Upon the arrival of the Judge, the Court Interpreter requests the assembly:

People of the Philippines versus Joel Masiglat y Pelayo, for violation of
Section 5, of Republic Act number 9165 or The Comprehensive
Dangerous Drugs Act of 2002.

Defense Counsel I am Atty. Larry-Jun Barcoma your honor, appearing as counsel for the

Court Interpreter People of the Philippines versus Joel Masiglat y Pelayo.

INFORMATION:

The undersigned prosecutor accuses Mr. Joel Masiglat y Pelayo a.k.a.


“Jojo” of Illegal Sale of Dangerous Drugs in violation of Section 5, Article II
of Republic Act No 9165, otherwise known as “The Comprehensive
Dangerous Act of 2002”, committed as follows:
That on the 12th day of October 2021, at about 7:00 in the morning, in
Lapu-Lapu City, Philippines, within the jurisdiction of this Honorable
Court, the above-named accused, without authority of law, did, then and
there, willfully and unlawfully sell, deliver, and convey to a police poseur-
buyer two (2) heat-sealed transparent plastic sachets containing white
crystalline substance with total net weight of 1.1397 gram subsequently
marked as “JPM-BB-JB-01” 10/12/2021 and “JPM-BB-JB-02” 10/12/2021
each with signature, which when subjected to laboratory examination
gave positive result to the test for the presence of Methamphetamine
Hydrochloride (shabu), a dangerous drug, in consideration of the amount
of Two Thousand (Php 2,000.00) pesos consisting of previously marked
four (4) Five Hundred Peso bill bearing serial numbers CB848946 ,
CB962543, CB763521, and CB742531 respectively later marked as “JPM-
BB-JB-03” 10/12/2021 with signature.

Judge Mr. Pelayo, do you understand the nature of the accusation made against
you?

Accused Yes, your honor.

Judge Alright! How do you plea?

Accused Not guilty, your honor.

Judge The accused pleaded not guilty to this charged.


Atty. Barcoma, is your client interested in plea bargaining?

Defense Counsel No your honor, he is innocent to the crime charged.

Judge But Atty. Barcoma, is it not possible that your client be interested to
enter a plea for a lesser offense? Possibly the crime of possession of Drug
Paraphernalia, because the penalty is lower than the one being charged.
What can you say to this?

Defense Counsel Ok, your honor, give me at least some minutes to discuss it with my
client.

Judge Alright! I’ll give you some minutes to confirm it with your client Atty.
Barcoma

Defense Counsel Your honor, after conferring with my client, he is not amenable to the
plea of guilty to a lesser offense.
Judge Alright! You may now step back to your seats. (Accused will return to
seat)

Order!

After arraignment of the accused, he entered a plea of not guilty to the


offense charged. The parties and their counsel are therefore ordered to
appear at the pre-trial of this case on October 29, 2021, for purposes of
documentation of evidence to be presented, and to consider other
matters as may aid in the prompt disposition of this case.

The parties are reminded that there may be no evidence to be presented


and admitted in this trial if they are not formally marked and identified
during the pre-trial conference, unless of course, because of good cause,
the court will admit the same.

Both party’s presence is compulsory for the pre-trial of this case.

Are there any matters that we need to discuss now?
