE ENVIRONMENT, a non-stock, non-profit foundation organized and existing under the laws of the Philippines, with office address at #77 Matahimik Street, Teachers’ Village, Quezon City represented herein by its Chairperson and Chief Executive Office, ATTY. DANNY N. VALENZUELA, hereinafter referred to as “FPE"; WITNESSETH: WHEREAS, His Excellency President Benigno S. Aquino Il issued Executive Order No. 26 on 24 February 2011 declaring the implementation of a National Greening Program (NGP) as government priority for poverty reduction, food security, biodiversity conservation, and climate change mitigation and adaptation; WHEREAS, EO 26 prescribes the harmonization of all greening efforts and similar initiatives of the government, private sector, LGUs and the eivil society; WHEREAS, The NGP includes among others the development of forestlands (production and protection), mangrove areas and protected areas, ancestral domains, civil and military reservations, urban areas under the greening plan of the LGUs, inactive and abandoned imine sites, and, riverbanks, stream banks and other suitable public lands; WHEREAS, DENR is the primary government agency responsible for the conservation, ‘management, development and proper use of the country’s environment and natural resources; EO 26 designated the DENR as the lead agency in the implementation of the NGP; WHEREAS, PTFCF is @ non-stock, non-profit organization that provides resources to support forest conservation inthe Philippines; WHEREAS, FPE is a non-stock, non-profit organization with a goal, among others, to initiate, assist and finance projects that support biodiversity conservation and sustainable evelopment efforts in the Philippines; x WHEREAS, PTFCF and FPE represent their respective network/s and/or partner CSOs ‘who will be involved in the production of seedlings, planting, and maintenance of reforestation areas under the NGP; NOW THEREFORE, in consonance with the above premises, the PARTIES hereby enter into this agreement based on collaborative efforts and complementation of resources 10 ‘mutually support the National Greening Program as a means to achieve sustainable development for poverty reduction, food security, biodiversity conservation and climate change mitigation and adaptation. FURTHERMORE, Parties commit to promote and use of Philippine native forest and fruit bearing tree species consistent with the Convention on Biological Diversity and the ‘employment of community-based forest management strategy, and hereby further agree as follows: ARTICLE I - ROLES AND RESPONSIBILITIES OF THE PARTIES Section 1. The DENR shall: 1 Enter into an appropriate agreement with identified partner on-site civil society organizations (CSOs) of FPE and PTFCF and based thereon provide financial and technical support for the production of seedlings, planting, ‘maintenance, monitoring and protection: Provided that CSOs shall refer to people's organizations, associations, cooperatives, indigenous peoples’ ‘organization and other such community organizations which shall directly implement the activities and benefit from such, 12 Guarantee payment to CSOs within 30 days according to the schedule of releases subject to existing accounting and auditing laws, rules and regulations as follows: First release ~ 15% upon signing and submission of work and financial plan; Second release ~ 25% of contract price upon the attainment of the agreed number of seedlings with 10% allowance for mortality and at least three ‘months after potting or the attainment of 50% of the height and diameter of the target species; Third release -25% payment will be made upon delivery by the CSOs and inspection by DENR at the planting site and the seedlings meeting agreed number and standards; Fourth release -25% payment upon site clearing, hole digging and planting of seedlings according to agreed density and planting standards; Retention fee — 10% payment upon achieving a survival rate of at least 859% ‘three months after planting. 13 Guarantee timely payment based on the agreed work and financial plan of (CSOs engaged to plant, maintain, protect and monitor; 1.4 Issue the appropriate permit to partner CSOs for the collection of seeds and wildings, including transport, if necessary; 1s Enroll partner CSOs in a registry of production areas and develop a mechanism for appropriate benefit sharing in the utilization thereof; 1.6 Mobilize and instruct its bureaus, attached agencies and field offices, (i. Regional Offices, PENROs, CENROs) to ensure the implementation of this partnership agreement; Lead the survey, mapping and delineation of planting sites; Include the PTFCF and FPE representatives in the NGP Experts’ Panel; Facilitate the enrolment of qualified CSO members to DSWD-Conditional ‘Cash Transfer Program and other related government programs. : vii a Ks Fr Section 2. PTFCF shall: 24 22 23 24 25 26 27 2.8 Provide counterpart resources in the form of