COMMITTEE REPORT
RE: PRPOSED MEASURE NO. 28-2021 : PROPOSED MEASURE ENDORSING TO
THE MUNICIPAL DEVELOPMENT COUNCIL (MDC) FOR THE INCLUSION TO
THE LGU ANNUAL INVESTMENT PLAN (AIP) CY 2021 AND TO THE
SANGGUNIANG BAYAN FOR THE APPROVAL OF THE MDDRMC
SUPPLEMENTAL PLAN FOR CY 2021

WHEREAS, on March 12, 2021 the Sangguniang Bayan received a correspondence

from the Office of the Mayor transmitting a copy of the abovementioned measure;
WHEREAS, the said measure was immediately referred to the Committee on Laws and
Public Accountability which thereafter conducted a Committee Hearing;
WHEREAS, the committee upon careful reading of the Resolution in its entirety and
upon testimonies of the resource persons invited finds that the said measure is not
intended to be submitted to the Sangguniang Bayan but to the Municipal Development
Council as its nomenclature says so;
WHEREAS, prescinding from the foregoing, this Committee recommends that MDRRMC
Resolution No. 04-2021 be returned to the office a quo for submission to Municipal
Development Council
NOW THEREFORE, the Committee recommends to adopt this committee report.

entitled: “RESOLUTION ERNDORSING TO THE SANGGUNIANG BAYAN THE
APPROVAL OF THE REPROGRAMMIMG AND APPROPRIATION OF
P3,201,622.41 FROM THE MDRRM UNEXPENDED FUND FOR CY 2020 TO
AUGMENT FUNDING FOR COVID-19 ACTION PLANS AND OTHER
REQUIREMENTS OF THE DRRM PROGRAMS IN THE MUNICIPALITY OF GMA,
CAVITE”
WHEREAS, on March 12, 2021 the Sangguniang Bayan received a correspondence
from the Office of the Mayor transmitting a copy of the abovementioned measure;
WHEREAS, the said measure was immediately referred to the Committee on Laws and
Public Accountability which thereafter conducted a Committee Hearing;
WHEREAS, the committee upon careful reading of the Resolution finds that the
proponent failed to append, include the itemized program of works with its
corresponding costings;
WHEREAS, the committee members agreed that in order for them to study the
proposal carefully and thoroughly, specifics of the said measure must be submitted to
them;
WHEREAS, this Committee recommends that the foregoing resolution be returned to
the proponent to comply with the above recommendations of the committee.
NOW THEREFORE, the Committee recommends to adopt this committee report.

RESOLUTION AUTHORIZING THE MUNICPAL TREASURER, IN
COORDINATION WITH THE OFFICE OF THE BUILDING OFFICIAL, TO OPEN
AND MAINTAIN A TRUST FUND ACCOUNT WITH LANDBANK

WHEREAS, a letter from Ms. Mary Ann E. Clariza, the Municipal Treasurer, was
received by the Sangguniang Bayan on February 15, 2021 seeking for the passage of a
Resolution authorizing her to open an account with Landbank of the Philippines;
WHEREAS, Joint Memorandum Circular No. 001 dated July 4, 2013 specifically 2.1 of
the Procedural Guidelines provides that “the local treasurer of the concerned city or
municipality, in coordination with the Office of the Building Official, is hereby authorized
to open and maintain a Trust Fund Account in their area of jurisdiction”
WHEREAS, the same Memorandum provides that subject to budgetary, accounting and
auditing rules and regulations, the Office of the Building Official shall automatically
retain 15% income derived from building permit fees and other charges;
WHEREAS, Presidential Decree 1906 prescribes the procedural guidelines for the
disposition and use of 20% of the Building Permit Fee and Other Charges under the
National Building Code of the Philippines;
WHEREAS, Memorandum Circular No. 03 Series of 2016 reiterates and urge all
concerned officials to faithfully comply with the above-provisions;
WHEREAS, considering the merit of the request of Ms. Mary Ann Clariza, the same is
in order.

P677,522.41 FROM THE NATIONAL GOVERNMENT FUND FOR THE
CONSTRUCTION OF THE SLOPE PROTECTION OF BRGY. BENJAMIN TIRONA
AND TO APPROPRAITE THE SAME IN THE SUPPLEMENTAL AIP PLAN OF THE
MUNICIPALITY ACCORDINGLY”
WHEREAS, on March 12, 2021 the Sangguniang Bayan received a correspondence
from the Office of the Mayor transmitting a copy of the abovementioned measure;
WHEREAS, the said measure was immediately referred to the Committee on Laws and
Public Accountability which thereafter conducted a Committee Hearing;
WHEREAS, the committee upon careful reading of the Resolution finds that the
