JUDICIAL COUNTER-AFFIDAVIT

I, EDGARDO DAMOHOY, Filipino, 32 years old, married, and a resident

of Basak Pardo, Cebu City, after having been sworn to according to law hereby
depose and say:

1. That I am the respondent in the above-entitled case:

2. That ATTY. JOSMAN MANDAL, a resident of Talamban, Cebu City,
Philippines, is the counsel who conducted and supervised my
examination as a respondent at her law office at MANDAL Law Office,
third floor, Colon St., Cebu City, Philippines.

3. That I am answering the questions asked of me, fully conscious that I am

doing this under oath and that I may face criminal liability for false
testimony or perjury if I state falsehood in my testimony. The whole
process has been done in Visayan which language is understood by me,
and translated into English and explained to me.

4. That the following are questions asked of me and answers that I gave to
the questions:

Pangutana 1: Unsa imong apil-kalabot ni ining maong kaso?

Tubag 1 : Ako ang usa sa naka saksi ni ining kasoha og ako sad ang nitawag sa
kapulisan.

[Q1: What is your involvement in this case?

A1: I am one of the witness of this present case and the one who called the
Police].

P2: Aduna ka bay kaugalingon nahibalo-an sa sinumbong o akusado ni ining

maong kaso?
T2: Oo ma’am, ako nakaila ni Edgardo Damohoy, alias “Edgar”, tungod kay siya
kay akoang pud nga silingan og usa ka lumolupyo sa Basak Pardo, Cebu City.

[Q2: Do you personally know the accused in this case?

 A2: Yes ma’am, I know Edgardo Damohoy, nicknamed “Edgar” because he
is my neighbor who is residing also in Basak Pardo, Cebu City].

P3: Ni adtong Septyembre 23, 2021, ilabi niadtong mga oras alas otso sa gabie,
makahinumdom kaba kon asa ka niadtong panahona?
T3: Niadtong petsaha og orasa, didto ako sa tindahan ngaa sa kilid sa balay ni
Edgardo Damohoy kay nagpalit ko og bugas.

[Q3: On September 23, 2021, particularly at 8 o’clock in the evening, can

you recall where were you?
A3: On September 23, 2021 at 8 o’clock in the evening I went to the store
near Edgardo Damohoy’s house to buy rice].

P4: Pwede ba nimong mahinumdoman ug ibungat ug unsay nahitabo ni atong

panahona?
T4: Nakadungog ko nga nag sinyagitay ang akusado og ang biktima pero wala ra
nako gitagad.

[Q4: Can you recall and state what happened during that time?
A4: Yes, I heard the accused and the victim shouting but I did not mind it].

P5: Paghuman ato unsa ang lain pa nimo nga namatikdan?

T5: Pila ka minuto ang nilabay naka dungog nalang ko og kusog nga paglamba og
tungod ato ako kini gisusi.

[Q5: After that did you notice anything else?

A5: Minutes have passed and I heard a loud bang and because of that I
checked where it came from].

P6: Unsa man ang imong nakita sa imong pagsusi?

T6: Nakit-an nako ang lawas sa biktima nga naghigda na sa yuta og ang akusado
nga nag barog atobangan ini nga nay dugo ang kamot.

[Q6: Upon checking what you have heard, what did you saw?
A6: I saw the victim lying on the ground while the accused was standing in
front of her with blooded hands].

P7: Unsa ang imong gibuhat human sa imong nakita?

T7: Ni syagit ko tungod sa ako ka kurat sa nahitabo og mao to nakalingi ang uban
nga taw hinungdan nga nidagan palayo ang akusado.

[Q7: What did you do after you what you saw?

A7: I screamed because of the shock and this caught bystander’s attention
that made the accused escaping the scene].

P8: Unsa man ang sunod nga panghitabo?

T8: Ni duol dayon ko sa biktima unya nitawag og pulis unya nanawag og tabang sa
uban aron manawag pud og ambulansya.

[Q8: What happened after that?

A8: I immediately approached the victim and called the police and ask for
help from others to call an ambulance].
P9: Pag abot sa mga pulis unsa man ang imong gibuhat?
T9: Gi imbitar ko nila nga mo adto sa police station para mainterbyo ko nila og ni
sugot ko aron makatabang sad ko og hatag sa kinahanglan nila nga impormasyon
og kini base sa akong nasayran.

[Q9: Upon the arrival of the police, what did you do?
A9: I was invited by the police officers to their police station to be
interviewed and I agreed so I could help them get the information they
needed based on my personal knowledge regarding the crime].

P10: Unsa man ang nahitabo sa estaston sa kapulisan?

T10: Pag-abot namo didto ila ko gi interbyo mahitungod sa krimen og unya
gipapirma sa affidavit isip witness sa krimen nga nahitabo.

[Q10: What happened in the police station?

A10: After arriving at the police station, they interviewed me regarding the
crime and let me sign the affidavit as a witness of the crime].

P11: Aduna ba kay kopya sa affidavit nga imong ge permahan didto sa Police
Station ug buot ba ka nga akoa kining ilakip isip Annex “A” sa imong judicial
affidavit?
T11: Oo, aduna ug uyon ko sa imong pagabuhaton.

[Q11 : Do you have a copy of the affidavit that you signed at the Police
Station and do you agree that I will include it as Annex “A” to your
judicial affidavit?
A11 : Yes I have and conform to your action].

P10: Adunay pa ba kay uban nga idugang Gng. Dela Torre?

T10: Wala na koy madugang pa Ma’am.

[Q10: Do you have anything else to add Mrs. Dela Torre?

A10: I have nothing more to add Ma’am].

AFFIDAVIT OF WITNESS

I, KRIS DELA TORRE, Filipino, 32 years old, married, and a resident of

Basak Pardo, Cebu City, after having been sworn to according to law hereby
depose and say:

1. That I am a witness to the case of FRUSTRATED HOMICIDE against

EDGARDO DAMOHOY.

2. That sometimes in September 23, 2021 I saw EDGARDO DAMOHOY

standing in front of MARIA TORRES with blooded hands.

3. That the truth of the matter is hereby stated hereunder.

a. On September 23, 2021 at 8 o’clock in the evening I went to the store

near Edgardo Damohoy’s house to buy rice.

b. That I heard the accused and the victim shouting but I did not mind it
until I heard a loud bang.

c. Upon checking where it came from I saw the victim lying on the ground
while the accused was standing in front of her with blooded hands. The
accused was able to escape the scene and I immediately called for help.

d. The ambulance and police arrived and the victim was rushed immediately
to the hospital while to police officer interviewed me regarding the crime
that happened.

4. That I am executing this affidavit to the best of my knowledge of the facts

and circumstances to support the filing of a case for FRUSTRATED
HOMICIDE against EDGARDO DAMOHOY in court and for whatever
legal purpose this may serve.
