B. Action: Adoption of Resolution: Approve Regulatory Permits and Conditional
Use Permits 21-007 Cultivation, 21-008, 21-009 Manufacturing and 21-010 Non-
Storefront Retail – PUBLIC HEARING
Community Services Director Waters reported the following: The applicant is
proposing to use an existing industrial site for a cannabis cultivation, distribution,
manufacturing, and Non-Storefront Retail business. The site is located at 258 S
Blair Rd (APN: 060-270-003-000), Woodlake, CA. This property is designated
Light Industrial Zone and allows for cannabis.

The applicant is requesting a conditional use permit and regulatory permit for the
following cannabis businesses:

1. Cannabis Cultivation
2. Cannabis Distribution
3. Cannabis Manufacturing
4. Cannabis Non-Storefront Retail

Cannabis businesses within the City of Woodlake require a Conditional Use


Permit, Certificate of Occupancy, Business License, and a Regulatory Permit
before beginning operations.

As part of the Conditional Use Permit, the City is requesting that the business
comply with the following conditions:
1
1. Meet all City development and State Building Code requirements prior to
beginning operations.
2. Meet all State requirements, laws, and regulations for cannabis businesses in the
State of California.
3. Meet all City requirements, laws, and regulations found in the City’s Municipal
Code, including Section 5.48, which regulates cannabis businesses.
4. Pay all fees and taxes imposed by the City of Woodlake.
5. Failure to comply with any City or State regulations will be considered a violation
of the Conditional Use Permit and Regulatory Permit and result in the revocation
of the Regulatory Permit.
PUBLIC HEARING OPENED: 6:56 PM
Sarah Albright, 234 S. Blair, Woodlake, CA – Mrs. Albright stated she was upset
and not happy with this business being so close to her home. She stated her
concerns are odor, security, roads, and water pressure.
Devon Martinez, Licensed Applicant – Mr. Martinez reported they care about all
the neighbors and has invited anyone who is concerned any issue, may reach out
to him, and have a conversation regarding their concerns. Security is very
important to their business and there will be always heavy video surveillance.
Oder will be kept to a minimum due to their extreme odor mitigation. Their
delivery schedule will be from 9 am to 10 pm and there will be no operations after
10 pm.
PUBLIC HEARING CLOSED: 7:06 PM
Councilmember Martinez asked if they have followed all state and city
regulations. CSD Waters stated yes. Councilmember Guerra asked when the
property was zoned for industrial. CSD Waters stated it has always been zoned
for industrial.
Jeremy Albright, 234 S. Blair, Woodlake, CA – Mr. Albright reported their water
pressure is already low. How will this new business affect the water pressure?
City Administrator Lara reported that cultivators are on their own well water.
Distributors are on city water only. City Administrator Lara asked Mr. Albright,
if there is ever any problem or issues, please contact City Hall and report the
issue. Mayor Mendoza understands water is precious and appreciates the concern
from Mr. & Mrs. Albright.
ON A MOTION BY MARTINEZ, SECOND BY VALERO IT WAS VOTED
TO ADOPT THE RESOLUTION AND APPROVE REGULATORY
PREMITS AND CONDITONAL USE PERMITS 21-007 CULTIVATION,
21-008 DISTRIBUTION, 21-009 MANUFACTORING, AND 21-010 NON-
STOREFRONT RETAIL MOTION PASSED 4-1. GUERRA VOTED NO.
C. Action: Adoption of Resolution: Approve Regulatory Permit and Conditional Use
Permit 20-006 Non-Storefront Retail Uncle Green Inc. – PUBLIC HEARING
Community Services Director Waters reported the following: The applicant is
proposing to operate cannabis business. The subject property is located at 34368
Road 196, Woodlake, CA 93286 (APN: 059-009-002)
The applicant is requesting conditional use permit and regulatory permit for the
following cannabis business:
1. Cannabis Non-Storefront Retail
The applicant has existing conditional use permits and regulatory permits for the
following cannabis business:
1. Cannabis Manufacturing
2. Cannabis Cultivation
3. Cannabis Distribution
Cannabis businesses within the City of Woodlake require a Conditional Use
Permit, Certificate of Occupancy, Business License, and a Regulatory Permit

