1. If an individual enters a drug den or resort being utilized as a place for taking in drugs and selling of drugs, without his
knowledge of the activities, will he be charge of a violation of RA 9165? Why or why not?
 No, because he doesn’t have the knowledge, or he is unaware of the nature of the place as such and shall
unknowingly visit the same.

2. Why is there a need for a confirmatory test supposed the arrested offender who underwent laboratory examination yielded
positive of drug use?
 Positive results on an initial drug test usually needs to be confirmed with additional testing. Confirmatory test is
conducted with the use of gas chromatography, this is more specific which will validate and confirm the result of the
screening test.

3. Explain the difference between the act of unnecessary prescription of drugs and unlawful prescription of drugs.
 The act of unnecessary prescription of drugs is the prescribing of any dangerous drugs by a licensed practitioner to
any person whose physical or physiological condition does not require the use or in the dosage prescribed therein
while unlawful prescription of drugs is the unauthorized issuance of a prescription or any other writing purporting to
be a prescription of any dangerous drugs.

4. Why is the mere possession of a dangerous drugs during parties or other occasions where a group of 2 or more persons are
present be considered a violation of RA 9165?
 Because it has a harmful effect on the physical and mental well-being of a person.

5. Dr. Doolittle, a chemist at a laboratory in the Philippines, has been found to have in his possession an amount of drugs
intended to be used in the processing of a medicine to cure COVID 19, upon his arrival at NAIA from China. Being the chief
chemist of said laboratory, he has been authorized to buy, acquire or possess such substances in relation to his work. Will Dr.
Doolittle be charge of an offense of RA 9165? Explain your answer.
 No. He will not be charge for the violation of RA 9165 because he is a duly licensed practitioner and it was part of
his job, he was only authorized to administer the drugs for medical purposes.
