Investigation disclosed that on the same date and time, APO1 Papa noticed that AVSEC Dennis Lumdang assigned at Exit Gate 2, ICT accosted one male employee of PS! for not wearing face shield. After a few minutes, he was approached and informed by SG Lumdang regarding the arrogant behavior showed by the said PSI employee. Immediately, APO1 Papa proceeded at the said area and courteously explained that all employees are mandatorily/ needs to wear face shield before entering ICT area. However, PSI employee displayed arrogant behavior and shouted, to quote “May ID naman ako ng ICT at dyan lang ako..Ano bang problemal”. Then and there, APO1 Papa politely explained again the new existing order DOTr Memorandum Circular No 2020- 014 dated 03 August 2020 that was strictly implementing by the AVSEC guards assigned thereat but PS! employee uttered vigorous words and said “irereport ko kayo kapag walang bantay dyan sa susunod!". Further, PSI male employee turned his back and walked inside but APO1 Papa stopped him but the former insisted from entering. Therefore, APO1 Papa immediately hold the said male person who struggled to free himself and said “Bitawan mo ko ano bang problema mo!” Instead of Samm heeding, he added while his finger pointed to APO1 Papa to quote “Airport Police ka lang! marami akong kilalang tunay na pulis sa Crame!” Moreover, sald officer invited the said male person to their International Cargo Terminal Police Section office however PSI employee refused and said “Kausapin mo muna OIC ko bago ako sumama sayo!” prompted him to arrest PS! employee because of the insult and humiliation. PS! employee was then informed of his Constitutional Rights (Miranda Doctrine) and brought to ICT Police Section for documentation and later identified as Mr Jeffrey Leonor y Datinguinoo, Parking Attendant of Philippine Skylanders International (PSI) Inc. Subsequently, Mr Leonor was endorsed to this office PIID for investigation and filing of appropriate criminal charges in court. ‘After preparation of inquest documents, the Pasay City Prosecutor's Office Record Section was informed about the case thru messenger. Scanned copies of documents in PDF format were sent/ forwarded to ocppasayeinauest@yahoo.com for pending inquest proceedings. MIAA Access Pass of Mr. Leonor was confiscated and issued confiscation receipt and forwarded to ID/Pass Control Division for appropriate disposition. At around 1020H, 18 August 2020, a complaint for violation of Art 151 (Resistance And Disobedience to a Person In Authority or the Agent of such person) and Art 287 (Unjust \Vexation) par 2 of the Revised Penal Code were presented in the presence of PAO Atty. Jamie Rose Palacol thru online inquest proceedings which was acted upon by the duty Prosecutor SDCP Dolores Rillera who put the case INQUESTED. After the inquest proceedings, respondent was brought to Pasay City General Hospital for Physical Examination, after which he was brought back to PIID for temporarily confinement pending issuance of the inquest resolution.
