TOPIC

Mestum is a local manufacturer that produces dry food. One day, the plant suffered a breakdown in
one of the production line. Kamarul, an engineer in the company, was called upon by his superior
to inspect the situation and to take appropriate action. After the inspection, Kamarul concluded that
the broke down of the production was due to a failure in the water pump system.

After troubleshooting the root cause, Kamarul contacted the water pump manufacturer, Worldwide
Pump Berhad to inform them of the fault he discovered. He asked them if they could repair the
water pump and if so, the price and the duration of the repair. Worldwide Pump Berhad in reply told
Kamarul that they could do it for the price of RM2500 which includes the cost to collect and return
the water pump to Mestum within ten days from the date of collection of the water pump. Within his
authority, Kamarul immediately agreed to the terms of Worldwide Pump Berhad.

Mestum, at the time their production line broke down due to the faulty water pump, has a contract
with an another company based in Singapore, to supply them 300 000 packs of dry food. The
contract could have resulted in Mestum making a profit of RM 40,000 if delivered on time. But
unfortunately, this was not disclosed to Worldwide Pump Berhad when Kamarul entered into
contract with them to repair the water pump.

Worldwide Pump Berhad thereafter arranged with Mr. Kenneth, the owner of the transporter
company, to pick up the water pump from Mestum. Worldwide Pump Berhad managed to repair
the water pump within five days from the date of collection. Worldwide Pump Berhad immediately
arranged for Kenneth to collect the water pump to return it to Mestum. Unfortunately, while on the
way to return the water pump, Kenneth met with an accident. The lorry including the water pump
were totally damaged.

As a consultant, you were approached by Mestum to give advice on the action they can take for all
their losses including the party that they can take action against, if they were to take court action to
claim for their losses. Your advice must be supported by the relevant law and case law.

TOPIC

Mr. Chong is a civil engineer working for the company that produces industry structural beams.
Recently, as the Head of Unit of a project, he and his team had developed a new type of beam
made of composite materials and have shown very promising preliminary results. Mr. Benny, who
is Chong’s boss, is excited of the prospect of the new design of beam that is developed by Chong
and his team as this could generate huge profit to the company if is successfully developed.
Currently, Chong is responsible for the testing of the beam. He and his team are in the midst of
conducting a range of crucial tests for the reliability of the new beam. The testing is expected to
complete in two months’ time.

One day, Chong received a call from Mr. Benny to meet him in his office. Mr. Benny has asked
Chong to finish his test report on the new beam design within a week because an important
potential customer from Indonesia will visit the company the following week and wants to have a
look at the first test report. Chong first reaction is to refuse Mr. Benny’s request. He knew that he is
not able to finish the test report within a week as he first needs to do more reliability tests on the
new beam design. Chong considers these additional tests crucial for gaining good insight in the
reliability of the new beam design.

Mr. Benny tells Chong to abandon the plan on other tests and to start writing his report immediately
as Mr. Benny deemed the existing data is sufficient to convince the potential customer from
Indonesia. Mr. Benny also tells Chong that if Chong refuses, he will ask Hossein, Chong’s
colleague to write the report. Chong says that he really needs more time. Moreover, he objects to
Mr. Benny’s idea in requesting Hossein to write the report as Hossein is not knowledgeable of the
tests and will not be able to write a sound report. Mr. Benny does not look happy with Chong’s
response. After the meeting, Chong confronted Hossein who says that he would agree with Mr.
Benny and to write the report if Mr. Benny asks him to do so.

Question 1
Chong has always embrace ethical engineering practices. What should Chong do if he wishes to
apply The Code of Ethics to this situation? Discuss and indicate a likely outcome of the matter.

Question 2
In your opinion, what are the relevant virtues an engineer should possess in his/her workplace? If
you think Chong is an ethical engineer, what are his actions that supports the virtues you have
listed down earlier?
