SUBJECT : Investigation Report Rape with Homicide That transpired Mintal,

Tugbok District Davao City.

II. MATTERS INVESTIGATED:

5. To determine the facts and circumstances relating to Rape with Homicide where the
victim was one ARNEL JOHN B. EGALAN.

6. To determine the criminal liabilities of the suspect and to know the reasons behind
his motive that resulted into killing a person without any intention and to see if he is capable of
the offenses as charged.
III. FACTS OF THE CASE

7. On about 9’oclock in the evening of april 21, 2021. A resident of Brgy. Sto. Niño
tugbok reported and seek police assistance on the alleged that a girl aged 30 years
old student, a resident of barangay mintal tugbok district Davao city was killed and
rape The girl was found lying dead in half naked condition inside her house. the
crime scene behavior was violent in nature and investigation was made to establish
the physical evidence and psychology of the criminal. (Tab “C” and its extract copy
hereto attached as respectively)

8. Upon receipt of the report, the elements of this station led by PMAJ Sean David
were dispatched to the said area of incident to conduct ocular Investigation (Spot
Report dated November 09, 2021 hereto attached as Tab “D”).

9. In initial investigation Conducted by the responding officer disclosed that the suspect
was already identified as Renz Jason C. Batondo alyas BOTCHOK 21 years old,
student a resident of Brgy. Sto. Niño tugbok dist. Davao city. which was revealed by
one of the witness that on April 27 2021, about 12 ocklock in the evening they
received information from an informant that the suspect was last seen around the
Commercial Store in Catalunan Grande at 4 o’clock in the morning. After receiving
the tip, the station commander, PLT John Rey Costan directed response to the said
location. Upon arrival to the area, the officers had a clear view of the suspect waiting
for his brother Alvin Sangre. The arresting officers immediately proceed to where the
suspect is and informed him of the reason of the arrest and further his constitutional
rights. The suspect therein submitted himself peacefully and was brought to the
appropriate action and investigation (Progress Report dated on April 27, 2021 hereto
attached as Tab “F”). Moreover, the investigation also revealed that the area of
incident was not so far at the barangay hall (Sketch of Locality hereto attached as
Tab “E”).

10. Arnel john B. Egalan age 20 years old, Single, a resident of Brgy. Sto. Niño tugbok
dist.Davao city. through his sworn statement to the Police officer he stated that
around 9:30 in the evening he saw Joan heading straight to his home at around
9'ocklock in the evening when Renz Jason suddenly appear and pointed a gun to the
victim Joan and forcing him to go inside of Renz's house, a few moments later the
witness heard a gunshot and he saw Renz running outside from his house and throw
his gun in the trashcan after that he went inside to see what happened, he saw joan
lying down inside her house naked and bathed in his own blood. he immediately call
an ambulance to bring Joan to the nearist hospital for medication, but unfortunately
when they arrived to the hospital the doctor declared the victim dead on arrival.

11. In the joint affidavit of arrest of PSMG Zoro Roronoa and PMSG Sanji Vinsmoke
Police officer of Police station 9, they asserted that on NOVEMBER 09, 2021 at
around 5 o’clock in the morning, they were directed by the chief of police to effect the
arrest on the suspect. There upon the arrival of the house of the suspect, the suspect
was informed the reason of arrest and correspondingly his constitutional rights in a
language he can easily understand. He, thereafter, submitted himself peacefully and
was brought to the station for proper disposition of action and investigation (Joint
affidavit of arrest of PMSG Zoro Roronoa and PMSG Sanji Vinsmoke hereto
attached as TAB “F”).

IV. DISCUSSION

12. The suspect Renz Jason suddenly appear and pointed a gun to the victim Joan and
forcing him to go inside of Renz's house, a few moments later the witness heard a
gunshot and he saw Renz running outside from his house and throw his gun in the
trashcan after that he went inside to see what happened, he saw joan lying down
inside her house naked and bathed in his own blood. he immediately call an
ambulance to bring Joan to the nearist hospital for medication.

V. CONCLUSSION

13. After a handful perusal surrounding this particular incident, probable cause exists
that the herein suspect is criminally liable and be charge for RAPE WITH
HOMICIDE.

