IN COMPLETELY AND INCOMPLETELY KNOCKED DOWN CONDITIONS

BY THE GRACE OF GOD ALMIGHTY

MINISTER OF INDUSTRY OF THE REPUBLIC OF INDONESIA

Considering : that to implement the provision of Article 11 paragraph

(3) of Presidential Regulation Number 55 of 2019 on an

Acceleration of Battery-Based Electric Vehicle for road

transportation, it is need to stipulate the Regulation of

Minister of Industry on Battery-Based Electric Vehicle

in Completely and Incompletely Knocked Down

Conditions;
In view of : 1. Article 17 paragraph (3) of 1945 Constitution of
 the Republic of Indonesia;
2. Law Number 39 of 2008 on State Ministry (State

Gazette of the Republic of Indonesia Year 2009

Number 166, Supplement to the State Gazette of

the Republic of Indonesia Number 4916);

3. Law Number 3 of 2014 on Industry (State Gazette

of the Republic of Indonesia Year 2014 Number 4,

Supplement to the State Gazette of the Republic of

Indonesia Number 5492);

4. Presidential Regulation Number 29 of 2015 on

HAS DECIDED:
To Stipulate: : REGULATION OF MINISTER OF INDUSTRY ON

BATTERY ELECTRIC VEHICLE IN COMPLETELY

AND INCOMPLETELY KNOCKED DOWN

CONDITIONS.

CHAPTER I

GENERAL PROVISION
Article 1
In this Minister Regulation referred to with:
1. Battery Electric Vehicle hereinafter referred to as Battery based EV
 is vehicle that driven by electric motor and obtaining electric power

supply from battery directly either in the vehicle or outside the

vehicle.
2. Battery-Based EV Industrial Company is Battery based EV

Industrial Company is established and operated in the Republic of

Indonesia as well as has industry business license.

3. Battery-Based EV in Completely Knocked Down hereinafter

referred to as CKD Battery-Based EV is the imported electric

vehicle in knocked down and complete conditions as Battery-Based

EV.
4. Battery-Based EV in Incompletely Knocked Down hereinafter

referred to as IKD Battery-Based EV is imported electric vehicle in

knocked down and incomplete conditions as a Battery based EV.

5. Main component is Battery-Based EV component which has main

function of a motor vehicle.

6. Supporting Components are part of Battery-Based EV that needed

to function electric vehicle.

7. Battery or Electrical Energy Storage Media hereinafter referred to

as Battery is source of electricity shall be used to provide electrical

supply to the electric vehicle.

8. Approval Letter is the letter certified that Battery based EV Industry

Company may carry out CKD Battery -Based EV importation or

IKD Battery based EV.

9. National Industry Information System hereinafter referred to as

SIINas is the integrated procedural order and work mechanism

including element of institution, human resources, data basis,

hardware and software, as well as data communication network that

connected one each other with objective for delivery, management,

presentation, service, as well as data dissemination and/or industry

 information.
10. Minister is minister who organize government affairs in industry

sector.
11. Director General is director general of Ministry of Industry who has

duty and function to carry out development to the Battery-Based

EV industry.
Article 2
1) Battery based EV Industry Company may carry out import on:

a. CKD Battery based EV; and/or

b. IKD Battery based EV.

2) In addition to importation in the form as referred to in paragraph (1)

Battery based EV Industry Company may also import component.

3) Importation of CKD Battery based EV and IKD Battery based EV

as referred to in paragraph (1) using tariff post for CKD Battery-

Based EV and IKD Battery-Based EV.

4) Component importation as referred to in paragraph (2) uses tariff

post of each component.

Article 3
1) Four wheeled or more Battery based EV industry company may

carry out import in the form of CKD Battery based EV and/or IKD

Battery based EV.

2) Two wheeled or three Battery based EV Industry Company may

carry out import in the form of CKD Battery based EV.

Article 4
In addition to importation in the form as referred to in Article 3, CKD

Battery based EV and IKD Battery based EV shall comply with the

provisions as follows:

a. Regarding Four wheeled or more Battery based EV industry are

valid in accordance with the provision as set out in Regulation of

Minister of Industry on four wheeled or more vehicle industry; and

b. Regarding two wheels Battery based EV industry or three are valid

 in accordance with the provision as set out in Regulation of

Minister of Industry on vehicle industry.

CHAPTER II

CKD BATTERY BASED EV, IKD BATTERY BASED EV

AND BATTERY BASED EV MANUFACTURING PROCESS

Section One

CKD Battery based EV and IKD Battery based EV

Article 5
1) CKD Battery based EV for four wheeled or more Battery based EV

shall include Main Component in the form of:

a. Body, cabin, and/or chassis;

b. Battery; and

c. Drive system.
2) In addition to Main Component as referred to in paragraph (1),

CKD Battery-Based EV for four wheeled or more Battery based EV

may include Supporting Components.

