Application of the Law
Case: Ms. Lovely Sy wants to build a three-star hotel in Cebu City. She proposed to the investors of the hotel
that all the rooms be provided with technologically advanced, efficient, and adequate air-conditioning units
with no window openings. She proposed that expensive brightly colored paintings be placed and installed
inside the rooms to attract guests instead of placing window openings to preserve the quality of the
paintings that will be placed inside the rooms. Is the proposal of Ms. Lovely allowed? Is there any law
violated?

ANSWER:

 Based in the National Building Code og the Philippines Under Light and Ventilation,
Section 801, Subject to the provisions of the Civil Code on Easement of Light and View,
and the provisions of this part of the code, every building shall be designed, constructed,
and equipped to provide adequate light and ventilation. Even she will provide air-
conditioning units, natural air and view are more important to a place that can be
applicable to all people or accommodators, she can place the paintings on the side
where the sun are not directly entering. Also, this should be applicable to the people who
will stay at place, some has difficulties on staying in some secluded areas, where
ventilation of the air, should be present. Since this time we have to adapt of the
pandemic, as per study of some professionals, proper ventilation is a must for any
buildings or area. Ventilation can also bethe best feature for the hotel to bring more lot of
guest. Rooms of the hotel are not required with some unnecessary object, those
necessary item that should be in a particular hotel must be at priority

 The given case is under the National Building code of the Philippines particularly in Light
and Ventilation Section 808 Window Openings according to this law every room must
intended for any use, not provided with artificial ventilation system as herein specified in
this code shall be provided with a window. Yes, Ms. Lovely Sy’s proposal is not allowed
for a reason what if any emergency might happen and then there is no any window
openings? It may cause more trouble to the hotel room that’s why it is important that
window openings must a factor that needs to consider in Ms. Lovely Sy’s proposal. Even
in her proposal the hotel rooms be provided with technologically advanced, efficient, and
adequate air-conditioning.
