Description of the issues that caused the complaints

Listing Issue
· Those products have been listed by the content manager, and he has copied item
description and images from the Amazon because he did not read the Amazon’s policy
before starting the listing. It was my responsibility to ensure that my staff is aware of the
Amazon policies.
· I have understood my mistake now and I have started an investigation for the items that
Amazon claims might be infringing the mentioned trademark in the listing from my
inventory.
· I have noticed that this could also be an attempt of our competitors to remove us from our
listings. Same happened to other sellers.

I now understand that it was my mistake that I haven’t checked the products properly before
listing and shipping them to my customers and I take full responsibility for that.

Steps you have taken to resolve the complaint

· I deleted the conflicting ASIN, and made sure that the entire listing was also deleted.
Meaning I can not modify it as requested, but I have deleted it from inventory and
will not sell it again.
· I have started shipping products by the 3rd party service provider now (FedEx & UPS),
after the Lockdown of COVID-19, I will send all products to the Amazon FBA
warehouse.
· I have enrolled with FBA and I will transfer all my product to the FBA.
· I have decreased the stock as now due to currier transportation problem
many buyers not getting products on time and we also not able delivered that on time.
· I have learned about the Anti-counterfeiting policy very well
(https://sellercentral.amazon.com/gp/help/external/201165970) and I am now carefully
aware of those violations, in particular that it is seller’s and supplier’s responsibility to
source, sell, and fulfill only authentic products.
· I have taken time to read every part of the Seller Policies to make sure I do not violate
them another time - https://sellercentral.amazon.com/gp/help/external/help- page.html?
itemID=521&language=en_US&ref=efph_521_bred_G1801.
· I have also trained my existing stuff of two people and four new people on the above
policies to make sure that they are in line with it as well.
· I have hired a catalogue analyst who will create my future product listing with generic
own description. I have already purchased bubble wrap and corrugated box to dispatch
product.
· I have hired a professional photographer to photo-shoot my future products
for the listing.
· I have also applied for the trademark certificate with our company name we
will use this on the product detail page.
· I have hired a QC team permanently who are going to check all products quality
after insourced then I will add stock in my inventory. This person’s responsibilities also
include regular checking of our Amazon Account Health dashboard, in order to avoid
potential problems and their timely resolution

Details how you will prevent the similar complaints

· To prevent other possible policy violations, I have introduced a process that allows me to
continue to monitor my product’s Description, Title, Images to identify problems and act
before they lead to a complaint.
· I made a list of brands for myself and my staff and have introduced an obligatory check
where any new product needs to be checked against this list before purchasing. It also
required to check the product against its brand and also image in https://www.uspto.gov/
so this situation never happens again.
· I have introduced a rule where we creating our own ASIN / Listings under our own TM
brand to ensure that our product is as per description.
· I have created a process where content managers are required to check the listings every
two days to make sure that the information is up to date.
· I have considered few things to avoid such issues to resolve this in future. a. Sourcing: I
am sourcing all our products directly from the registered manufacturer and will be selling
only those products which we are printed. All the products would be nonbranded.
· I have introduced a training system where my employees need to go through
periodic training on the Amazon policies every month.
· Listings: I will list the product accurately on Amazon as described on the
outer and inner packaging of product. I have taken pictures of our new products also.
·
· Packaging: I will ensure that product is its original packaging as well as in
appropriate product package ratio.
· Shipping: After packaging the product is sealed using H technique to avoid
opening during transit and shipped with Amazon FBA service.
· I will immediately take action if any complaint received in account health regarding my
any products.
· I truly understand that allegations of intellectual property infringement is a serious matter
and it can cause legal actions too. As a seller, my prime goal is to have a good deal with
our customers and their satisfaction.
· I will truly abide by each and every step mentioned above to prevent such issues going
forward and will maintain safe, trustable, selling & shopping environment.

Please consider our request and reinstate the listing.

Sincerely,
SERGEI APANAVICHUS
