Abstract:

2G scam

Under pressure from the Supreme Court to wrap investigations into the multi-
crore 2G Spectrum scam, the CBI seems to be persuading the managing director of
one of the telecom companies, which was allotted spectrum, to become a
witness. According to sources, the MD of a leading telecom company was
questioned for four hours by a team of CBI officers who confronted him with
documentary evidence. "He is also among the top telecom MDs who is under the
Income Tax department's scanner. We have questioned him at length and the
statements were recorded. We have asked him to furnish some other documents
related to his telecom firm after which he will again be called for questioning,"
said a CBI official, who is part of the probe. The moves comes soon after CBI had
said four former bureaucrats are under scanner for their purported ties with
coprorate lobbyist Niira Radia, who is being probed for her role in
the  2G Spectrum scam. Officials said the examination of all these officials were
going on and they have been asked to furnish the details. "The matter is in the
Supreme Court and details about the investigation cannot be divulged. We have
been examining several officials and former bureaucrats whose named have
cropped up during investigation," said a CBI official. Earlier, the CBI had
questioned Pradip Baijal, former Telecom Regulatory of India (TRAI) chairman,
who joined a PR firm that was engaged by private telecom companies, which were
in the fray for 2G licences. Sources also claimed that officials of Department of
Telecom (DoT) are also being probed. "We have examined some of the top
officials of DoT. However, there have been no arrests so far. We will also be
examining some former DoT officials who allegedly granted unified access
services licences to a few selected companies at nominal rate by rejecting the
applications of the others without any valid reasons, causing loss to the
government and corresponding gains to individuals or companies," an official
said. The licences were awarded to certain companies by putting a cap on the
number of applicants against the recommendations of TRAI.
TRAI RESPONSIBILITY

The Telecom Regulatory Authority of India or TRAI  was established in 1997 is the


independent regulator established by the Government of India to regulate
the telecommunications business in India.

1 Make Recommendations, From The Licensor, On The Following Matters.

i. Need And Timing For Introduction Of New Service Provider.


ii. Terms And Conditions Of License To A Service Provider.
iii. Revocation Of License For Non-Compliance For Terms And Conditions Of
License.
iv. Measures To Facilitate Competition And Promote Efficiency In The Operation Of
Telecommunication Services So As To Facilitate Growth In Such Services.
v. Technological Improvements In The Services Provided By The Service Providers.
2. Discharge The Following Functions.
i. Ensure Compliance Of Terms And Conditions Of License.
ii. Compatibility And Effective Inter-Connection Between Different Service
Providers.
iii. Regulate Arrangement Amongst Service Providers Of Sharing Their Revenue
Derived From Providing Telecommunication Services.
3. levy fees and other charges at such rates and in respect of such services
as may be determined by regulations.
