CODE OF PROFESSIONAL CONDUCT

Ethic in BEM

 Specific to the target of producing engineer who is able to perform his duty in an ethical way, Board of Engineers
produced a set of regulations named as Code of Conduct to be adhered by a REGISTERED PERSON.

Who are REGISTERED PERSON ?

 In exercise of the powers conferred by paragraph 4(1)(f) of the Registration of Engineers Act 1967 [Act 138],
the Board of Engineers Malaysia hereby determines the Code of Conduct of registered Person as stated herein
below.
 This Circular supersedes Circular No. 3/2005, Guidelines for Code of Professional Conduct (BEM/RD/PPC/08).
 This Code of Conduct is in addition to Part IV, Code of Conduct of the Registration of Engineers Regulations
1990.

The REGISTERED PERSON IS :


1) PROFESSIONAL ENGINEER WITH PRACTISING CERTIFICATE
2) PROFESSIONAL ENGINEER
3) GRADUATE ENGINEER
4) ENGINEERING TECHNOLOGIST
5) INSPECTOR OF WORKS

Sources of Codes

 REA - an act and a document passed by parliament to become law


 RER – a regulation prepared by BEM and approved and issued by Minister of Works
 Circular – a document issued by President of BEM

Code of Conduct PEPC

1) PEPC is not allow to falsify his qualification.


2) Before sign or make any endorses PEPC need to check carefully with due diligence the accuracy. Don’t simply
sign or endorses any document before checking.
3) Respond with the reasonable time with the Board or any other authorities to his professional services. Don’t try
to avoid communicate with them.
4) Any task or work assign to PEPC must be qualified by education and experience related with the work like
example M&E work need to assign with the person have the M&E qualification.
5) PEPC just only sign the engineering document that was prepared by him and has been prepared under his
direction and control.
6) A registered PEPC shall not accept assignment and assume responsibility for coordination of an entire project
and sign and stamp (Professional Engineer with Practising Certificate stamp) the engineering documents for the
entire project.
7) PEPC need to prepare the professional report, statement and testimonies with the right and relevant information.
8) PEPC is not allowed to express publicity about the technical oppinions that are not of his competence or
expertise.
9) A registered PEPC shall not issue any statement, criticism or argument on technical matters that are inspired or
paid for by interested parties.
10) A registered PEPC shall notify the Board in writing within three (3) months:-
i. if he is convicted of an offence involving false or negligent certification, fraud or dishonesty in Malaysia or
elsewhere; or
ii. if he becomes a bankrupt.

Code of Conduct GE

1) GE is not allow to falsify his qualification and tell the false experience or exaggerate the previous work
experience to demand the better salaries.
2) Before sign or make any endorses GE need to check carefully with due diligence the accuracy. Don’t simply
sign or endorses any document before checking.
3) Respond with the reasonable time with the Board or any other authorities to his professional services. Don’t try
to avoid communicate with them.
4) Any task or work assign to GE must be qualified by education and experience related with the work like example
M&E work need to assign with the person have the M&E qualification.
5) GE just only sign the engineering document that was prepared by him and has been prepared under his direction
and control.
6) GE need to prepare the professional report, statement and testimonies with the right and relevant information.

Registered Graduate Engineer to certified work only if he has supervised, witnessed, or inspected such work

1) Registered GE shall keep proper records of his participation, supervision, inspection or witnessing of activities
on site including the dates and time, subject-matter, condition of site, weather, etc
2) Registered GE shall check or verify with due diligence the accuracy of facts and data before he signs or endorses
any statement or certification.
3) Registered GE shall bring to the attention of the Engineer or Employer at the earliest possible opportunity of
any instance where the work or materials used are not in compliance with the specifications, drawings or
conditions of contract.
4) Registered GE shall not issue instructions to the Contractor or give verification or approval to works carried out
by the Contractor unless he has been authorised by the Engineer or Employer to do so.
5) Registered GE shall not reveal acts, data or information without the prior consent of the Engineer or Employer,
except as authorised or required by law or when the withholding of such information is contrary to the safety,
health and interest of the public.
6) Registered GE having knowledge of any violation of this Code of Conduct or any law or regulation shall report
thereon to the Engineer or Employer and, where relevant.

Registered Graduate Engineer notto accept benefit from more than one party

1) GE is not allowed to take job from Client and contractor at the same time without permission of the client.
2) GE has to disclose to the client if the contractor or supplier he wishes to recommend or accept their services.
3) GE cannot accept reward from supplier because its tantamount corruption.
4) PEPC cannot involve in making decision for appointment of agent where he is a director.