CONDITIONAL USE PERMT 20-006 NON-STOREFRONT RETAIL
UNCLE GREEN. APPROVED UNANIMOUSLY.
D. Action: Adoption of Resolution: Approval of the City of Woodlake’s Fiscal Year
2021/2022 Budget Amendment No. 1
City Administrator Lara reported the following: Annually, the City staff submits,
to the City Council, a draft budget. The draft budget is submitted at scheduled
Council meetings, which are open to the public. The purpose of the budgeting
process is to propose necessary expenditures and the means of funding.
Occasionally, budget amendments will be necessary to cover unexpected
expenditures or note unexpected revenues. Amendments will be presented to the
Council for approval. Below is a summary of the key changes as shown in the
attached Budget Amendment No.1:
1. General Fund Increase Revenue Building Permit Revenues.
2. General Fund Increase Revenue Sale of Fixed Asset Revenues.
3. General Fund Increase Revenue from Other Governments.
4. General Fund Increase Revenue Subdivision Fees.
5. General Fund Increase Revenue Community Center.
6. General Fund Increase Expenditure Public Works Admin and Engineering
7. General Fund Increase Expenditure Street Project Antelope and Magnolia
8. General Fund Increase Expenditure General Land Purchase
9. STP Fund Increase Expenditure Whitney/Sequoia Ave. Construction

ADOPT THE RESOLUTION AND APPROVE THE CITY OF
WOODLAKE’S FISCAL YEAR 2021/2022 BUDGET AMENDMENT NO. 1
APPROVED UNANIMOUSLY.
E. Action: Adoption of Resolution: Support of the Water Infrastructure Funding Act
of 2022 by the Woodlake City Council
Community Service Director Waters reported the following: The State of
California’s water system infrastructure is aging and in critical need of
improvement and repair. The challenges of a growing population in conjunction
with climate change and prolonged droughts have exposed serious flaws within the
state’s water infrastructure. The Water Infrastructure Funding Act of 2022 is a
citizens’ constitutional amendment that was filed for title and summary on August
26, 2021. The funding allocated with the Act would ensure the state achieves water
resilience and adequately provides clean, safe, and affordable drinking water to all
Californians.

The Act would allocate funds based on strategy, allowing Californians to repair and
upgrade aqueducts, dams, water treatment plants, build off-stream reservoirs,
expand existing reservoirs, invest in wastewater reuse and desalination plants,
runoff capture, and aquifer recharge and recovery.
ON A MOTION BY ORTIZ, SECOND BY VALERO IT WAS VOTED TO
ADOPT THE RESOLUTION AND SUPPORT THE WATER
INFRASTRUCTURE FUNDING ACT OF 2022. APPROVED
UNANIMOUSLY.

VI. OTHER BUSINESS


A. Information: Items from Staff
City Clerk Zacarias – Reported there were 3 applications submitted for the
Student Representative position. After much discussion, council agreed to
have an Ad Hoc committee to review applications and interview students.
Vice-Mayor Ortiz and Councilmember Martinez were selected to interview
students with Councilmember Guerra as an alternate. Interviews will be
scheduled for next week. Also, three families submitted pictures of their
carved pumpkins for the contest hosted by the City of Woodlake. Council
agreed to recognize all entries as winners.
Community Services Director Waters – Reported he does not have any new
information regarding the parks grant but should have information by
November.
City Administrator Lara – Reported soccer season will end next Thursday.
Sign ups for basketball season will start soon and season will start in January.
The Homegrown Project will host their annual parade. Council if you are
interested, please reach out to City Clerk Zacarias.
Chief Marquez – Reported there have been no issues with traffic lately. The
Woodlake Lions will host their annual senior dinner on December 9th at the
Woodlake Veteran Memorial from 5 pm to 9 pm.
B. Information: Items from Council
Councilmember Guerra – Reported parents have been grateful for the soccer
season. Kids have been having fun.
Vice-Mayor Ortiz – Stated she is thankful for the rain.
Mayor Mendoza – Reported the City of Woodlake will host the General
meeting in February. He asked if more outreach could be done to invite
different schools to the Christmas parade.

BACKGROUND:

Pursuant to Section 3.24.050 of the Woodlake Municipal Code the Finance Department prepares
a report listing all investments of the City of Woodlake. The City’s temporary idle cash, those
funds not immediately needed to pay current bills, is invested in accordance with the City’s
Investment Policy that was approved by Resolution No. 09-05 which was adopted on February 9,
2009.

DISCUSSION:

The first objective of the investment policy is to secure the safety of the invested funds. The
second objective is to match the availability (liquidity) of the funds to the cash flow needs of the
organization. The third objective, that is only considered after the first two objectives have been
met, is yield, or the earnings rate.

RECOMMENDATIONS:

Staff recommends that Council approve the October 2021 Monthly Report of Investments as
submitted.

FISCAL IMPACT:

There is no fiscal impact.

Our daily lives are filled with information regarding crime, violence, and disaster, often causing
feelings of helplessness. The many daily acts of kindness that occur in our community are
largely inconspicuous and unobtrusive. Woodlake recognizes the value of acts of kindness and
how such acts positively impact the person offering kindness, the person receiving kindness and
those who witness it.

