We, Mrs. Jojit E. Yap, Mrs. Joyce Martha Cuenca, Mr.
Robert Javellana, Dwight A. Carbon, Eugenio Velasco Jr., Fr. Ernie Larida, Mr. Antonino Panique, Mr. Noel Alarcon, and Mr. Nicanor Gerald Jison, all of legal age, with office/business address at Central Negros Electric Cooperative, Inc. (CENECO), Mabini cor. Gonzaga Streets, Bacolod City, after being sworn to in accordance with law do hereby depose and state that:
1. We are the members of the Board of Directors of
CENECO with office/business address as stated above;
2. We are aware of CENECO Power Supply Procurement
Plan (PSPP) and the schedule to conduct Competitive Selection Process (CSP) for the procurement of 20MW Base Power Supply for the compliance of CENECO to its PSPP requirement in accordance with the Department of Energy (DOE) Department Circular No. DC 2018-02- 0003, entitled. “Adopting and Prescribing the Policy for the Competitive Selection Process in the Procurement by the Distribution Utilities of Power Supply Agreement for the Captive Market”;
3. We, CENECO approved the composition of the Third-
Party Bids and Awards Committee - (TPBAC) who will spearhead and manage the conduct of CSP through the issuance of BOD resolution numbers 12365, 12424 and 12600 12600;
4. We have personal knowledge that the CSP conducted by
TPBAC was in accordance with the DOE Department Circular No. DC 2018-02-0003, entitled ''Adopting and Prescribing the Policy for the Competitive Selection Process in the Procurement by the Distribution Utilities of Power Supply Agreement for the Captive Market" and the implementing guidelines of National Electrification Administration (NEA) thru Memorandum No. 2019-¬007, entitled "Adoption of the IRR of the Policy in the Conduct of the CSP of the Electric Cooperatives’ Power Supply Agreement;
5. We, with the abstention of Directors Cuenca,
Javellana and Larida, approved the TPBAC recommendation to award the 20 MW PSA to KEPCO SPC Power Corporation (KSPC), the bidder having the lowest calculated and most responsive bid to the requirements and needs of CENECO;
6. The draft of PSA between CENECO and KSPC was
submitted to NEA for review;
We are executing this Joint Sworn Statement in order to
