BARRAMEDA CASE ANALYSIS

After 10 years,a malabon city court has dismissed the murder and parracide change in
connection with killing of ruby ros barramada ,her body was recovered off navotas in a drum
filled with concrete in 2009.

On august 15 judge Edward larida Jr of malabon regional trial court branch 170 dismissed
Manuel jinemez lll for lack of parable cause.

And on July 10 the court junked the murder case against the victim's father in law Manuel
jinemez Jr his brother lope,lennard descalso, Robert Ponce and Manuel Montero, the man who
lead authorities to the location of barramada remain.

The sister of the actress and former beauty queen Rochelle barramada went missing on march
14 2007 . After she visited her children at the house of the jinemez.

After body was recovered in June 2009 after accused turned witness Manuel Montero

Montero accused barramada husband Manuel lll her father in-law Manuel Jr her uncle in-law
lope jinemez driver Eric Fernandez security office .

The steel drum was placed inside a steel casing also filled with cement ,and dumped into the
sea of navotas .

The unfinished testimony of state witness Manuel Montero ,who escaped from camp naging
diwa in2013 , contributed greatly to the dismissal of the parracide and murder casses since
these were filled in court in August 2009.

Montero had also recanted his testimony in handwritten statement filled before the court on
may 12,2013 weeks after he escaped from Witness protection in camp naging diwa on march
20 2013.

Montero had accused Fernandez Norberto Ponce and lennard descalso of straggling ruby rose
to death and cementing her upon the order of jinemez he accused lope jinemez Jr brother of
giving them P50,000. for killing

The prosecutor failure to present strong evidence of the guilt of three accused in the ruby rose
barramada case prompted the judge to grant their petition for bail

The resolution dated on June 10 granting bail to Manuel jinemez Jr Lenard descalso and Robert
Ponce ,judge zaldy docena of the malabon regional trial court branch 170 said the 10 days
period he gave formal offer of evidence before the bail petition were submitted for resolution
in may lapsed without any compliance from the prosecution .
The evidence that the prosecution failed to present ,such as the clothes and juwelry retrieved
from barramada's body which was found in the drum off water on natovas city in 2009 shall
excluded and rejected by this Court even if they had been marked earlier as exhibit it was not
clear however wether this applied only on the bail petition or extended to the murder case filed
against the accused.

The judges noted that no valid excuse or justification was offered to explain Montero's
continued absence to appear not only for the continuation of his direct examination but also for
his cross examination relative to his earlier declaration.

At the very least they should have moved that Montero be re incluede in the criminal
information as one the accused for the second time headed .

INCOMPLETE TESTIMONY

According to the judge since Montero's testimony on the murder remained incomplete the
same could not be the subject of a cross examination,a right accorded to the accused .

Robert barramada ,the victim's father said the prosecution team handling the murder case was
composed of Theodore Villanueva and Benito Oliver sales lll from the department of justice .

Docena said that the article 3 section 14 of the 1987 constitution for instant mandated that the
accused shall enjoy the right to meet the witness face to face .

Rochelle now 36 admitted that she and her family are getting tired and exasperated by the
unexpected twists and delay in the hearing of the case ,but they will never stop their guests for
her Rochelle said she very close to her sester who would have been 33yrs lod now.
