after  they  hit  a  group  of
protesters.

The violence broke out after
two  SUVs  allegedly  ran  over

protesters, who were demon­
strating against Maurya’s visit
at the Tikonia­Banbirpur road

up some passengers.

menced  PNG  supply  in  Gorakh­
pur  district  of  Uttar  Pradesh

gramme for Organic Produc­
tion (NPOP).
This  is  part  of  APEDA’s  ef­
forts  to  boost  export  of  or­
ganic  produce  and  products
from the country.
Organic  farming  in  the
country  has  grown  at  a
steady pace since the launch
of NPOP in 2001 and with the
thrust  extended  by  APEDA,  a
statutory  body  under  the
Ministry  of  Commerce,  ex­
ports  of  organic  products
have increased.

Spike is  a  detailed  narrative  on  how  the  pan­
demic evolved in the first 18 months. It is written
by  Dr  Jeremy  Farrar  who  is  a  tropical  medicine
expert and member of SAGE, the scientific advis­
ory group for emergencies in the UK. Although
much has been written about the pandemic, this
book pieces together all the events as they unfol­
ded,  meticulously  documenting  them  through
the eyes of a medical doctor. While written from
a global  perspective,  the  book  focuses  on  Bri­
tain’s  dilemma,  response  and  experience  in
some detail.
The  book’s  title,  Spike — could  not  have  been
more  apt,  as  it  refers  not  only  to  the
spike  protein  of  the  SARS­CoV­2  virus,
but perhaps also signifies that a spike
in cases (and deaths) could occur from
failed  decisions,  or  worse  —  failing  to
decide.
The early part of the book is written
like  a  thriller.  The  first  chapter  opens
with  the  author  seated  in  an  airport
lounge  in  Rwanda  on  December  31,
2020,  scanning  through  his  phone  —
when  he  first  became  aware  of  a  cer­
tain situation in China. The reader gets
a first­person  account  of  how  Dr  Farrar  net­
worked with important people across the world,
in an attempt to decipher the true nature and ex­
tent of the problem.
The  reader’s  interest  is  kept  hooked  in  both
the  science  of  the  pandemic,  as  well  as  the  hu­
man  and  fallible  side  of  being  a  concerned  sci­
entist. Dr Farrar has annotated his prose with his
own emails and tweets, recreating a sense of the
real­time urgency he faced.
A ‘how-to’ guide
Virology and epidemiology apart, Spike is also a
goldmine of practical wisdom; it is essentially a
how­to  guide  for  those  interested  or  involved
with decision­making. Barriers to decision­mak­
ing are elegantly outlined, and this would be one
of  the  key  take­aways  from  the  book.  For  in­
stance, you could involve several brilliant and in­
dividually  competent  people  in  a  project,  but
that need not necessarily result in the best pos­
sible outcome. The chief reason is that effective
Dr  Farrar  demonstrates  how  individual  per­
ception of an evolving situation can vary for dif­
ferent individuals — based on their personality,
past  experience,  personal  failures,  individual
preferences,  influence  of  peer  groups  and  mul­
tiple  types  of  bias.  In  particular,  he  highlights
two forms of bias that corrupt decision­making
during a crisis – they are optimism bias and con­
firmation bias.
He  also  warns  of  the  intrusion  of  pseudos­
cience in the guise of science, referring specific­
ally to ‘The Great Barrington Declaration’ which
essentially was interpreted as “let the disease run
its course”. He explains why the concept of ‘herd
immunity’,  while  applicable  to  pathogens  like
poliovirus,  does  not  apply  to  the  SARS­CoV­2
virus. Unfortunately, the price to pay for an ini­
tial delay in implementing even basic measures
was  a  large  number  of  deaths,  and  today,  the
world  knows  that  Britain  was  not  the  only
wealthy  nation  that  suffered  the  con­
sequences of early hesitancy.
In spite of Britain having had the op­
portunity  to  witness  the  devastation
caused by the pandemic in more than
one  country,  writes  Dr  Farrar:  “The  UK
was  suffering  its  own  long­standing
malady:  the  arrogance  of
exceptionalism”
Although  criticised  for  its  tepid  ini­
tial  response,  Britain  has  shown  the
way  for  the  world  in  several  other  as­
pects  of  the  pandemic.  This  includes
the  RECOVERY  trial,  which  gave  the  world  the
first  scientifically  proven  life­saving  treatment
for Covid­19, that was dexamethasone. A consid­
erable part of our knowledge of variants is owed
to  the  work  of  British  scientists.  Public  Health
England generates regular updates on variants,
and  on  the  effect  of  vaccines.  Spike provides  a
rare  insider’s  perspective  into  how  these  ele­
ments were put together for a common good.
Although  the  pandemic  is  far  from  over  and
knowledge is rapidly getting outdated, Spike will
no doubt hold its position as a candidly written
early narrative on the topic — by a person of au­
thority and competence. Dr Farrar’s book will en­
thuse  general  readers,  policy  makers  as  well  as
healthcare  workers,  all  of  whom  have  been  in­
volved  or  affected  by  the  pandemic  one  way  or
another.

