p) Carrier/owner shall be responsible for all cargo loss/damage including but not limited to, pilferage,
short landed, short-delivery wet damage, sinking of ship, fire and piracy.

q) After completion of fumigation, vessel has to sails out and moves directly from loadport to
discharge port in her routine waterway, otherwise Owner shall be held for full responsibilities /
liabilities for all risks/damages/expenses arising from the delay of the vessel's departure.

r) Owner must cooperate closely with Charterer's Cargo Handler and disport agent to secure
discharging operation at disport smoothly and safely)
s) Owner to guarantee that the descriptions of the vessel are correct and any breach by Owner of any
term formingpart of the descriptions of the vessel will give Charterer the option to terminate this
fixture note and/or claim for damages, if any.
0 Owner must arrange qualified vessel to arrive the load port to ensure the arrival period to Philippine -
ports. Otherwise, Owner shall be held for full responsibilities / liabilities for any-
problems/expenses arising from late of vessel laycan/arrival time. The Charterer has the right to ,
refuse the vessel and claim for losses/damaged arisen from late of vessel laycan/arcival time.

u) Owner must provide Charterer below documents with signatures of conceming parties :

- Daily discharging report..


- Tally sheet.
- Notice of loss/damage.
- Report on Receipt of Cargo
- Cargo Outtum Report (latest 5 days after completion of discharge)
- Cargo manifest
- Stowage plane
- Mate's receipt.
- Others documents as per Insurance Company's request

15. Extra cost for usual marine insurance on goods due to vessel's age fifteen (15) years and above f
for cargo packed in bags shall be for the account of the Owner and shall be deducted from the freight .t

16. Other Terms and Conditions :


a) Transshipment is not allowed.
b) Combine shipment is allowed.
c) Shipment of any cargoes other than rice is strictly prohibited.
d) Taxes, dues, levies on vessel to be at Owner's account at both ends. Taxes, dues, levies on cargo to
be at Charterer's account and Consignee's account at loadport and disport respectively.
e) Tally at shipside to be for Owner's account at both ends. Tally at dockside to be for Charterer's
account at loadport andfor Consignee's account at disport.
f) Should the vessel be detained by Authorities at loading/discharging port, the direct actual expenses
