FACTS:

This is a Petition for the Issuance of a Writ of Kalikasan and a Writ. of Continuing Mandamus due to
anthropogenic activities within the Mount Santo Tomas Forest Reserve, reads, in part, a petition filed on
behalf of a group of people concerned about the effects of climate change on the environment in the
area.

A petition on behalf of the people of Tuba, Benguet, Baguio and San Fabian, Pangasinan against mining,
deforestation and other activities in Mount Santo Tomas Forest Reserve. According to the petition,
these activities are in violation of the constitutional right of the inhabitants to a safe, healthful, and
balanced ecology.

The petitioners pray for the immediate issuance of a Temporary Environmental Protection Order. The
BWD's reliance on the Amliang dams has been considerably reduced owing to its contamination. It also
issued a Temporary Environmental Protection Order (TEPO) for the area where the company's
operations are based.

ISSUE:

Whether the Supreme Court's Temporary Environmental Protection Order (TEPO) granted in this matter
in its Resolution of September 30, 2014 must be applied retroactively, the Writ of Kalikasan extended
and applied retroactively, and a Writ of Continuous Mandamus issued.

RULING:

Yes, the Court for an order awarding the Writ of Kalikasan and Writ of Continuing Mandamus privileges.

The previously issued Temporary Environmental Protection Order (TEPO) has been ordered to be made
permanent, and halt and desist orders have also been issued against respondents.
