1923- A Comparative Study of The Indian and English Decisions’, Journal of the
Indian Law Institute, Vol 11, No 4 (OCTOBER-DECEMBER 1969), pp 430-479”

In this paper, the author has made a brief discussion on the Workmen’s Compensation
Act, 1923 followed by an in-depth analysis of the provisions mentioned under the act that
addresses the issues of workplace injuries and an analysis of an extent to which the
employer should be liable to cover up the compensation of the injuries caused considering
several factors and situations of the incidents. The author has also portrayed a
comparative analysis by discussing both Indian and English legislations and the decisions
taken by the both courts in order to estimate the benefits and shortcomings of the
provisions of both legislations.

In this paper, the authors had made an economic perspective of the Workers’
Compensation discussing how it is beneficial for both the employers and employees. In
the process, they summarised many of the crucial legal issues surrounding the system and

provisions, safety incentives and methods of delivering benefits and discussed plants that
have been suggested for altering them. They also documented some of the recent growth
in the lawsuit designed to extent liability for work-related injuries and diseases beyond
the boundaries initially defined by workers compensation. In contrast to the broad
scenario of legal questions developed, the authors had attempted to provide an in-depth
analysis of two of the most important economic issues surrounding workers compensation
in this paper.
