SECTION 1 CRIMINAL PROCEDURE

Do you think it is better that before the application of a search warrant with the
Courts, law enforcement officer should first coordinate with the Prosecutor? Why
or why not?

There may be no provision of the law which requires or prohibits a law


enforcement officer to coordinate with a prosecutor before the application of a
search warrant, however, it would be better if they do. When applying for a search
warrant, a law enforcer should construct the application intelligently in accordance
to the constitutional requirements of the law. Therefore, with the help of a
prosecutor, the application would conform better to its requisites and have a better
chance of approval and validity in the court. For instance, he can give assistance in
the rules of particularly describing of places and things to be searched and seized
for it to be more valid. When it comes to the complainant and witnesses, the
prosecutor can provide legal advices regarding the right approach during their
examination with the judge to elicit a better view and convince the court that there
is certainly a probable cause.
In conclusion, the prosecutor can provide the law enforcer a better
preparation and there would be lesser chance of committing an error before the
formal application of a search warrant in the court. This would result to a successful
application of a search warrant in the court and strong evidence when the court
hearing comes.
