Assessment

1.    Give at least three (3) documents which can be used as references in determining the

property’s description. (3 points)

One of the documents that would determine the property’s description would be the Original

Certificate of Title if the owner of the property is the first titleholder. Another one would be the

Transfer Certificate of Title (TCT) which is issued to the new owner based on the deed of land

conveyances such as sale, donation or assignment. A tax declaration could also be a proof in

reference to determine the property’s description and for a strong proof it could also be supported by

tax receipts.

2.    What are information can be found in each document which is related to the property’s

description? (15 points)

In the Original Certificate of Title, there lies the name of the landowner, full names of all

persons whose interest make up the full ownership of the land, their civil status, names of respective

spouses, citizenship, residence, the description of the property, amount of hectares or square

meters. The certificate also has a seal on the lower left corner to signify its authenticity. This

document also described therein subject to liens and encumbrances noted on it.

Transfer Certificate of Title contains same content with the OCT however in the TCT it also

mentions when the land was originally registered. It also mentions the technical description of the

property and has a memorandum of encumbrances. Just like the OCT it also has a seal on the lower

left corner that signifies authenticity.


For the tax declaration, I’ve only seen photocopies of it but based on what I have observed it

has the name and address of the owner, the place of where the lot is, the name of its neighbouring

lots in north, east, west, and south. Also in tax declaration it shows the market and assessed values

of the property.

3.    How were each document acquired? ( 6 points

OCT can be acquired through judicial or administrative registration. Judicial is done through

the courts while the administrative can be done through DENR. It is registered with the Register of

Deeds of the province or city where the land is located. The TCT can also be acquired within your

nearest Registry of Deeds. Tax declaration on the other hand can be seized in provincial or municipal

office of the assessors.
