BETWEEN
MRS ADENIKE ADEWARE of No 16, Igbogbo Road, Opposite Anglican Church,
Offin Ile, Igbogbo, Ikorodu, Lagos State, (hereinafter called the “Assignor”),
which expression shall, where the context so admits, include her Heirs, Privies,
Legal and/or Personal Representatives and Assigns of the ONE PART.
AND
MISS ADENAIKE ABOSEDE ABIOLA of Alhaji Kazeem Kolawole Street, Seyi Bus
Stop, Offin-Ile, Igbogbo, Ikorodu Local Government Area, Lagos State
(hereinafter called the “Assignee”), which expression shall, where the context
so admits, include her Heirs, Privies, Legal and/or Personal Representatives
and Assigns of the OTHER PART.
WHEREAS:
1. The parcel of land hereinafter described and hereby intended to be
assigned for consideration and located at No 1, Adegoke Adeware,
Avenue, Adware Bus Stop, Offin-Ile Town, Igbogbo, Ikorodu Local
Government Area, Lagos State forms part of a large tract of land
originally belonging to the OLOFIN CHIEFTAINCY FAMILY and their
ancestors of Offin-Ile Town, via Igbogbo, Ikorodu Local Government,
Lagos State from time immemorial under the Yoruba Native Laws and
Customs and the family members through the generations had exercised
full and unfettered rights of ownership and possession thereon without
let or hindrance whatsoever until part of the said land was assigned to
Mr. and Mrs Adegoke Adeware of 16, Igbogbo Road, Opposite Anglican
Church, Offin-Ile, Igbogbo, Ikorodu, Lagos State.
2. By virtue of the assignment of plots / acres out of the land referred to in
Paragraph 1 above to Mrs Adegoke Adware by the accredited
representatives of the Olofin Chieftaincy Family, Mrs Adegoke Adware
continued to exercise unfettered rights of ownership and possession
thereon, including fencing and building on same without let or
hindrance.
3. The Assignee herein has now approached the Assignor who is also
desirous and willing to assign her whole interests and rights in Part of
the Parcel of land for the assignment thereof, for a valuable
consideration.
NOW THIS DEED WITNESSES AS FOLLOWS:
In pursuance of this Deed and in consideration of the sum of N300,000.00
(THREE HUNDRED THOUSAND NAIRA) only, paid by the Assignee to the
Assignor before the execution of this deed, (the receipt whereof the Assignor
hereby acknowledges), the Assignor as the beneficial owner hereby assigns
UNTO the Assignee all the Assignor’s interests in all the parcel of land
measuring approximately 27ft by 24ft. by 25ft situate, lying and being at No 1,
Adegoke Adware Avenue, Adware Bus Stop, Offin-Ile, Igbogbo, Ikorodu Local
Government Area, Lagos State and more particularly marked out, described
and delineated on Survey Plan No. ……………………………….........., drawn by
Surveyor…………….
……………………………….Of………………………………............................................,
Lagos State a copy of which plan is annexed to this Deed of Assignment, to
hold the same unto the use of the Assignee for all the unexpired residue of her
Interests in the demised property as permissible under the Provisions of the
Land Use Act 1978.