DISCUSSION:

The City of Woodlake would like to recognize these acts of kindness. By recognizing these acts,
all members of our community will be made aware of the importance of being kind to others
throughout the year. The purpose of Kindness Week is to remember the simple day-to-day acts
of kindness that enable our community to be kinder, safer, and more secure place to live, work
and play.

RECOMMENDATIONS:

Staff recommends that the City accept the Proclamation and recognize November 8th – 13th as
Kindness Week.

Information: Relocation of Ambulance Services Stationed in the City of Woodlake

BACKGROUND:

Exeter District Ambulance approached the City of Woodlake approximately three years ago
about the opportunity to place an ambulance within Woodlake on a full-time basis. At that time
Woodlake and its surrounding communities were being served by an ambulance posted in
Lemon Cove. The posting location was at a Tulare County Fire Department in Lemon Cove and
it is approximately 6.5 miles or ten minutes from downtown Woodlake.

DISCUSSION:

In April of 2020 the Exeter District Ambulance and American Ambulance of Visalia moved into
a location in downtown Woodlake to provide ambulance services to the residents of Woodlake
and surrounding communities. The ambulance providers receive most of their calls from the city
of Woodlake and having them downtown improved their response times to Zone 3, which
includes Woodlake and surrounding areas. Although, relocating the ambulance services
improved responses times for more people it increased ambulance response times to Zone
4/Three Rivers and Zone 13/Badger and its surrounding areas.

To meet the response times to Zone 4/Three Rivers and Zone 13/Badger the City of Woodlake
was notified that the ambulance providers would be relocating back to Lemon Cove starting
December 1, 2021. While this will improve the response times to Zone 4/Three Rivers and Zone
13/Badger it will be at the expense to Zone 3/Woodlake where most of the calls originate from
for the ambulance providers.

In Tulare County ambulance provider agencies are authorized by the Emergency Medical
Services Agency and Tulare County for their appropriate level of service in accordance with
policy and procedures. Those policies and procedures are attached.

Zone 3/Woodlake and Zone 4/Three Rivers are considered rural areas and the required maximum
response time for those areas are twenty minutes. The required response times for metro areas
which every city in Tulare County falls under, except for Woodlake, is ten minutes. With the
relocation of ambulance services to the Lemon Cove post instead of Woodlake, response times
would be increased for residents in Zone 3/Woodlake, but would be considered acceptable if
they were under twenty minutes. Currently, Woodlake response times are being provided in
under ten minutes.

City staff has had conversations with the ambulance providers and the County of Tulare. The
City has expressed their concerns with the relocation of services back to Lemon Cove and
increased response times for Woodlake and residents in Zone 3. In the near future, the City
hopes to continue their conversations with the ambulance providers and the County of Tulare to
ensure that a solution is found that improves average response times and takes into account call
volume and community needs.

The City of Woodlake has reviewed several City Ordinances and found that there are a handful
that need to be revised and /or added.

Chapter 8.16.080 Solid Waste and Refuse Fees - The City of Woodlake is proposing to remove
outdated solid waste and refuse rates from the written code.

Chapter 8.44 – Water Wells - The City of Woodlake is proposing to update permitting and
regulation of water wells in city limits.

Chapter 8.50 – Rental Housing Policy. The City of Woodlake is proposing a Rental Housing
Policy to safeguard and preserve housing stock of decent, safe and sanitary residential units
within city limits.

Chapter 5.50 – Rental Property Business Licenses- The City of Woodlake is proposing the
requirements and regulations of business licenses for rental properties.

Multiple Chapters - Civil Penalties and Violation. The City of Woodlake is proposing to update
civil penalties and violations sections throughout the Municipal code.

DISCUSSION:

Chapter 8.16.080 Solid Waste and Refuse Fees

Currently, the City’s Municipal Code lists outdated solid waste rates. The City of Woodlake is
proposing to remove outdated solid waste and refuse rates from the written code and replace it
with language that allows the City to set sewer rates consistent with Article XIII-D of the
Constitution of the state of California.

Chapter 8.44 – Water Wells

The City of Woodlake is proposing to require a permit to construct, modify or repair, abandon,
or destroy any well within City Limits. Currently, the City does not require a permit to build a
well within City Limits which results in well permits being issued without the City’s knowledge
or approval. The proposed ordinance would help the City monitor the wells

Chapter 8.50 – Rental Property Business Licenses

The City of Woodlake is proposing to add rental businesses to the Woodlake Business Licensing
program.

Chapter 5.50 – Residential Housing Policy

The City of Woodlake is proposing a policy that would allow the City to conduct inspections on
rental housing to verify that the property meets the Health and Safety Standards found in
California Civil Code 1941.1.

Multiple Chapters - Civil Penalties and Violation

The City of Woodlake is proposing to update civil penalties and violations sections throughout
the Municipal code to reference the City’s administrative fees policy.

