To amend title IV of the Public Health Service Act to require the Secretary
of Health and Human Services, acting through the Director of the
National Institutes of Health, to consult with certain heads of Federal
agencies with respect to biomedical research that may affect national
security, and for other purposes.

A BILL
To amend title IV of the Public Health Service Act to
require the Secretary of Health and Human Services,
acting through the Director of the National Institutes
of Health, to consult with certain heads of Federal agen-
cies with respect to biomedical research that may affect
national security, and for other purposes.

1 SECTION 1. SHORT TITLE.

2 This Act may be cited as the ‘‘Securing and For-


3 tifying Everyday Biomedical Research Act’’ or the ‘‘SAFE
4 Biomedical Research Act’’.
5 SEC. 2. DUTIES OF THE DIRECTOR.

6 Section 402(b) of the Public Health Service Act (42


7 U.S.C. 282(b)) is amended—
8 (1) in paragraph (24), by striking ‘‘; and’’ and
9 inserting a semicolon;
10 (2) in paragraph (25)(B), by striking the period
11 and inserting a semicolon; and
12 (3) by inserting after paragraph (25) the fol-
13 lowing:
14 ‘‘(26) shall consult with the Director of the Of-
15 fice of National Security within the Department of
16 Health and Human Services, the Assistant Secretary
17 for Preparedness and Response, the Director of Na-
18 tional Intelligence, the Director of the Federal Bu-
19 reau of Investigation, and the heads of other appro-
20 priate agencies on a regular basis, regarding bio-
21 medical research conducted or supported by the Na-
22 tional Institutes of Health that may affect or be af-
23 fected by matters of national security; and
24 ‘‘(27) shall ensure that recipients of awards
25 from the National Institutes of Health, and, as ap-
26 propriate and practicable, entities collaborating with

1 such recipients, have in place and are adhering to
2 appropriate technology practices and policies for the
3 security of identifiable, sensitive information, includ-
4 ing information collected, stored, or analyzed by do-
5 mestic and foreign entities.’’.
