SAMPLE SITUATIONS FOR GBSH IN THE SCHOOL SETTING:

1) Mr George Wigan is a professor of a well-known college. Miss Lydia Beringa is his student who
claimed that on August 16, 2021 at around five in the afternoon, Mr Wigan asked her to be at his
office so he could hand over the class assignment. Once inside, she saw him take a folder from
one of the cartons on the floor near his table, and placed it on top. He then asked her to come
closer, and when she did, held her hand, then touched and fondled her breast. She stated that he
fondled her breast five times, and that she felt afraid. A classmate of hers, Miss Catherine
Benido, claiming to have witnessed the incident, testified that the fondling incident did happen
just as Miss Beringa related. However, Mr Wigan claimed that the touching happened by
accident, just as he was handing Miss Beringa a book. He further stated that the incident
happened in about two or three seconds, and that the girl left his office without any complaint.

2) Richard Fernandez identifies as LGBTQ+, and has been open about their sexual orientation to
most of their classmates. Every day, upon entering the classroom, a classmate of theirs, Caroline
Bigcas, manages to give a comment or two about Richard’s sexual preference which are
considered homophobic, but for the sake of harmony in the classroom, such remarks were
tolerated. One day, however, just as Richard entered the room, Caroline said, “It’s common
sense. Do you see any animal partnering where male is to male and female is to female? No, the
animals are better because they know how to distinguish male from female. If we tolerate this,
then man is worse than animals.” Richard had enough and approached Student Affairs to lodge
a complaint against Caroline. Caroline reacted violently to the complaint, claiming that the
comment made was not specific to Richard; that her remarks were tolerated; and that Richard
never complained of them. Several of their classmates were able to testify as witness of the
constant bullying of Caroline. Due to the complaint submitted by Richard, Caroline was more
aggressive in her verbal bullying of Richard.