fter  being  a  hard­boiled
academician  for  more
than  three  decades,  Cor­
nell  University  Professor
Kaushik Basu took a plunge into the
cauldron  called  government  when
he  became  Chief  Economic  Advisor
in  late  2009.  This  was  the  year  the
UPA  returned  to  power  much
against  expectations.  It  was  also  a
time when the 2008 global financial
crash was beginning to be felt in the
emerging  economies.  Basu’s  term
lasted  till  2012,  when  India  had  to
pump  in  a  massive  stimulus  to
maintain growth, leading later to in­
flation and stuttering growth.
After  his  stint  with  the  govern­
ment, just when Basu was preparing
to go back to the quiet world of aca­
demia,  he  was  offered  the  post  of
World Bank Chief Economist.
Policymaker’s Journal is essentially
a diary  that  Basu  kept  during  his
years in New Delhi and Washington.
He  does  not  go  into  the  nitty­gritty
of policymaking here, as dealt with
in an earlier book. These are impres­
sionistic  jottings  that  Basu  made
every night after a hectic day’s work.
The period in which the author was
Chief  Economic  Advisor  was  also
one beset with corruption scandals –
Commonwealth  Games,  2G,  coal
case – were some of the major ones.
View on corruption
But one hardly finds any mention of
them  in  the  book  and  the  reason
Basu  gives  is  he  did  not  personally
witness  any  act  of  corruption,
adding,  “while  there  is  a  lot  of  cor­
ruption in the government, its incid­
ence is not as high as many outside
observers believe”.
In fact, his view on corruption got
Basu  into  a  bit  of  trouble  with  the

ing  economists  and  researchers  to
send  academic  papers  involving
policymaking.  Basu  wrote  a  paper
on  corruption  where  he  said  in
small corruption offences, the ‘bribe
giver’,  who  are  usually  common
people, should not be penalized for
giving bribes to get a ration card or a
driver’s license.
This paper was widely reported in
the press and predictably raised the
hackles of the political class. Ironic­
ally,  the  Left  parties  were  most  in­
censed and wanted the paper to be
taken  down  from  the  Finance  Min­
istry  web  site.  Basu  was  willing  to
even  put  in  his  papers  if  either  the
Prime Minister or the Finance Minis­
ter had made such a request. To their
credit  they  didn’t,  much  to  Basu’s
relief.
Another  interesting  incident  re­
counted in the book was when Basu
gave  the  Carnegie  Endowment  lec­
ture in the US where he made some
remarks on reforms in India, which
were construed in the press as proof
of  the  then  government  halting  re­
forms  till  the  2014  elections.  This
again predictably created a storm in
New Delhi.
When  Basu  in  his  defence  said
that  it  was  a  case  of  misreporting,
Pranab Mukherjee, the then Finance
Minister,  was  convinced  and  told
Basu  to  call  up  the  reporter  con­
cerned  and  give  him  a  piece  of  his
mind.  When  Basu  called  up  the  re­
porter,  the  reporter  was  so  apolo­
getic, having got enough grief from
his  bosses,  that  it  was  Basu  who
ended up consoling him!
Another  major  government  de­
cision  taken  during  Basu’s  tenure
was the controversial “retrospective
tax”  law  which  was  brought  in  to
counter the adverse Supreme Court

cases  against  some  MNCs.  Basu
claims  that  he  was  kept  out  of  the
loop  on  this  decision  and  wonders
whether that was because he would
have opposed it. For the record, this
law was recently amended after nine
long years.
Basu  has  great  admiration  for
Manmohan  Singh,  Pranab  Mukher­
jee and Arun Jaitley. He is almost in
awe of Manmohan Singh. But it is his
glowing views on the Gandhi­Nehru
family  that  are  bound  to  raise  eye­
brows. About Rahul Gandhi, he says,
“… he has no great interest in power,
which  is  a  rare,  good  quality  in  a
politician.  He  is  also  a  person  of
ample  basic  goodness.”  Goodness,
maybe, but power?
Basu had his skirmishes with then
high­profile  NAC  over  making
everything  into  a  right.  He  says,
“…to enshrine something as a right,
when  you  have  no  way  to  ensure
that the right can be fulfilled is to di­
minish  the  value  of  the  right.”
Though  he  supported  the  right  to
food law, he opposed right to work.
The Washington years
As World Bank Chief Economist Basu
led  a  peripatetic  life  travelling  to
Tajikistan, Peru and Estonia.
There  are  some  amusing  incid­
ents  recounted  here  –  Tajikistan’s