RECOMMENDATIONS:

Staff recommends adopting the resolution to Receive Public Comments, Waive 2nd Reading,
and Approve the Following Ordinances:

FISCAL IMPACT:

The General Fund will not be impacted through adoption of the amendments to the above said

WHEREAS, the City of Woodlake wishes to amend the Municipal Code; and

WHEREAS, the City of Woodlake held a 1st reading and public hearing at the September 27, 2021 City
Council meetings to receive comments regarding these ordinances; and

WHEREAS, the City Council set the 2nd hearing date for November 8, 2021.

NOW, THEREFORE, THE CITY OF WOODLAKE DOES RESOLVE to Receive Public Comments,
Waive 2nd Reading, and Approve the Following Ordinances:

Chapter 8.16.080 Solid Waste and Refuse Fees - The City of Woodlake is proposing to remove outdated
solid waste and refuse rates from the written code.

Chapter 8.44 – Water Wells - The City of Woodlake is proposing to update permitting and regulation of
water wells in city limits.

Chapter 8.50 – Rental Housing Policy. The City of Woodlake is proposing to a Rental Housing Policy
to safeguard and preserve housing stock of decent, safe, and sanitary residential units within city limits.

THE CITY COUNCIL OF THE CITY OF WOODLAKE DOES ORDAIN AS


FOLLOWS:
Section 1. PURPOSE. The provisions of this ordinance are intended in order to
promote the public health, safety, comfort and general welfare of the community.
Section 2. CODE ENACTMENT. Section 8.16.080 within Title 8 , Chapter
8.16 of the Woodlake Municipal Code is hereby enacted to read in its entirety as follows:

Section 8.16.080 – Solid Waste and Refuse Fees

A. The city council shall hold a public meeting and public hearing on any proposed
rate requests, accept public testimony and consider all evidence presented and in
compliance with Article XIII-D of the Constitution of the state of California.
B. Each single-family residence, apartments, mobile home, businesses, or multiple
dwelling on the same property one pickup per week of refuse, recyclables, and
green waste. Containers will be furnished and maintained by the disposal service
contractor unless it is damaged or destroyed willfully by the user.
C. For the amounts of refuse more than those normally collected or too large or
bulky to be handled in regular container or requiring times other than on regular
pickup schedules or cleanup of construction sites a charge for labor and
equipment will be made. Amount of charge and method of payment will be
determined by the disposal service contractor on an individual job basis.

Section 3. CEQA REVIEW. The City Council hereby finds that this ordinance is
not subject to review under the California Environmental Quality Act (CEQA) pursuant
to CEQA Guidelines section 15061(b)(3) [there is no possibility the activity in question

may have a significant affirmative effect on the environment]. In addition to the
foregoing general exemption, the City Council further finds that the ordinance is
categorically exempt from review under CEQA under the Class 8 categorical exemption
[regulatory activity to assure the protection of the environment]. The City Manager is
hereby directed to ensure that a Notice of Exemption is filed pursuant to CEQA
Guidelines section 15062 [14 C.C.R. § 15062].
Section 4. NO LIABILITY. The provisions of this ordinance shall not in any way
be construed as imposing any duty of care, liability or responsibility for damage to person
or property upon the City of Woodlake, or any official, employee or agent thereof.
Section 5. PENDING ACTIONS. Nothing in this ordinance or in the codes
hereby adopted shall be construed to affect any suit or proceeding pending or impending
in any court, or any rights acquired, or liability incurred, or any cause or causes of action
acquired or existing, under any act or ordinance or code repealed by this ordinance, nor
shall any just or legal right or remedy of any character be lost, impaired or affected by
this ordinance.
Section 6. SEVERABILITY. If any section, subsection, subdivision, paragraph,
sentence, clause or phrase of this ordinance, or its application to any person or
circumstance, is for any reason held to be invalid or unenforceable, such invalidity or
unenforceability shall not affect the validity or enforceability of the remaining sections,
subsections, subdivisions, paragraphs, sentences, clauses or phrases of this ordinance, or
its application to any other person or circumstance. The City Council of the City of
Woodlake hereby declares that it would have adopted each section, subsection,
subdivision, paragraph, sentence, clause or phrase hereof, irrespective of the fact that any
one or more other sections, subsections, subdivisions, paragraphs, sentences, clauses or
phrases hereof be declared invalid or unenforceable.
Section 7. CONSTRUCTION. The City Council intends this ordinance to
supplement, not to duplicate or contradict, applicable state and federal law and this
ordinance shall be construed in light of that intent. To the extent the provisions of the
Woodlake Municipal Code as amended by this ordinance are substantially the same as

provisions in the Woodlake Municipal Code existing prior to the effectiveness of this
ordinance, then those amended provisions shall be construed as continuations of the
earlier provisions and not as new enactments.
Section 8. EFFECTIVE DATE. The foregoing ordinance shall take effect
thirty (30) days from the date of the passage hereof. Prior to the expiration of fifteen (15)
days from the enactment hereof a certified copy of this ordinance shall be posted in the
office of the City Clerk pursuant to Government Code section 36933(c)(1) and a
summary shall be published once in the , a newspaper printed and
published in the City of Woodlake, State of California, together with the names of the
Council members voting for and against the same.

