OTHER LAWS RELATED TO THE TEACHING PROFESSION

Laws are essential for a harmonious and orderly co-existence with one another. The
Teaching Profession is governed by several laws sanctioned by the Philippine
government.

Come and familiarize yourself with these laws, they will be your guide in this

LESSON 1. RA 6728 – Government Assistance to Students and Teachers in Private
Education Act.

ACTIVITY A. ENGAGE

Situation: This Pandemic Crisis, students and teachers were given by the government
financial assistance because of the “lock down”.

Question: What can you say about this? Give your observations.

Instructions: Write your answer on a short bond paper in not more than 10 sentences.

Education

Section 4. Forms of Assistance. - Assistance to private education shall consist of:

(1) Tuition fee supplements for students in private high schools, including students in
vocational and technical courses;

(2) High School Textbook Assistance Fund: Provided, That students in public schools
shall be provided a comprehensive textbook program under the Secondary Education
Development Program (SEDP);

(3) Expansion of the existing Educational Service Contracting (ESC) Scheme;


(4) The voucher system of the Private Education Student Financial Assistance Program
(PESFA);

(5) Scholarship grants to students graduating as valedictorians and salutatorians from


secondary schools;

(6) Tuition fee supplements to students in private colleges and universities;

(7) Education Loan Fund; and

(8) College Faculty Development Fund.

READING: The government has many financial assistance programs to students and
schools all over the country. These are given in many forms such as scholarships, free
education, study leave, etc. Local government units also sponsors scholarships/financial
assistance to financially handicapped families and many more.

LESSON 2.B.
RA 8545. Expanded Government Assistance to Students and Teachers in Private
Education Act.

ACTIVITY A. Engage.
Instruction: Make a dialogue/comic strip about a learner in the public school and a
learner in the private school. Their topic of conversation is about their scholarship grant
given by the government. Do this on a short bond paper. Use your ingenuity in
presenting your output.

LESSON 3.C. RA 7877. Anti-Sexual Harassment Act of 1995.

ACTIVITY A. Engage.
Situation:
Lorna is a Senior High School learner. She is bright, beautiful and an active learner. Her
teacher (male) is so much attracted to her. So, he find ways to like him. But, Lorna
doesn’t like his unexplained actions. She tries to evade from him.

Question:
If you are Lorna, would you follow her teacher’s wishes and unexplained actions? What
will you do?

Instruction:
Write your answer on a short bond paper is not less than one-hundred words (100).

READING: RA 7877 – ANTI SEXUAL HARASSMENT ACT OF 1995.

SECTION 1. Title. – This Act shall be known as the “Anti-Sexual Harassment Act of
1995.”
SECTION 2. Declaration of Policy. – The State shall value the dignity of every individual,
enhance the development of its human resources, guarantee full respect for human
rights, and uphold the dignity of workers, employees, applicants for employment,
students or those undergoing training, instruction or education. Towards this end, all
forms of sexual harassment in the employment, education or training environment are
hereby declared unlawful.

SECTION 3. Work, Education or Training -Related, Sexual Harassment Defined. – Work,
education or training-related sexual harassment is committed by an employer,
employee, manager, supervisor, agent of the employer, teacher, instructor, professor,
coach, trainor, or any other person who, having authority, influence or moral
ascendancy over another in a work or training or education environment, demands,
requests or otherwise requires any sexual favor from the other, regardless of whether
the demand, request or requirement for submission is accepted by the object of said
Act.

LESSON 4. D. RA 8190. June 11, 1996.


An Act granting priority to residents of the Barangay, Municipality or City where the
school is located in the appointment or assignment of classroom Public School
Teachers.

Situation: Presently, this time of Pandemic Crisis, husband and wives are tolerated to
ride together on a motorcycle, provided they will show some proof that they are
couples.

Question:
1. What is the reason of the government, why at first, they don’t permit these
couples to ride together on their motorcycle?
2. Why is that the couple also insist to ride together especially going to and from
their workplace?

Section 1. In the appointment or assignment of teachers to public elementary or


secondary schools, priority shall be given to bona fide residents of the barangay,
municipality, city or province where the school is located: Provided, That the teacher
possesses all the minimum qualifications for the position as required by law.

Protests regarding the appointment or assignment of classroom public schoolteachers


shall prescribe in three (3) months upon the issuance of such appointments or
assignment

Sec. 2. In the exercise of its disciplinary authority, the Secretary of Education, Culture
and Sports shall impose the following administrative sanctions for any willful violation of
this Act: (1) first violation — suspension of one (1) month without pay; (2) second
violation — suspension of two (2) months without pay; and (3) third violation and
subsequent violations hereof — suspension of six (6) months without pay.

