Dear Sir,

We, the undersigned, having examined this Form of Tender, Instructions to Tenderers, Form of
Agreement, BWO Terms and Conditions and all Appendices, hereby tender and undertake to execute
and complete the whole of the Tender Scope for Frame Agreement on Onshore fabrication Services

in accordance with and as defined in the above mentioned documents to the entire satisfaction of BW
Offshore Nigeria Ltd (on behalf BW Offshore Singapore Pte Limited and Sendje Berge Limited) (“BWO”)
and in line with recognized good trade practice for the amount shown below.

1. We agree to abide by the Tender for a period of one hundred and twenty (120) calendar days
from the date fixed for receipt and it shall remain binding upon us and the Tender may be
accepted at any time prior to the expiry of that period.

2. Pending a formal agreement being prepared and executed this tender together with the
written acceptance thereof by BWO shall constitute a binding contract between us.

3. We have examined the Tender Documents and Addendum(s) and have taken these into
account in compiling our Tender.

4. We confirm that all prices and rates are fully inclusive, fixed, firm and valid for the duration
indicated in clause 1 above, and includes all Contractor’s costs, expenses, overhead and
profit for the complete performance of the Work. All prices shall be expressed in NIGERIAN
NAIRA as agreed and such prices shall not subject to change in the event of fluctuation in the
rate of exchange of any other currency to the Nigerian NAIRA