THE CITY COUNCIL OF THE CITY OF WOODLAKE DOES ORDAIN AS

FOLLOWS:

Section 1. PURPOSE. It is the purpose of this chapter to regulate the construction,


modification or repair, abandonment or destruction of wells in such a manner that the
groundwater of this city will not be contaminated or polluted, and that water obtained
from wells will be suitable for beneficial use and will not jeopardize the health, safety or
welfare of the people of this city, and to monitor the amount of water pumped from wells.

Section 2. CODE ENACTMENT. Chapter 8.44 within Title 8 of the Woodlake


Municipal Code is hereby enacted to read in its entirety as follows:

Section 8.44.010 Water Wells


This Ordinance shall be known and referred to as the water well ordinance of the City of
Woodlake.

Section 8.44.020 Definitions


For the purpose of this chapter:
“abandon or abandonment.” When applied to a well, shall mean to cease maintenance or
use of the well for a period of one year.
“contamination”. The impairment of the quality of water to a degree which creates, or
may create a hazard, to the public health through poisoning or through spread of disease.

“destroy or destruction”. When applied to a well, shall mean any action which causes the
well to no longer produce or act as a conduit for the interchange of water.
“emergency”. A circumstance which:
1. causes an imminent threat of or actual contamination or pollution of the city’s
groundwater; or
2. jeopardizes the health or safety of the people of this city; or
3. is likely to cause a substantial and immediate loss of property.
“person”. Any individual, firm, partnership, general corporation, association, or
governmental entity.
“pollution”. The alteration of the quality of water, in full or part, which affects or may
affect such water for beneficial uses. Pollution may include contamination.
“public nuisance”. When applied to a well, shall mean any action or omission which
threatens to or which in fact contaminates or pollutes the groundwater or otherwise
jeopardizes the health, safety and welfare of the public.
“Community Development Director.” The Community Development Director of the city
or his/her duly authorized representatives.
“Well”. Any artificial excavation for the purpose of extracting water from, or injecting
water into, the ground, or for providing cathodic protection, or for making tests or
observations of underground conditions, or for any other similar purpose. This definition
shall not include:
1. oil, gas, or geothermal wells;
2. wells used for the purpose of
a) dewatering excavation during construction; or
b) stabilizing hillsides or earth embankments.

Section 8.44.030 Acts prohibited; permit required.


A. It shall be unlawful for any person to construct, modify or repair, abandon or
destroy any well, unless such person has a valid permit issued by the Community
Development Director for the specific action to be taken.

B. It shall be unlawful for any person to construct, modify or repair, abandon or
destroy any well, unless such construction, modification or repair, abandonment or
destruction is in conformance with the terms and conditions contained in the
permit issued by the Community Development Director.
C. It shall be unlawful for any person to construct any private well, whether for
domestic, industrial, or any other use. No permit shall be issued for construction of
a well, if the property to be served is connected to the city's water supply system
or the property is within 500 feet of a feasible connection point to the city's water
supply system.
D. It shall be unlawful for any person to modify an existing private well, and no
permit shall be issued for modifications other than abandonment and destruction if
the property is within 500 feet of a feasible connection point to the city's water
supply system.

Section 8.44.040 Meter required.


In the event that a meter is not installed on an existing constructed private water well, the
Community Development Director may cause a meter to be installed at the cost of the
city. Existing private water wells are defined as those constructed prior to the effective
date of this chapter. In the event any water well meter is not properly maintained by the
well owner, the Community Development Director may perform the necessary
maintenance on the meter and recover the costs from the owner.

Section 8.44.050 Reporting water use.


The owner of each well within the city on which a water meter has been installed shall
allow the city access to read said meter annually on or about October 1 of each year and
not later than 30 days thereafter. This information shall be reported to the Community
Development Director as the amount of water pumped since the last meter reading. In the
event the meter is not read and the amount pumped not reported to the Community

Development Director in accordance with this chapter, he/she may cause the meter to be
read by any lawful means.
Section 8.44.060 Permits.
A. The application for the permit required by this chapter shall be:
1. Made in writing to the Community Development Director on such forms as
he/she may prescribe, setting forth such information as he/she may require
to carry out the purposes of this chapter.
2. Signed by the applicant.
B. The application shall be accompanied by any filing fee established for said
applications by the City Council, through resolution. No part of the filing fee is
refundable.
C. Permits issued pursuant to this chapter by the Community Development Director
may contain, and be subject to, such terms and conditions as the Community
Development Director determines are necessary to carry out the purposes of this
chapter. The Community Development Director shall deny any application for a
permit if, in his/her determination, its issuance would tend to jeopardize the
purposes of this chapter.