Sec. 3. The Department of Education, Culture and Sports (DECS) shall prescribe the
rules and regulations necessary to implement this Act. The DECS shall provide the
senate and the House of Representatives a copy of the rules and regulations within
ninety (90) days after approval of this Act.

Sec. 4. All laws, decrees, executive orders, rules and regulations, or parts thereof
inconsistent with this Act are hereby repealed or modified accordingly.

of violence against women and their children. Be able to indicate the step by step
procedure in making formal complaints, you may refer to the law itself for your
guidance.

violence against women and their children. Enumerate as many as you can, use bullet

 For the protection of family, women and children.


 Violence refers to any act/series of acts committed by any person against a
woman who is his wife, former wife or against a woman with whom the person
has or had a sexual or dating relationship, or with whom he has a common child,
or against his child whether legitimate or illegitimate, within or without the family
above, which result in or is likely to result in physical, sexual, psychological harm
or suffering, on economic sense including threats or such acts, battering, assult,
coercion, harassment or ordinary deprivation of liberty.
 Also included in the violence are: Physical Violence, Sexual violence,
psychological violence, economic abuse.
 Take note of Section 5, enumeration of acts of violence against women and their
children (Letter A-I)

Instruction: These are four kinds of violence committed. Make a diagram of your own
wherein this kind of violence will be shown. Write below each kind salient examples. Be

LESSON 6. RA 9710 – The Magana Carta of Women

ACTIVITY A. Engage.
Question: Have you heard, read or seen women who holds important positions in our
government.
Instruction: List down names of women who holds important positions in our
government. Write their positions and their names.

1. What countries in the world are popularly known of racial discrimination?
2. What would be the effect of this racial discrimination to mankind? Explain briefly.

READING: RA 9710. Magna Carta of Women.
- Affirms the role of women in nation building and ensures the substantial equality
of women and men.
- Promotes the empowerment of women and promote equal opportunities.
- This law grants protection to women and ensure non-discrimination in all aspects
of society.

ACADEMIC EXERCISE.
Instruction: In a cartoon, illustrate popularly known women all over the world who
holds position in the government. Do this on a short bond paper. Creatively express
your presentation.

READING D. Elaborate
READING:
Women deserves recognition and protection in all civilized countries such as the
Philippines. With the changing times and seasons, the women sector have little by little
obtained social, cultural, political and institutional recognition. Year after year, their
voices are given credit and consideration. Organizations pushing for women’s rights
have become even more aggressive in ascertaining the privileges that women should be
deserving of.

ACADEMIC EXERCISE
Instruction: Make an illustration of how you will present the qualities of an ideal
woman. Do this creatively on a short bond paper.

LESSON 7. G. – RA# 8491 – Flag and Heraldic Code of the Philippines.

ACTIVITY A. ENGAGE
Intention: Draw a scenario of a Flag Ceremony in school with the presence of the
learners and teachers. Give emphasis to the Raising of the Flag. You may use your own
style, how you will present this. Do this on a short bond paper.

ACTIVITY B. Explore.
Instruction: In your elementary and high school years, you were taught about the
essential features of the drawing of our flag. Do this on a short bond paper. Answer the
questions briefly.

2. What does each symbolize?
3. How many rays are there?

LESSON 8.H. RA 10157. The Kindergarten Education Act


AN ACT INSTITUTIONALIZING THE KINDERGARTEN EDUCATION INTO THE BASIC
EDUCATION SYSTEM AND APPROPRIATING FUNDS THEREFOR.

ACTIVITY A. Engage.

Section 1. Short Title. - This Act shall be known as the "Kindergarten Education Act".
Section 2. Declaration of Policy. - In consonance with the Millennium Development
Goals on achieving Education for All (EFA) by the year 2015, it is hereby declared the
policy of the State to provide equal opportunities for all children to avail of accessible
mandatory and compulsory kindergarten education that effectively promotes physical,
social, intellectual, emotional and skills stimulation and values formation to sufficiently
prepare them for formal elementary schooling. This Act shall apply to elementary school
system being the first stage of compulsory and mandatory formal education. Thus,
kindergarten will now be an integral part of the basic education system of the country.
Kindergarten education is vital to the academic and technical development of the
Filipino child for it is the period when the young mind's absorptive capacity for learning
is at its sharpest. It is also the policy of the State to make education learner-oriented
and responsive to the needs, cognitive and cultural capacity, the circumstances and
diversity of learners, schools and communities through the appropriate languages of
teaching and learning.

our country will be more of a quality education.

