Sub:- Appointment/Extension of tenure of SPPs for     handling
CBIC cases before the Subordinate Court and High Court
in Mumbai Zone-Reg.

            It is to mention that vide Board’s order vide F. No. 278A/21/1999-
Legal dated 20.09.2016, tenure of Smt. Anuradha Mane as Special Public
Prosecutor (SPP) was extended from 06.10.2015 to 05.10.2018 (Copy
enclosed). During discussion with the SPP, it is learnt that she is facing
questions from the accused parties regarding the very validity of her
authorization to defend the case, in the absence of extension of her tenure
after 05.10.2018. Same is the issue with Shri Prafulla V. Mahatre who was
appointed as SPP vide Order F. No. 278A/15/2013-Legal dated 09.01.2015
whose tenure ended on 30.09.2016 and Letter dated 08.09.2021 received
from JNCH, Mumbai is enclosed in this regard.

Further to this, DRI vide their letter F. No. DRI/MZU/D/Misc-

14/2008-09 (Pt II)/8901 dated 30.08.2021 (copy enclosed) expressed

concern over the legal issues with regard to the ongoing

prosecution/remand cases and requested post-facto approval for extension
of tenure of 7 advocates appointed as Special Public Prosecutors (SPPs) for
period of 18 months from 21.12.2018 to 20.06.2020 vide CBIC order F. No.
278A/29/2017-Legal dated 21.12.2018.
 
            Whereas the proposals of this Office for getting approval of fresh
panel of SPPs is pending with CBIC, it is requested that the tenure of the
following SPPs may please be extended, post-facto, until new Panel of SPPs
is approved by CBIC which is mandatory in view of the fact that the
Department is utilizing the services of these SPPs beyond the tenure of their
appointment.