VI. RECOMMENDATION

14. WHEREFORE, In view of the forgoing undersigned respectfully recommendation that

the case of RAPE WITH HOMICIDE penalize under Article 266 Republic Act No.
8353 anti-rape law 1997 Philippine Commission on women of the revised Penal
Code be filed against Renz Jason C. Batondo at the Prosecutor’s Office. This case is
considered solved and closed.

MENDOZA IN THE OFFICE OF THE CHIEF OF POLICE, POLICE STATION NO. 9 ON MAY
22, 2021 AT ABOUT 8:00 AM ON THE INCIDENT HAPPENED LAST APRIL 21, 2021.

QUESTION AND ANSWER

Question: Mr Arnel John B. Egalan why are you here in the office of the chief of police?

Answer: I am here in order to give a statement about the incident that happened last April
21, 2021 in phase 2 Atis st., Brgy. Sto niño Tugbok District Davao city.

Question: Will you please narrate it to me the whole incident?

Answer: around 9:30 in the evening I saw Joan heading straight to her home at around
9'ocklock in the evening when Renz Jason suddenly appear and pointed a gun to the victim
Joan and forcing him to go inside of Renz's house, a few moments later I heard a gunshot and
then i saw Renz running outside from his house and throw his gun in the trashcan after that I
decided to go inside to see what happened, I saw joan lying down inside her house naked and
bathed in his own blood.

Question: what did you do after you heared a gunshot?

Answer: I immediately call an ambulance to bring Joan to the nearist hospital for
medication, but unfortunately when they arrived to the hospital the doctor declared the victim
dead on arrival.

Question: Then what did you do next?

Answer: I rushed here to report the incident.

Question: I have nothing to ask you at the moment, do you have anything to say or retract
from your statement?
Answer: None sir!
Question: Is there anyone who forced and coerced and threatened you to give these
statement of yours?
Answer: None sir!

APRIL 21, 2021 FOR RECORD – One Mister Arnel john B. Egalan 20 years old, Single, a
2100H resident of Brgy. Sto. Niño tugbok dist. Davao city. Personally came to this
office and reported that one Renz Jason C. Batondo 21 years old, student
and also a resident of the above mentioned address raped Joan B. Fronda,
30 years old, student, a resident of barangay mintal tugbok district Davao
city. The witness Arnel stated that he saw Joan heading straight to his
home at around 9'ocklock in the evening when Renz Jason suddenly
appear and pointed a gun to the victim Joan and forcing him to go inside of
Renz's house, a few moments later the witness heard a gunshot and he
saw Renz running outside from his house and throw his gun in the
trashcan. The witness immediately call an ambulance to bring Joan to the
nearist hospital for medication, but unfortunately when they arrived to the
hospital the doctor declared the victim dead on arrival. Case refered to the
investigation section for appropriate action for record and future
references.

JOINT AFFIDAVIT OF ARREST

We, PMSG Zoro Roronoa and PMSG Sanji Vinsmoke both bonafide members of the
Mintal police station, Davao Del sur. After having been duly sworn to in accordance with
law, do hereby depose and say

1. That on April 27 2021, about 12 ocklock in the evening, our office received
information from an informant that the suspect was last seen around the
Commercial Store in Catalunan Grande at 4 o’clock in the morning. After
receiving the tip, the station commander, PLT John Rey Costan directed
response to the said location.

2. That acting on the said information, our chief of police directed us to conduct
ocular investigation on the said report and possibly arrest the suspect

3. That thereafter, upon confirming the said report we were able to arrest the
suspect in the person on one Renz jason C. Batondo whom we were able to
locate Commercial Store in Catalunan Grande.

4. That we were able to locate and arrest him when we received him an
information that the said place immediately we brought the suspect to the
Mintal police station for proper documentation and disposition

5. That are appropriate changes are now being prepared by this station for filing
in court against suspect on Renz Jason C. Batondo

6. That we are executing this affidavit in order to attest to the veracity of all the
above mentioned facts

and later died due to being shot by a gun.
