RENT AGREEMENT

THIS RENT AGREEMENT is entered on this 01st day of September 2020 at


Mangaluru by and between: -

____________, hereinafter called as the FIRST PARTY of the one part.

AND

__________________, hereinafter called as the SECOND PARTY of the other


part.

The term and expression FIRST PARTY and SECOND PARTY shall mean and
include their respective heirs, legal representatives, successors and administrators,
agents, executors and assignees etc.

WHEREAS the FIRST PARTY is the owner of the residential house bearing
_________________________, more fully mentioned in the schedule here below
and herein after referred to as Schedule Premise.

ANDWHEREAS the SECOND PARTY was a tenant under the FIRST PARTY
with respect to the schedule premise under an agreement and the period of said
agreement has expired. Now therefore the SECOND PARTY has approached the
FIRST PARTY and requested the FIRST PARTY to let out the schedule
property to him on a monthly rent of Rs.15,100/- (Rupees Fifteen Thousand One
Hundred Only) for a further period of 11 months only and the FIRST PARTY
has agreed subject to the following terms and conditions:

NOW THEREFORE THIS RENT AGREEMENT WITNESSETH AS


FOLLOWS:
1] The tenancy period shall commence from 01-09-2020 and shall end on 31-07-
2021. That, the monthly rent is agreed and fixed for the Schedule Premise is
Rs.15,100/- (Rupees Fifteen Thousand One Hundred Only) and the same is
payable on or before the 5th day of every following tenancy month.
2] That the tenancy month commences from the 1 st day of every English Calendar
month and ends at the last day of every English Calendar month.

3] The SECOND PARTY shall pay rent regularly for every calendar month and
in default he shall pay the same with interest at 12% per month.

4] That the tenancy is for a period of 11 months only and the SECOND PARTY
shall surrender and hand over the vacant possession of the Schedule Premise to
the FIRST PARTY immediately after the expiry of 11 months.

5] That the SECOND PARTY has already paid a sum of Rs.75,000/- (Rupees
Seventy Five Thousand Only) by way of cheque bearing no.675151 as interest
free refundable caution deposit and the receipt of which FIRST PARTY hereby
acknowledges and the same shall be refunded to the SECOND PARTY without
interest at the time of vacating and handing over possession of the Schedule
premise to the FIRST PARTY.

6] That the FIRST PARTY shall pay the property tax to the authorities
concerned and the SECOND PARTY shall not be liable to pay the same in any
manner whatsoever.

7] That the SECOND PARTY shall not assign or transfer his right under this
agreement or sub-let, under-let and/or part with whole or any portion the schedule
premise in favour of any third parties.

8] That the SECOND PARTY shall not in any manner alter the existing structure
or put up any additional structure and/or effect any material alterations in
whatsoever manner to the schedule premise.

9] The SECOND PARTY shall be entitled to make use of the schedule premise
for residential purpose only.

10] That the SECOND PARTY shall pay the monthly water charges and
electricity charges as per the consumption made by him to the respective
departments as and when the bills are raised and shall not cause disconnection
thereof on account of non-payment of the revenue.

11] That the SECOND PARTY shall permit the FIRST PARTY and/or her
authorized agents to inspect the schedule premise at all reasonable times.

12] That the SECOND PARTY shall maintain the schedule premise in good and
tenantable condition and shall return/hand over to the FIRST PARTY without
causing any damages in the same condition as it were handed over to the
SECOND PARTY as on this day subject to reasonable wear and tear.

13] That the SECOND PARTY shall not cause any disturbances, annoyance
and/or public nuisance to the neighbors in whatsoever manner.

14] That the SECOND PARTY shall not raise any loans, advance etc., on the
strength of the schedule premise or by hypothecation of any amenities, furniture,
fixtures and fittings provided by the FIRST PARTY.

15] That in the event of the SECOND PARTY fails or neglects to pay the
consolidated monthly rentals, consecutively for a period of two months, the
FIRST PARTY shall be at liberty to determine the lease without causing any
notice to the SECOND PARTY and the FIRST PARTY shall thereupon be
entitled to and at liberty to re-entry upon the schedule premise.

16] That the SECOND PARTY undertakes that he shall not damage the schedule
premise and/or any amenities in any manner. Any damage caused by the
SECOND PARTY on account of either his careless attitude or otherwise, such
damages shall have to be made good by the SECOND PARTY.
17] That the FIRST PARTY shall be at liberty to adjust apart from the damages
caused if any by the SECOND PARTY to the schedule premise, all arrears of
consolidated rent and electricity charges etc., against the security deposit and in
the event the security deposit is insufficient to meet the same, the SECOND
PARTY shall be liable to make good such excess amount out of his personal
assets and earnings.

18] It is agreed between the parties that in case the FIRST PARTY intends to
terminate the lease during the pendency of the lease, the FIRST PARTY shall
give one month prior notice in writing to the SECOND PARTY and in case the
SECOND PARTY intends to terminate the lease during the pendency of the
lease, then the SECOND PARTY shall give one month prior notice in writing to
the FIRST PARTY stating the intention thereto.

19] That the SECOND PARTY shall vacate and handover the vacant possession
of the schedule premise in good and tenantable condition to the FIRST PARTY
on determination of this Rent Agreement, either by efflux of time or otherwise.

20] That this rent agreement shall be terminated in case of any breach of the any
of the conditions and covenants herein contained by the SECOND PARTY, the
FIRST PARTY shall be entitled to re-enter into the premises without prejudice to
her right to recover all arrears of rents and other charges.

21] That after the expiry of the lease period of 11 months both parties may
continue the lease for a further period as mutually agreed by both the parties by
drawing up a fresh agreement.

22] The arrangements envisaged in this Agreement shall be implemented and


effectuated by both the parties in the best interest and by maintaining cordial
relationship between them.

23] This Rent Agreement is prepared on stamp paper of the value of Rs.500/- and
the same is retained with the FIRST PARTY and a copy of the same shall be
retained by the SECOND PARTY.