3) Description of Main Component goods as referred to in paragraph

(1) and Supporting Components as referred to in paragraph (2)

contained on Table I-A in Annex I which are constitute inseparable

part of this Minister Regulation.

Article 6
1) IKD Battery based EV for four wheels or more Battery based EV

shall comply with the provision of:

a. Including at least 2 (two) types of goods description of Main

Component and/or Supporting Components;

b. Description of goods as referred to in point a including at most

2 (two) types of goods description of Main Component; and

 c. Does not include excluded components of ID based EV for four

wheeled or more Battery-Based EV.

2) Goods description of Main Component and Supporting

Components as referred to in paragraph (1) contained on Table I-B

in Annex I which are constitute inseparable part of this Minister

Regulation.
3) Excluded Components of IKD Battery-Based EV for four wheeled

or more Battery-Based EV as referred to in paragraph (1) point c

contained on Table I-C in Annex I which is constitute inseparable

part of this Minister Regulation.

Article 7
1) Four wheeled or more Battery based EV industry company held

excluded components of IKD Battery based EV for four wheeled or

more Battery based EV as referred to in Article 6 paragraph (1)

point c with:

a. own production;

b. cooperate in the form of subcontract with other domestic party

for component manufacturing;

c. use components are produced by domestic producer; and/or

d. import.
2) Usage of components are produced by domestic producer as

referred to in paragraph (1) point c including at least 9 (nine) of

excluded components of IKD Battery based EV for four wheeled or

more Battery based EV as referred to in Article 6 paragraph (3).

3) Import of excluded components as referred to in paragraph (1) point

d are carried out provided that:

a. Does not include components are produced by domestic

producer as referred to in paragraph (2); and

 b. Using tariff post of each component.
Article 8
1) CKD Battery-Based EV for two wheeled or three Battery-Based EV

shall include Main Component in the form of:

a. Frame and/or body;

b. Battery; and

c. Drive system.
2) In addition to Main Component as referred to in paragraph (1),

CKD Battery-Based EV for two wheeled or three Battery-Based EV

shall include Supporting Components.

3) Goods description of Main Component as referred to in paragraph

(1) and Supporting Components as referred to paragraph (2)

contained in Annex II which are constitute inseparable part of this

Minister Regulation.
Section Two

Manufacturing Process
Article 9
Battery-Based EV Industry Company shall be obliged to carry out

manufacturing process inside to:

a. CKD Battery-Based EV for four wheeled or more Battery-Based

EV as referred to in Article 5;

b. IKD Battery-Based EV for four wheeled or more Battery-Based EV

as referred to in Article 6; and

c. CKD Battery-Based EV for two wheeled or three Battery-Based EV

as referred to in Article 8.
Article 10
1) Manufacturing process to the CKD Battery-Based EV for four

wheeled or more Battery-Based EV as referred to in Article 9 point

a at least including:

a. Assembling; and
 b. Testing quality control.
2) Manufacture process as referred to in paragraph (1) is carried out to

produce Battery-Based EV in the form of:

a. Road tractor for semi trailer,

b. Vehicle for transportation of 10 (ten) or more including

driver,

c. Car and other vehicle are especially designed for people

transportation (other than post 8702, including station wagon

and racing car, including sub-post 8703.80; and

d. Vehicle for goods transportation, on sub-post 8704.90.

Article 11
1) Manufacture process to the IKD Battery-Based EV for four wheels

Battery based EV or more as referred to in Article 9 point b is

carried out at least 2 (two) of activities as follows:

a. Body printing;

b. Body painting;

c. Making and/or assembling of cabin;

d. Making and/or assembling of chassis;

e. Making and/or assembling of electric motor;

f. Making and/or assembling of axle;

g. Making and/or assembling of battery;

h. Assembling; and

i. Testing and quality control.

Battery-Based EV industry company in conducting manufacturing

process to the IKD Battery-Based EV as referred to in paragraph (1)

shall be obliged to use at least 1 (one) Main Component from

domestic.
2) Manufacturing process as referred to in paragraph 1 (one) is carried
 out to produce Battery based EV in the form of:

a. Road tractor for semi-trailer, including sub-post 8701.20;

b. Vehicle for people transportation, including in sub-post

8702.40;

c. Car and other vehicle are especially designed for people

transportation (other than tariff post 8702), including station

wagon and racing car, including in sub-post 8703.80;

d. Vehicle for goods transportation, including sub-post 8704.90;

e. Vehicle for special needs, other than especially designed for

people or goods transportation (example: crane lorry, fire

engine, concrete mixer lorry, street sweeper lorry, sprayer

lorry, repair shop car, radiology unit car); and

f. Chassis is equipped by machine, as referred to in post 8706,

with machine is replaced by electric motor.

