AFFIDAVIT OF ADVERSE CLAIM

FIRST AVPR INVESTMENTS, INC., a corporation duly organized and existing bylaws under the Republic
of the Philippines with office and business address at Shaw Boulevard Kapitolyo, Pasig City, herein represented by
its General Manager MR. SERGIO E. ABCEJO after having been duly sworn to in accordance with law hereby
depose and state: THAT-

1. The above stated corporation is the buyer of the one (1) parcel of land situated in Barrio of Pulo, Sta.
Cruz, Municipality of Sta. Rosa, Province of Laguna, containing an area of 136 square meters, more or
less covered by Transfer Certificate of Title No. T-37367, under the registered name of SPOUSES
MARIANO SARMIENTO and FLORENTINA MONTOYA-SARMIENTO, as per Deed of
Absolute Sale, which is more particularly described as follows:

TRANSFER CERTIFICATE OF TITLE NO. T-37367

“A parcel of land (Lot 2011-C of the subdivision plan Psd-02-000058 being
a portion of Lot 2011, Sta. Rosa Estate, LRC Rec. No. 8375), situated in the Bo. of
Pulo, Sta. Cruz, Mun. of Sta. Rosa, Prov. of Laguna. Bounded on the SW., along line
4-5 by Lot 2011-C; on the NW along line 5-1 by Lot 200-D; along line 1-2 by Lot
2011-B all of the subd. plan; on the NE., along line 2-1 by Lot 2010 of Sta. Rosa
Estate and on the SE., along line 3-4 by Road. Beginning at a point marked “1” on
plan being S.46 deg. 12’W., 34. 61 m. from……………………………………
containing an area of ONE HUNDRED THIRTY SIX (136) SQUARE METERS,
more or less.”

2. The SELLERS refused to surrender the owner’s duplicate copy of Title with TCT No. T-37367 of
the above stated parcel of land so that a proper memorandum and transfer of title be made thereon;

3. That I am executing this Affiant of Adverse Claim to protect my rights and interest over the said parcel
of land as BUYERS thereof and further warn the public not to enter into any transaction involving the
subject parcel of land;