Section 8.44.070 Rules and regulations.


The Community Development Director may adopt rules and regulations to implement
and administer this chapter. Said rules and regulations shall be approved by the City
Council.

Section 8.44.080 Cash deposit or security bond.


Prior to the issuance of a permit, the applicant shall post with the Community
Development Director a cash deposit or security bond to guarantee compliance with any
terms and conditions of the permit and the proper performance of the work. Such cash
and security bond shall be in the amount determined necessary by the Community
Development Director to ensure compliance with this chapter, but in no event will such

cash deposit or security bond be for an amount in excess of the total estimated cost of the
work to be performed. The deposit or bond will be returned to the permittee upon
satisfactory completion of the work.

Section 8.44.090 Suspension or revocation of permit.


A. The Community Development Director may suspend or revoke a water well permit
issued under this chapter whenever the Community Development Director determines
that any work performed under such a permit constitutes a public nuisance or when
the applicant, his or her agents, employees, or the licensed well drilling contractor
performing the work:
1. violates any provision of this chapter or any terms and conditions of the
permit; or
2. misrepresents any material fact(s) in the permit application.
B. Before the Community Development Director suspends or revokes a water well
permit, the Community Development Director shall make reasonable effort to notify
the landowner where the well is located or the licensed well drilling contractor
performing work on the well.

Section 8.44.100 Appeal.


Any person whose permit application has been denied, granted conditionally, or any
person whose permit has been suspended or revoked, may appeal to the City Council:
A. Said person shall file a notice of appeal with the City Clerk on or before the 14th
calendar day following the date of decision by the Community Development
Director.
B. The matter shall be scheduled for hearing before the City Council, no later than 30
days following receipt of the appeal, absent mutual agreement to the contrary. The
appellant shall be served with notice of the time and place of the hearing, as well
as any relevant materials, at least five calendar days prior to the hearing. The

hearing may be continued, upon mutual consent. At the time of the hearing the
appealing party, the Community Development Director, and any other interested
person may present such relevant evidence as he or she may have, relating to the
determination from which the appeal is taken.
C. Based upon the submission of such evidence and any other relevant material
including city files, the City Council shall issue a decision upholding, modifying,
or reversing the determination from which the appeal is taken. Notice of decision
shall be given within 14 days following submission of the matter to the Council
and shall state the reasons for the decision. Any notices under this section may be
sent by regular mail, postage prepaid, and shall be deemed received on the fifth
calendar day following the date of mailing.

Section 8.44.110 Public nuisance.


Upon finding by the Community Development Director that a well may cause
contamination or pollution to the groundwater or is a threat to the public health, safety or
welfare, such well shall constitute a public nuisance. The Community Development
Director may take any action necessary to abate such public nuisance. The owner of the
property upon which the well is located and/or the permittee for such well shall be liable
for any and all costs incurred by, or at the request of, the Community Development
Director in the abatement of said public nuisance.

Section 8.44.120 Inspection.


The Community Development Director or his/her designee(s) may, at any and all
reasonable times (absent an emergency, reasonable times exclude any time of day on
weekends or holidays and prior to 8:00 a.m. or after 5:00 p.m. on weekdays), enter any
and all places, property, enclosures and structures for the purpose of examining or
investigating the construction, modification or repair, abandonment, or destruction of
wells.

Section 8.44.130 Backflow prevention of existing auxiliary water supply wells.
The water purveyor has the primary responsibility to prevent water from unapproved
sources entering the public water supply system. Each service connection from a public
water system supplying water to premises having an auxiliary water supply (well) shall
be protected against backflow of water from the premises into the public water system by
the installation of a city-approved reduced pressure principle backflow prevention device
installed at the public water supply meter connection. It shall be the responsibility of the
water user to provide protective devices as required under this code. It shall be the duty
of the water user on any premise for which backflow protective devices are installed to
have a competent licensed inspection and test performed at least once per year at the
expense of the water user.

Section 8.44.140 Violation – Penalty


A violation of this Chapter is not punishable as an infraction or misdemeanor, a
violation of this Chapter is punishable only by an administrative fine. Any person
who violates any provisions of any ordinance enacted by the city, as amended
from time to time, or any person who owns property upon which a violation
exists, irrespective of whether that person caused the violation, shall be subject
to an administrative fine or penalty up to the maximum amounts set forth by
Woodlake Municipal Code Chapter 1.12.070.

Persons cited for violating this Chapter may request an administrative appeal
hearing as permitted by Woodlake Municipal Code Chapter 1.12.110.