projects and programs to support the ‘objectives and outcomes of the NGP; Mobilize its partners and networks to ensure production of sufficient quantity of seedlings, consistent with quality standards of the NGP; Provide list of CSOs that are engaged in the NGP, specifying its household ‘members, gender, age, and contact information; Provide specific location of CSO nurseries, species to be raised and production quantities; Share list of Seed Production Areas (SPAs)/ seed sources and information on phenology, species and other relevant information; Participate in NGP activities, to ensure that there is sufficient coordination of efforts and that its wealth of experience in forest conservation is shared in shaping national policies and guidelines in implementing the NGP; Provide supervision and guidance to CSOs to ensure timely and satisfactory production of quality seedlings, planting maintenance, and protection of Philippine native forest and fruit bearing tre species; Facilitate the regular and timely submission of accomplishment reports to the DENR by partner CSOs. Section 3. FPE shall: 31 32 33 34 35 3.6 37 38 Provide counterpart resources in the form of existing projects and programs to support the objectives and outcomes of the NGP. Mobilize its partners and networks to ensure production of sufficient quantity of seedlings, consistent with quality standards of the NGP. Provide list of CSOs that are engaged in the NGP, specifying its household members, gender, age, and contact information. Provide specific location of CSO nurseries, species to be raised and production quantities. Share list of Seed Production Areas/ seed source and information on phenology, species and other relevant information. Participate in NGP activities, to ensure that there is sufficient coordination of efforts and that its wealth of experience in community-based biodiversity conservation and sustainable development is shared in shaping national policies ‘and guidelines in implementing the NGP. Provide supervision and guidance to CSOs to ensure timely and satisfactory production of quality seedlings, planting maintenance, and protection of Philippine native forest and fruit bearing tree species; Facilitate the regular and timely submission of accomplishment reports to the DENR by partner CSOs. DENR, FPE and PTFCF shall: 4.1 Agree on the form and levels of technical assistance to be provided to CSOs in the ‘production, planting and nurturing of Philippine native forest and fruit bearing ‘tree species; 4.2 Establish a mechanism to identify, map and protect seed production areas, 43. Establish a mutually agreed upon monitoring protocol for use in the monitoring and assessment of the activities of partner CSOs in relation to seedling production, planting, and maintenance employing the use of Global Positioning ‘System- (GPS) based geo-tagging photo technology; 44 Establish a mutually agreed upon control mechanism for the timely actual release of funds by the Provincial Environment and Natural Resources Offices (PENROs) or the Community Environment and Natural Resources Offices (CENROs) to partner CSOs; 4.5 Share relevant information such as standards, priorities, focus areas, partnership ‘with local organizations, completed initiatives, reports, and other essentials to planning and implementation of the NGP; 46 Jointly plan and prepare the annual work and financial plan, and monitor the implementation of this agreement vis-a-vis the use of native tree species starting 2013, with the intention to create a roadmap that would ensure the planting of Philippine native trees in all future reforestation projects. ARTICLE I - TERM AND EFFECTIVITY Section 5. The parties herein shall carry out their respective roles and responsibilities upon signing of the Agreement which shall remain in force until June 30, 2016, unless terminated by ‘mutual parties involved without prejudice to the fulfillment of the obligations of the parties under this Agreement. Section 6. The terms and conditions of this Agreement shall be effective upon approval and ing hereof by the parties. Provisions in this Agreement may be modified, altered or supplemented subject to the mutual agreement of both parties. ARTICLE Ill - TERMINATION ‘Section 7. Any party may terminate this partnership agreement for a cause thirty (30) days upon prior written notice. ARTICLE IV ~ MISCELLANEOUS PROVISIONS Section 8, The parties shall exert all efforts to fulfill their respective commitments for the successful implementation of this partnership agreement and the National Greening Program. Section 9. Separability. If any provision contained herein is invalid, illegal or unenforceable in any respect under any applicable law or decisions, the validity, legality and enforceability of the remaining provisions shall not be affected or impaired in any way. v Ose «h GH IN WITNESS HEREOF, the parties hereto have set their hands on date and place above written.
