DEED OF ABSOLUTE SALE

KNOW ALL MEN BY THESE PRESENTS:

This Deed of Absolute Sale, made and entered this ____ day of December
2020, in Murcia, Negros Occidental, by and between:

LEONCIO T. TALABAN, of legal age, Filipino, married to NELLY R.


TALABAN, and with postal address at Purok San Ramon, Brgy.
Santa Cruz, Murcia, hereinafter referred to as the SELLER;

and

PEDRO A. CANSON, of legal age, Filipino, married to ANTONIO C.


CANSON with residence address at Block 9, lot 9, NGO Village,
Brgy. Handumanan, Bacolod City, Negros Occidental hereinafter
referred to as the BUYER.

WITNESSETH: THAT

WHEREAS, the SELLER is the registered lawful and actual possessor of a


certain parcel of land situated in Brgy. Santa Cruz, Murcia, Province of Negros
Occidental, and more particularly described and bounded as follows:

TRANSFER CERTIFICATE TITLE NO. CLOA-18002

A PORTION OF PARCEL OF LAND OF AGRICULTURAL LAND


(Lot 3. Pcs-06-005364 (AR), being a Consolidated Subdivision of
Lot 172-A, 172-1, 172-K, Psd-06-057564 (AR), situated in the
Barangay of Sta. Cruz, Municipality of Murcia, Province of Negros
Occidental, Island of Negros; –x x x – containing an area of TWELVE
THOUSAND FIVE HUNDRED FIXTY SIX (12,556) square meters.

WHEREAS, the BUYER offered to buy a portion of the above-mentioned


parcel of land amounting to an area of SIX THOUAND SIX HUNDRED SIXTY
SEVEN (6,667) SQUARE METERS from the Seller and the latter by virtue of
these presents has agreed to sell the same portion together with all the
improvements found thereats;

NOW, THEREFORE, for and in consideration of the amount of ONE


MILLION PESOS (P1,000,000.00), Philippine Currency, receipt in full is hereby
acknowledged by the SELLER to his satisfaction, the SELLER SELLS, CEDES,
TRANSFERS and CONVEYS in a manner that is absolute and irrevocable the
above real property unto the BUYER, his heirs, assigns and successors-in-
interest.

The SELLER warrants that he can transfer the title and possession of the
aforesaid real estate property to the BUYER and that there are no other
transactions pending registration with the Registry of Deeds in the Municipality
of Murcia that will adversely affect the rights of the BUYER.
THAT any and all expenses incidental to the registration and conveyance
of the title from the name of the SELLER to the name of the BUYER such as
Transfer Tax, Documentary Tax, registration expenses and the like shall be the
sole and exclusive account of the BUYER: provided, that capital gains tax shall
be for the account of the BUYER.

IN WITNESS WHEREOF, the parties have hereunto signed this DEED


OF ABSOLUTE SALE this _____ day of December 2020 at the date and place
first above mentioned.

pages including this page, and that the parties and their witnesses signed their
names and a portion of the parcel of land covered by TCT No. CLOA-18002 of
the Registry of Deeds of Murcia.