WOODLAKE ADDING A RENTAL HOUSING POLICY.

THE CITY COUNCIL OF THE CITY OF WOODLAKE DOES ORDAIN AS


FOLLOWS:
Section 1. PURPOSE. The provisions of this ordinance are intended to
safeguard and preserve the housing stock of decent, safe and sanitary residential
rental units within the city and to protect persons residing in them by providing for a
regular and comprehensive system of inspection and, through such inspections,
identify and require the correction of substandard conditions. The purpose of the
ordinance is to identify substandard housing violations through an effective pro-active
and re-active inspection program to ensure rental housing units in the city meet
minimum health and safety standards required by the State of California and are safe to
occupy.
Section 2. CODE ENACTMENT. Section 17.48.07 and Section 17.48.08
within Title 17, Chapter 17.48 of the Woodlake Municipal Code is hereby enacted to read
in its entirety as follows:
Sections:

Chapter 8.50 – Rental Housing Policy

8.50.010 - Definitions

This ordinance shall be known as the "Rental Housing Policy”.

For purposes of this article, unless the particular provision or the context otherwise clearly
requires, the definitions in this section shall govern the construction, meaning and
application of words and phrases used in this article:
A. "Director" shall mean the Community Development Director or his or
her designee
B. "City" shall mean the City of Woodlake and/or any agent hired to implement
this article.
C. "Health and Safety Standards" shall mean the standards set forth in California
Civil Code 1941.1.
D. "Owner" means the person or entity identified and listed as having title by
the latest property tax assessment roll, maintained by the Fresno County

Assessor.
E. "Property" or "Residential Rental Property" means any lot or parcel of land
containing Residential Rental Units, and all improvements thereon, including
common areas.
F. “Residential Rental Unit" means any structure or part of a structure that is
used or may be used by one or more persons as a home, residence, dwelling,
or sleeping place for longer than thirty days, including single family
dwellings, duplexes, triplexes, or multi-family (four units or more)
residential buildings, which is not an owner occupied unit, including rooming
houses, boarding houses, apartment units, condominium units, and single
room occupancies, but excluding:
1. hotels, motels, and bed and breakfasts used for transient lodging
2. any rental units in a state licensed hospital, hospice, community
care facility, intermediate care facility, or nursing home
3. rental housing units owned, managed or operated by an
educational, religious, or medical institution, or by a third party for
an educational, religious, or medical institution, when units are
used for the sole purpose of housing employees, students, clergy,
patients, or others directly related to the institution.
G. Tenant's Affirmative Obligations" shall mean the standards set forth in
California Civil Code 1941.2. An Inspector 's determination that a tenant is or
is not in substantial violation of Tenant's Affirmative Obligations, or the cause of
the existence of a dilapidation or violation or interferes substantially with the
Owner's obligation to effect necessary maintenance or repairs is not intended as
evidentiary proof of the condition of the unit, and shall be used only for
purposes of implementing and enforcing this article.

Section 8.50.020 - Scope

The provisions of this article shall apply to all Residential Rental Units located within the
city. Provisions of this article shall be supplementary and complementary to all of the
provisions of this Code, and any local, state or federal law. Nothing herein shall be construed or
interpreted to limit any existing right or power of the city to abate and prosecute any and all
nuisances or to enforce any other conditions in violation of state or local laws, including but not
limited to any building, housing, property maintenance and public nuisance laws.

Section 8.50.030 – Inspections, compliance with applicable codes and standards

A. Baseline Inspection: All Residential Rental Properties in the city shall be subject to
a baseline inspection upon application for a City business license. The Director, or his or
her designee, hereinafter referred to as the Inspector, is authorized to inspect all

Residential Rental Units upon application, to determine whether such Residential Rental
Units meet minimum Health and Safety Standards. If violations are found during the
initial inspection, the owner is given 30 days to make the corrections. If all violations are
not corrected before the 30-day progress inspection, a business license shall not be
issued. A reasonable fee may be charged for inspections, as set forth in the Fee Schedule.
The City will give a 72-hour notice to tenant prior to inspections.

B. Compliance with Codes and Standards: Residential Rental Units shall be required to
be in conformance and maintained in accordance with the code standard that was in
effect at the time the Residential Rental Unit was constructed, substantially altered, or
remodeled, erected, or converted, except for any additional requirements mandated by
this Code or state law. Tenants have the right to request an inspection by the Inspector to
determine compliance.

Section 8.50.040- Enforcement and penalties

If, after a correction notice has been issued, the Owner fails to abate the violations, the City
may proceed with all remedies available under law to compel compliance, including but not
limited to issuing administrative citations, abatement proceedings, civil injunction, and/or
criminal prosecution, or any combination of remedies, so long as violations are not caused by
tenant's breach of Tenant's Affirmative Obligations. In any action or proceeding brought by the
City to enforce this article, the City shall be entitled to recover its attorney's fees when it is the
prevailing party. The City Attorney may, at his or her discretion, charge any violation of this
ordinance as either an infraction or a misdemeanor.

