The Executive Engineer,Kukadi Irrigation Division No.1, Narayangaon.
Whereas A.B.Fadtare,At-Post-Falatan, Tal-Faltan,Dist-Satara,(herein after "The
Contractor")ha undertaken, in pursuance of Contract No. WUA .49 dated 24-1-2008 to
execute Rehabilitation in the juridiction of WUA No.49 (herein after called "The
Contract")
AND WHEREAS is has been stipulated by you in the said Contract that the Contractor

shall furnish you with a Bank Guarantee by a recognised bank for the sum specified

therein as security for compliance with his obligation in accordance with the contract.
AND WHEREAS we have agreed to give the Contractor such a Bank Guarantee;

NOW THEREFORE we hereby a firm that we are the Guarantor and responsible to
you, on behalf of the Contractor, up to a total of Rs. 36,200/- (Rupees Thirty Six
thousand two hundered only), such sum being payable in the types and proportions
of currencies in which the Contract price is payable, and we undertake to pay you,
upon your first written demand and without cavil or argument, any sum or sums within
the limits of Rs. 36,200/- (Rupees Thirty Six thousand two hundered only) as
aforesaid without your needing to prove or to show grounds or reasons for you demand
for the sum specified therein.

We here by waive the necessity of your demanding the said debit from the Contractor
before presenting us with the demand.

We further agree that no change or addition to or other modification of the terms of

contract or of the works to be performed here under or of any of the Contract
documents which may be made between you and the contractor shall in any way
release us from any liability under the guarantee, and we hereby waive notice of any
such change,addition or modification.

This guarntee shall be valid until 01-03-2010 (i.e) 28 days from the date of expiry of
Defects Liability Period.

Amount of Guarntee-Rs. 36,200/- (Rupees Thirty Six thousand two hundered

only),Date 04-02-2008 Period-25 months.

(herein after "The Contractor")ha undertaken, in pursuance of Contract No. WUA .51
dated 15-2-2008 to execute Rehabilitation in the juridiction of WUA No.51 (herein after
called "The Contract")

AND WHEREAS is has been stipulated by you in the said Contract that the Contractor

shall furnish you with a Bank Guarantee by a recognised bank for the sum specified

therein as security for compliance with his obligation in accordance with the contract.
AND WHEREAS we have agreed to give the Contractor such a Bank Guarantee; NOW
THEREFORE we hereby affirm that we are the Guarantor and responsible to you, on
behalf of the Contractor, up to a total of Rs. 1,22,000/- (Rupees One Lakh twenty two
hundered only), such sum being payable in the types and proportions of currencies in
which the Contract price is payable, and we undertake to pay you, upon your first
written demand and without cavil or argument, any sum or sums within the limits of Rs.
1,22,000/- (Rupees One Lakh twenty two hundered only) as afore said without your
needing to prove or to show grounds or reasons for your demand for the sum specified
therein.
We here by waive the necessity of your demanding the said debit from the Contractor
before presenting us with the demand..
We further agree that no change or addition to or other modification of the terms of
contract or of the works to be performed thereunder or of any of the Contract
documents which may be made between you and the contractor shall in any way
release us from any liability under this guarantee, and we hereby waive notice of any
such change, addition or modification.
This guarntee shall be valid until 14-09-2010 (i.e) 28 days from the date of expiry of
Defects Liability Period.
Amount of Guarntee-Rs. 1,22,000/- (Rupees One Lakh twenty two hundered
only),Date 15-02-2008 Period-31 months.

Now withstanding anything contained herein..

1. Our liability under this bank guarantee shall not exceed Rs. 1,22,000/- (Rupees One
Lakh twenty two hundered only),
2. This bank guarantee will remain in force up to 14-09.2010.
3. Unless claim in writing is presented to us on or before expiry of the Guarantee. All
the purcher's rights under the said guarantee shall be forfeited and the bank shall be
released, discharged from all liabilities thereunder whether the original Guarantee bond
is returned to us or not for Bank of Baroda,Karve Road Branch, Pune-411004.
