Terms and Conditions

1. Think and Learn Pvt. Ltd (Company) reserves the right to make any change in BYJU’S
products and programs without prior notice.
2. Think and Learn products and programs are intended for individual use only. Broadcasting
the programs through any means,including but not limited to through the internet, television,
handheld devices and other devices, is not permitted,and is a breach of the intellectual
property rights of Think and Learn Pvt. Ltd (the “Company”).The Company reserves the right
to initiate legal proceedings in the case of such a breach.
3. It is expressly clarified that all intellectual property rights including but not limited to
copyright, patent, trademarks, trade secrets in the products, modules, contents and programs
shall continue to vest withthe Company at all times.The student/ parent shall not have the
right to claim any rights over the intellectual property in the product by virtue of them
purchasing the product.Further, in no event shall the student / parent have the right to make

 copies of the products once the sale is made.The student / parent acknowledges that a
breach of this clause could cause irreparable harm to the Company as to which monetary
damages may be difficult to ascertai or an inadequate remedy.The student / parent
acknowledges that the Company will have the right, in addition to its other rights and
remedies, to seek injunctive relief for any violation of the clause.
4. Customers are entitled to make payment for BYJU’S products and programs through online
payment, cash, card or cheque.
5. In the case of payment by cheque, the requested product / program will be dispatched by the
Company only on realization of the cheque.
6. Should the cheque bounce,fail to be realized or if the Company is required to present an
alternate cheque for any reason, any banking charges incurred by the Company in this regard
are recoverable by the Company from
7. the issuer of such a cheque
8. The Company is entitled to revise the price of its products and programs, at any time, at its
sole discretion without prior notice
9. The parent/student will have access to the product and content until the month & year of
validity specified in this form and
10. certain courses/ programs by the company may have a view count restriction.The parent /
student is bound by the same.
11. If the tablet or SD card is lost/misplaced post delivery, then a student can ask for a new
device against the payment for the same.
12. On receipt of such request, the Company shall disable / lock the misplaced tablet or SD
card.The student undertakes to provide any
13. assistance as may be required by the Company for the same.The tablet price would depend
on the market price of the tablet as determined
14. by the Company and the content SD card will be replaced for 2500 / - each, which price may
be amended at the sole discretion of the Company.
15. Any change of address or phone numbers should be notified to the Company without any
delay through a written application or by reaching out
16. to us on our customer care number 9243500459
17. A student/ parent may apply for a refund within a period of 15 (fifteen) days after delivery of
the product.
18. The request shall be made within the end of 15th day from the delivery of the product through
an email to support@byjus.com.
19. From the 16th day onwards, the student / parent, will not be eligible for a refund of the course
fee.The decision of the Company regarding
20. the eligibility of a student / parent to claim a refund shall be final and binding.The company
will issue refunds for those cases which are
21. eligible for a refund via cheque, NEFT or any other mode that it so prefers.The company is
not obligated to refund the amount by cash,
22. Think & Learn Pvt. Ltd reserves the right to withdraw any of its products without prior notice.
In the event of the same,
23. the customer would be offered an option to opt for an alternate product / course for a refund
of the amount paid via cheque or NEFT.
24. If at any point of time, the government further increases tax rate, the extra amount of taxes
will be borne by the customers
25. from the date of enforcement of such act by the government
26. In case of any dispute or difference between the user and the Company, regarding the
interpretation of these terms and conditions,
27. non - payment of any claim or any dispute arising out of or in pursuant to these terms and
conditions, the same shall be referred to a
28. sole arbitrator who shall be appointed by the directors of the Company.The proceedings shall
be conducted at Bangalore under the provisions
29. of Arbitration & Conciliation Act and the courts at Bangalore only shall have the jurisdiction

 over the matter and / or for enforcement as
30. the case may be.Such person shall be entitled to proceed with reference from the stage at
which it was left by his predecessor, if both the parties consent to this effect, failing which
the arbitrator will be entitled to proceed de novo,
31. Warranty will be valid only when the original duly filled TAX INVOICE is presented together
with the defective product
32. This warranty will not apply if the type or serial number on the product has been altered,
removed or defaced
33. This warranty does not cover the damage caused to the product due to improper installation
by customer and/ or connecting the product to
34. equipment not approved by device manufacturer and deficiency in product performance due
to electricity disturbances while charging.
35. This warranty does not cover the risk to the product caused by accident, lightening, water,
fire, other acts of God, improper ventilation,
36. dropping or excessive shock or any external cause beyond the Company & device
manufacturer’s control.
37. Any problems related to the tablet (hardware) will be rectified/replaced by the device
manufacturer only, and the Company will not be
38. liable for the same.Think and Learn Pvt.Ltd will only be able to assist the customer in case
there are any issues related to
39. SD card content on the tablet.The Company will not be liable in case the device manufacturer
charges the customer in case there is
40. any physical damage to the tablet
41. It is understood that the minor is the beneficiary/user of our product/App, however as per the
Indian Contract Act,1872 it is only the
42. parent / guardian who can enter into a valid / legal contract and for all practical purposes, it
is deemed that the parent / guardian is the
43. end user of the same and will have rights and liabilities as contemplated herein and under
relevant act and statutes for the time being in force.