Article 12
1) Manufacturing process to the CKD Battery-Based EV for two

wheeled Battery-Based EV or three as referred to Article 9 point c

at least including:

a. Assembling; and

b. Testing and quality control.

2) Manufacturing process as referred to paragraph 1 (one) is carried

out to produce two wheeled or three Battery-Based EV including

post 8703, post 8704 and sub-post 8711.60.

Article 13
Battery-Based EV of manufacturing process result as referred to in

Article 10, Article 11, and Article 12 shall comply with the specification

of Battery-Based EV as set out in Regulation of Minister of Industry on

Specification, Development Road Map, and Calculation of Local

 Content of Battery-Based Electric Vehicle.
CHAPTER III

IMPLEMENTATION OF CKD BATTERY-BASED EV.

IKD BATTERY-BASED EV, AND EXCLUDED COMPONENTS

OF IKD BATTERY-BASED EV
Article 14
Importation of CKD Battery-Based EV and IKD Battery-Based EV as

referred to in Article 5, Article 6, and Article 8, as well as excluded

components of IKD Battery-Based EV for four wheeled or more

Battery- Based EV or more as referred to in Article 7 is carried out

based on an Approval Letter shall be issued by Director General.

Article 15
1) Battery-Based EV Industry Company submits an application for

Approval Letter as referred to in Article 14 electronically to the

Director General through SIINas.

2) An Application as referred to in paragraph 1 (one) is submitted by

uploading requirement documents in the form of:

a. List of production tools;

b. Import plan of CKD Battery-Based EV, IKD Battery-Based

EV, or excluded components of IKD Battery-Based EV for

four wheeled Battery-Based EV or more for 1 (one) year; and

c. Production realization on CKD Battery-Based EV import, IKD

Battery-Based EV, or excluded components of IKD Battery-

Based EV for four wheeled or more Battery-Based EV that has

been carried out.

3) In the event of manufacturing process implementation is carried out

through cooperation in the form of sub-contract, an application as

referred to in paragraph 2 (two) shall be equipped with sub-contract

agreement.
4) In the event an application for Approval Letter as referred to in

paragraph 1 (one) is submitted for IKD Battery-Based EV,

document as referred to in paragraph 2 (two) equipped with

determination letter that obtained from SIINas.

5) An application as referred to in paragraph 1 (one) uses form

according to Format A as contained in Annex III which is constitute

inseparable part of this Minister Regulation.

Article 16
1) Director General conducts verification to an application as referred

to in Article 15;

2) Verification as referred to in paragraph 1 (one) including

verification over:

a. Company legality;

b. Import plan and realization;

c. Production plan and realization; and

d. Testing process plan as well as quality control

3) Based on verification result as referred to in paragraph (2), Director

General issues Approval Letter or rejection of issuance of Approval

Letter electronically within maximum period of 5 (five) working

days since the submission of application as referred to in Article 16

with complete and correct.

4) Approval Letter as referred to in paragraph (3) is valid for 1 (one)

year since it is issued.

5) Approval Letter as referred to in paragraph (3) uses form according

to Form B as contained in Annex III which is constitute inseparable

part of this Minister Regulation.

CHAPTER IV

REPORTING AND MONITORING

Article 17
1) Battery-Based EV Industry Company has obtained an Approval
 Letter as referred to in Article 16 paragraph (3) shall be obliged to

convey import and production realization report electronically to

the Director General through SIINas.

2) Report as referred to in paragraph (1) is conveyed of each 6 (six)

months from the issued Approval Letter.

3) Report as referred to in paragraph (1) is copy carboned in writing to

the Director General who handle custom duty on ministry that

organize governmental affairs in financial sector.

Article 18
1) Director General carries out monitoring to the Battery-Based EV

Industry Company on implementation compliance of this Minister

Regulation.
2) In monitoring as referred to in paragraph (1), Director General may

coordinate with the relevant institution, Local Government of

Province, and/or Local Government of District/City.

3) Monitoring as referred to in paragraph (1) is carried out at least 1

(one) time in 1 (one) year.

Article 19
Battery-Based EV Industry Company which is:

a. Not convey manufacture process as set out in Article 9; and

b. No convey report as referred to in Article 18,

Shall be imposed administrative sanction in the form of approval letter

is not provided on the next period.

Article 20
1) Ministry who organize governmental affairs in financial sector may

carry out monitoring and verification to the Battery based EV

Industry Company which is producing CKD Battery based EV or

IKD Battery based EV.

2) Monitoring and verification as referred to in paragraph (1) may be

carried out to other domestic company that accept part or all of

manufacture process performance.

 CHAPTER V

CLOSING PROVISION
Article 21
This Minister Regulation is effective commencing from the enaction

date.

In order to make everyone aware of it, instructing the enaction of this

Minister Regulation by its placement in State Gazette of the Republic of

Indonesia.
