LEGAL PROFESSION MIDTERM EXAMINATION

Answer briefly and concisely. You are given three hours to answer the questions. Take a
picture of your answers as written in your test notebook and send to Google Classwork.
Also, please submit your hardcopy notebook to the Dean’s Office on Monday.

1. What is the significance of the Code of Professional Responsiblity?

2. Legal profession is said to be regarded as one of the noblest, if not the noblest
profession of all. Why is the legal profession regarded as a noble profession?

3. Explain why the legal profession is a privilege and a right.


4. Atty. Gelly passed the Bar 1n 1975. After taking his oath, he did not enlist in any IBP
chapter because he went to the USA to pursue a Master's Degree. Eventually, he
passed the state bar and specialized in lmmigration law. In 2005. he returned to the
Philippines and was but the IBP is charging him from 1975 up to the present and
threatening him with expulsion if he does not comply. Is the IBP correct? Explain

5. Victor has been legally separated from his wife, Belen for fifteen (15) years. He has
found true love and happiness with Amor and they lived together as husband and
wife. Amor convinced Victor to study law and gave him financial support. Recently,
Victor passed the 2018 Bar Examinations. Upon knowing this, Belen filed a
complaint against Victor for immorality. Should Victor be allowed to take oath as an
attorney?
6. If Holy Name University makes it mandatory for students who plan to enroll in the
Juris Doctor course to pass first the PhilSAT examination to be administered by the
Legal Education Board, would it be a valid pre-requisite? Explain.

7. Do you agree with the rule allowing law students to engage in limited practice of
law? Explain your answer.
8. May a foreign educated Filipino who finished his tertiary studies abroad take the
Philippine bar? Explain.
9. Juan Sawi flunked the bar examinations thrice already, in the Bar examinations given
by the Supreme Court for the year 2016, 2017 and 2018. Mr. Sawi is not giving up
his ambition to become a lawyer someday. Mr. Sawi now seeks your advice whether
he is qualified to take the 2019 bar examination. Explain your answer.
