AFFIDAVIT OF REAPPEARANCE
I, AAA, of legal age, Filipino citizen, presently residing at Legazpi City,
after having been duly sworn to in accordance with law, depose and state
that:

1. I was legally married to BBB on January 1, 2000 at a wedding

ceremony solemnized by Fr. Juan Dela Cruz in St. Raphael Parish Church,
Legazpi City, Albay;

2. BBB and I begot two children, XXX and YYY, and we all lived
together in Legazpi City until my disappearance on September 6, 2016;

3. On September 6, 2016, while fishing off the coast of Rapu-

Rapu, Legazpi City, my motorized boat suddenly erupted in flames and I
was thrown overboard;

4. When I regained consciousness on November 8, 2016, I found

myself in a hospital with second- and third-degree burns all over my body
and with no memory whatsoever of my life including my own identity;

5. Through information from the attending nurses, I was able to

know that I was then at the Northern Samar Provincial Hospital, where I
was brought by concerned residents who found me floating off the coast of
Catarman. I was also told that I have been confined under comatose at the
said hospital for 28 days before I regained consciousness;

6. I stayed at the said hospital until December 27, 2016 for

treatment of my injuries, however, despite medication and psychological
intervention, my memory did not return and I was discharged with a
diagnosis of Dissociative Fugue secondary to severe head trauma;

7. Having no memory at all of my life and my identity, I settled at

Catarman, Northern Samar where I eventually found work as a farmhand;

8. On July 9, 2021, I woke up with a severe headache and the

startling realization that I could remember who I was and my life before the
accident. I then wasted no time in returning to Legazpi City to find my wife
and children;
 9. On July 12, 2021, upon arriving in our house in Legazpi City, I
was devastated to learn that my wife, BBB, already had me declared
presumptively dead on November 27, 2019. I was even more devastated to
learn that BBB had already married another man, CCC, on December 17,
2019, in Legazpi City;

10. Despite my absence for the last five years, which was neither
due to my fault nor will, I wish to be reunited with my wife and children and
to have us live together again as a family;

11. I am executing this Affidavit to attest to the truth of the

foregoing facts, as well as to give due notice to BBB, CCC, the Local Civil
Registrar of Legazpi City, and all others concerned, of the fact and
circumstances of my reappearance and for the automatic termination of
the subsequent marriage of BBB and CCC as provided for under Article 42
of the Family Code.

September, 2021 in Legazpi City, Philippines.
