6. Reasons for appeal :

Aggrieved by the response received : Applicant had sought for the status/stage
of Within the specified period investigation in Crime No. 301/2018 of
Kadugodi Police Station.

Grounds of Appeal :

a. The Applicant submits that he is the Complainant in above case and filed the
Application for knowing the status/stage of the Investigation as to whether the
Investigation is completed and if the Charge sheet would be filed before the
Court in the near future in respect of the case.

b. The PIO misread the application as Applicant seeking information of the


Accused thereby refused the information on the grounds of concession given to
the Department under Notification No. DPAR 91 RTI 2009, DTD. 06.05.2013
and thereby rejected the Application.

c. The Applicant submits that he apprehends that the accused may move the
Hon’ble High Court for quashing the FIR citing delay in investigation.

d. The Applicant submits that in this case recovery of huge money is involved
which is siphoned off by the accused thereby affecting his business interests as
such sought for the status of investigation.

e. The Applicant submits that provision of Rule 24(4) of RTI Rules 2005 is not
applicable to this case since the Applicant has not sought for any information
relating to intelligence or security but only the status of investigation in
respect of his complaint. As such the PIO cannot take refuge and reject
application under the above provision.
