What is REACh?
REACH stands for Registration, Evaluation, Authorization and Restriction of
Chemicals. It entered into force on 1 June 2007.
REACH is a regulation of the European Union, adopted to improve the
protection of human health and the environment from the risks that can be
posed by chemicals.

As Importer we are responsible for all products we import.


The responsibility for fulfilling the requirements of REACh lies with Thomann,
or your representative in the European Union.

What does it mean if a substance is on


the Annex XVII of REACh?
Annex XVII is the list of restrictions under REACh. Restriction is one of the two
mechanisms in REACh used to address substances of concern. It can be used to
regulate against risks to specific populations such as the general public or
against more widespread health and/or environmental risks.

A restriction can ban or place limits on any substance or substance type which
poses an unacceptable risk to human health or the environment. A substance
does not need to meet the SVHC criteria associated with the Authorization
process to be restricted.

When Thomann is importing goods from non-EU, we must ensure they meet
any and all relevant restrictions.

What are SVHCs?


SVHC stands for “Substance of Very High Concern”.

SVHC refers specifically to those substances that meet the hazard categories
mentioned and that have been placed by the Commission on the Candidate List
of substances considered for authorization.

SVHC substances are not necessarily restricted, but Thomann, as brand owner
or importer into the EU, must be notified about any SVHC substances >0,1%
present in any material.

Since 2008, the list has grown steadily through bi-annual updates, at an
average rate of 35 substances per year (including substances belonging to
specific groups listed as SVHCs).

What we want
Since we are responsible for all articles we import, we are also liable in the case
of non-compliance, which in case of Annex XVII is a criminal offense.

Consequently, we need proof of your materials not exceeding the limits of


any restricted chemicals.

Please inform yourself and keep up to date with these restrictions.

Additionally, we ask you to avoid substances listed under the SVHC list. They
pose a high risk of being restricted soon.

Notify Thomann about any SVHCs >0,1% present in any material.

The SVHC list gets updated twice a year – please inform yourself and keep up to
date with the SVHC list.

What we need from you


To ensure compliance with the legislation above you may be contacted by
Thomann’s quality specialists or by ProductIP - Thomann’s compliance service
partner.

After risk assessment of your product you will be asked to provide test reports
for certain synthetic materials. As importer we need actual test reports that
show compliance with the latest restrictions and cannot accept a Declaration of
Conformity.
