Industrial design is the discipline that is responsible for the
conception and development of objects and products to be
manufactured in series, with a functional purpose for people.
It is one of the multiple tools that seeks to improve the
qualities of industrial products, emphasizing form, function
and use with a priority focus on the user.

¿HOW TO PROTECT INTELLECTUAL WITH THE INDUSTRIAL DESING?

The main requirement that the law requires for its
protection is novelty. That is, prior to your application
for registration, the design has not been known in the
national or foreign market. The protection of an
industrial design in Colombia is granted for 10 years
from its application for registration and during this
period, the right holder can prevent the use of the
design by third parties and claim damages if an
infringement of their right occurs.

OFFICE IN CHARGE OF THE INDUSTRIAL DESINGS

The office in charge of governing the registration of graphic design

in Colombia is the superintendency of industry and commerce which
is the national authority for the protection of competition, personal
data and legal metrology, protects the rights of consumers and
administers the National System of Industrial Property, through the
exercise of its administrative and jurisdictional functions.

The application for registration of industrial design is an

administrative procedure that is carried out before the
Superintendency of Industry and Commerce and consists of
the following stages:
Presentation of the application
Formal examination
Publication
Oppositions of third parties
Substantive examination
Appeal (if applicable).
This process lasts approximately eight (8) months.