RA 10533 – AN ACT ENHANCING THE PHILIPPINE BASIC EDUCATION SYSTEM BY
STRENGTHENING ITS CURRICULUM AND INCREASING THE NUMBER OF YEARS FOR
BASIC EDUCATION, APPROPRIATING FUNDS THEREFOR AND FOR OTHER PURPOSES

Be it enacted by the Senate and House of Representatives of the Philippines in


Congress assembled:
Section 1. Short Title. — This Act shall be known as the "Enhanced Basic Education Act
of 2013″.

Section 2. Declaration of Policy. — The State shall establish, maintain and support a
complete, adequate, and integrated system of education relevant to the needs of the
people, the country and society-at-large.

Likewise, it is hereby declared the policy of the State that every graduate of basic
education shall be an empowered individual who has learned, through a program that is
rooted on sound educational principles and geared towards excellence, the foundations
for learning throughout life, the competence to engage in work and be productive, the
ability to coexist in fruitful harmony with local and global communities, the capability to
engage in autonomous, creative, and critical thinking, and the capacity and willingness
to transform others and one’s self.

For this purpose, the State shall create a functional basic education system that will
develop productive and responsible citizens equipped with the essential competencies,
skills and values for both life-long learning and employment. In order to achieve this,
the State shall:

(a) Give every student an opportunity to receive quality education that is globally
competitive based on a pedagogically sound curriculum that is at par with international
standards;

(b) Broaden the goals of high school education for college preparation, vocational and
technical career opportunities as well as creative arts, sports and entrepreneurial
employment in a rapidly changing and increasingly globalized environment; and

(c) Make education learner-oriented and responsive to the needs, cognitive and cultural
capacity, the circumstances and diversity of learners, schools and communities through
the appropriate languages of teaching and learning, including mother tongue as a
learning resource.

Section 3. Basic Education. — Basic education is intended to meet basic learning needs
which provides the foundation on which subsequent learning can be based. It
encompasses kindergarten, elementary and secondary education as well as alternative
learning systems for out-of-school learners and those with special needs.

Section 4. Enhanced Basic Education Program. — The enhanced basic education


program encompasses at least one (1) year of kindergarten education, six (6) years of
elementary education, and six (6) years of secondary education, in that sequence.
Secondary education includes four (4) years of junior high school and two (2) years of
senior high school education.
For kindergarten and the first three (3) years of elementary education, instruction,
teaching materials and assessment shall be in the regional or native language of the
learners. The Department of Education (DepED) shall formulate a mother language
transition program from Grade 4 to Grade 6 so that Filipino and English shall be
gradually introduced as languages of instruction until such time when these two (2)
languages can become the primary languages of instruction at the secondary level.

Section 5. Curriculum Development. — The DepED shall formulate the design and
details of the enhanced basic education curriculum. It shall work with the Commission
on Higher Education (CHED) to craft harmonized basic and tertiary curricula for the
global competitiveness of Filipino graduates. To ensure college readiness and to avoid
remedial and duplication of basic education subjects, the DepED shall coordinate with
the CHED and the Technical Education and Skills Development Authority (TESDA).
Section 8. Hiring of Graduates of Science, Mathematics, Statistics, Engineering and
Other Specialists in Subjects With a Shortage of Qualified Applicants, Technical-
Vocational Courses and Higher Education Institution Faculty. — Notwithstanding the
provisions of Sections 26, 27 and 28 of Republic Act No. 7836, otherwise known as the
"Philippine Teachers Professionalization Act of 1994″, the DepED and private education
institutions shall hire, as may be relevant to the particular subject:

(a) Graduates of science, mathematics, statistics, engineering, music and other degree
courses with shortages in qualified Licensure Examination for Teachers (LET) applicants
to teach in their specialized subjects in the elementary and secondary education.
Qualified LET applicants shall also include graduates admitted by foundations duly
recognized for their expertise in the education sector and who satisfactorily complete
the requirements set by these organizations: Provided, That they pass the LET within
five (5) years after their date of hiring: Provided, further, That if such graduates are
willing to teach on part-time basis, the provisions of LET shall no longer be required;

LESSON 10. RA 10931 – Universal Access to Quality Testimony Education Act

SUMMARY
Module 1, was about the study of “other laws related to the Teaching Profession”. Each
law was in the form of Republic Acts and their number. Important articles and sections
were discussed and studied. Activities were performed by the learners to deepen their
knowledge and understand the concepts of each teacher-related laws.