a party; a meeting with Bill Gates at a
restaurant  in  Washington,  where
Gates  confessed  to  Basu  that  his  fa­
vourite Indian politician was Nitish
Kumar.  Basu  tried  to  get  Gates  en­
thused on the concept of “Living Life
Index”.  But  the  index  “meant  to
study bureaucratic hurdles faced in
everyday  life”  was  stymied  by  the
bureaucratic  hurdles  in  the  World
Bank!
Basu also had a chance to meet the
legendary  Daniel  Ortega  of
Nicaragua,  who  led  the  Sandinista
revolution back in the 1970s, where
he mused on ”how hard it is live up
to  the  idealism  of  a  genuinely  pro­
gressive revolution”. Basu wanted to
ask  him  about  his  fall  from  grace,
but  discretion  got  the  better  of
valour.
On the ideological spectrum, Basu
considers himself firmly on the Left.
This  will  surely  make  some  tradi­
tional  Left  leaders  in  India  uncom­
fortable – a Leftist World Bank Chief
economist?  But  to  Basu’s  credit,  he
attempted  to  veer  the  World  Bank
away  from  the  much­maligned
“Washington  Consensus”  and
worked  on  the  “Stockholm  State­
ment”  which  emphasized,  “…  that
economics  was  not  just  about  free
trade,  deficit  control  and  GDP
growth. Inequality matters, for a bet­
ter society and also an end in itself”.

is  that  it  is  written  with  great  hu­
mour,  much  of  it  self­deprecating.
But  one  gets  the  impression  that
Basu has held back more than he has
revealed  –  especially  on  his  New
Delhi days.

The  oil  producer  group  known
as  OPEC+  keeps  trumpeting  its
flexible  approach  to  balancing
the  global  oil  market.  As  prices
test  $80  a  barrel,  that  flexibility
needs  to  include  raising  the
amount of oil they plan to pump
in the coming months.

touting. Their own analysts, who
presented  their  findings  to  the
group’s  technical  committee
last  week,  see  global  stockpiles
continuing  to  be  drawn  down
over  the  next  two  months,  be­
fore a swing in the opposite dir­
ection early next year.
The  ministers  could  be  for­

“I was jotting down all the anecdotes

Section 31D(2) speaks of the necessity of giving prior notice, in
the manner as may be prescribed, of the intention to
broadcast the work stating the duration and the territorial
coverage of the broadcast, together with the payment of
royalties in the manner and at the rates fixed by the Appellate
Board.
While the High Court has held the broadcasters down to the
requirement of prior notice, it has modified the operation of
Rule 29 by stipulating that the particulars which are to be
furnished in the notice may be furnished within a period of
fifteen days after the broadcast. The interim order converts
the second proviso into a “routine procedure” instead of an
exception (as the High Court has described its direction). This
exercise by the High Court amounts to re-writing.

Not a business activity

A single transaction of buying and selling shares does not
constitute a business activity, the Chennai bench of the
Income Tax Appellate Tribunal (ITAT) has said. The income tax
assessee had purchased and sold 1.25 lakh shares of ING Vysya
Bank in 2009. He declared the transaction as an investment
and accordingly claimed capital gain while filing his IT return.
To this, the ITAT said, “It has to be

inferred that the assessee’s
intention is to do business in shares.

While the OECD is working towards developing consensus on
an inclusive framework to address tax challenges from the per­
spective of digitalisation of the economy, several countries have
introduced unilateral measures to tax the digital economy. In­
dia was a forerunner of such unilateral approaches with the im­
plementation of the Equalisation Levy 1.0 in 2016. In 2020, the
Indian Income­tax Act expanded the scope of Equalisation Levy
(commonly referred to as ‘Equalisation Levy 2.0 or EL 2.0’) as
part of the Finance Act 2020. EL 2.0 was made effective on April 1,
2020. The new levy now includes a 2 per cent tax on gross reven­
ues received by a non­resident “e­commerce operator” from the
provision of ‘e­commerce supply or service’ to Indian residents
or non­resident companies having a permanent establishment
in India. The expression ‘e­commerce supply or service’, inter
alia, includes the online sale of goods or the online provision of
services or facilitation of the online sale of goods or provision of
services. 
Further,  amendments  were  made  in
the Finance Act 2021 to clarify and expand
the scope of EL 2.0. One such amendment
appears  to  have  expanded  the  scope  of
this levy manifold. As mentioned above,
one  of  the  prerequisites  to  trigger  a
charge  under  EL  2.0  is  ‘online  sale  of
goods’  or  ‘online  provision  of  service’.

On  a  tight  time  schedule  for
the  proposed  India­UAE  free
trade  pact,  which  is  to  be
signed by early next year, the

vestment  and  Internal  Trade
(DPIIT)  has  called  for  sugges­
tions  from  industry  bodies
and other stakeholders on in­
tellectual  property  rights  is­
sues that could make it easier
for  Indians  to  do  business  in