Woodlake hereby declares that it would have adopted each section, subsection,
subdivision, paragraph, sentence, clause or phrase hereof, irrespective of the fact that any
one or more other sections, subsections, subdivisions, paragraphs, sentences, clauses or
phrases hereof be declared invalid or unenforceable.
Section 7. CONSTRUCTION. The City Council intends this ordinance to
supplement, not to duplicate or contradict, applicable state and federal law and this
ordinance shall be construed in light of that intent. To the extent the provisions of the
Woodlake Municipal Code as amended by this ordinance are substantially the same as
provisions in the Woodlake Municipal Code existing prior to the effectiveness of this
ordinance, then those amended provisions shall be construed as continuations of the
earlier provisions and not as new enactments.
Section 8. EFFECTIVE DATE. The foregoing ordinance shall take effect
thirty (30) days from the date of the passage hereof. Prior to the expiration of fifteen (15)
days from the enactment hereof a certified copy of this ordinance shall be posted in the
office of the City Clerk pursuant to Government Code section 36933(c)(1) and a
summary shall be published once in the , a newspaper printed and
published in the City of Woodlake, State of California, together with the names of the
Council members voting for and against the same.

OF THE MUNICIPAL CODE OF THE CITY OF
WOODLAKE ADDING A RENTAL PROPERTY
BUSINESS LICENSES POLICY.

THE CITY COUNCIL OF THE CITY OF WOODLAKE DOES ORDAIN AS


FOLLOWS:
Section 1. PURPOSE. The provisions of this ordinance are intended to
safeguard and preserve the housing stock of decent, safe and sanitary residential
rental units within the city and to protect persons residing in them.
Section 2. CODE ENACTMENT. Section 17.48.07 and Section 17.48.08
within Title 17, Chapter 17.48 of the Woodlake Municipal Code is hereby enacted to read
in its entirety as follows:

Chapter 5.50 – Rental Property Business Licenses

Section 5.50.010 – Rental Properties

Every person conducting or maintaining real property in the City for rental
as a commercial rental, dwelling unit, whether as a single-family, two-family,
or multi-family residential unit, except the Housing Authority of the city and
owners of motels and hotels, which are taxed pursuant to the provisions of
Chapter 5.04 of Title 5 of this code, shall pay an annual business license tax
based upon the average monthly gross receipts for such rental units in
accordance with the schedule set forth in Chapter 5.04 of this chapter.

Section 5.50.020 - Applications

Applications for issuance of a business license for commercial and residential


income properties shall be submitted in accordance with Section 5.04.080
and within three (3) months of commencement of the use of the property as
rental income property, either as a new use or as a change of use. This
application fee shall not apply to any property for which a business license
has been applied for and previously obtained.

Section 5.50.030 – Violation- Penalties

A violation of this Chapter is not punishable as an infraction or misdemeanor, a


violation of this Chapter is punishable only by an administrative fine. Any person
who violates any provisions of any ordinance enacted by the city, as amended from
time to time, or any person who owns property upon which a violation exists,
irrespective of whether that person caused the violation, shall be subject to an
administrative fine or penalty up to the maximum amounts set forth by Woodlake
Municipal Code Chapter 1.12.070.

Persons cited for violating this Chapter may request an administrative appeal hearing
as permitted by Woodlake Municipal Code Chapter 1.12.110.

Section 3. CEQA REVIEW. The City Council hereby finds that this ordinance is
not subject to review under the California Environmental Quality Act (CEQA) pursuant
to CEQA Guidelines section 15061(b)(3) [there is no possibility the activity in question
may have a significant affirmative effect on the environment]. In addition to the
foregoing general exemption, the City Council further finds that the ordinance is
categorically exempt from review under CEQA under the Class 8 categorical exemption
[regulatory activity to assure the protection of the environment]. The City Manager is
hereby directed to ensure that a Notice of Exemption is filed pursuant to CEQA
Guidelines section 15062 [14 C.C.R. § 15062].
Section 4. NO LIABILITY. The provisions of this ordinance shall not in any way
be construed as imposing any duty of care, liability or responsibility for damage to person
or property upon the City of Woodlake, or any official, employee or agent thereof.
Section 5. PENDING ACTIONS. Nothing in this ordinance or in the codes
hereby adopted shall be construed to affect any suit or proceeding pending or impending
in any court, or any rights acquired, or liability incurred, or any cause or causes of action
acquired or existing, under any act or ordinance or code repealed by this ordinance, nor
shall any just or legal right or remedy of any character be lost, impaired or affected by
this ordinance.
