CONTRACT OF LEASE

KNOW ALL MEN BY THERE PRESENTS:

This Contract of Lease made and entered into by and between:

JOSE MAURO HAGUISAN, of legal age, Filipino, and a resident of Tandag


City, hereinafter referred to as the “LESSOR”; and ROSALINDA GENON EGAY, of
legal age, Filipino, and a resident of P-1, Payasan, Lianga, Surigao del Sur, hereinafter
called as the “LESSEE”;

-WITNESSETH, that:

WHEREAS, the LESSOR is the owner of Commercial space/building, located at


Osmeña St., Tandag City, Surigao del Sur ;

WHEREAS, the LESSEE is desirous of leasing the said commercial building


under the following terms and conditions:

A. That the term of this contract is for a period of ONE (1) year starting
March 18, 2021 to March 18, 2022, renewal to the option of both parties ;

B. That the monthly rental of the lease premises shall be in the amount of
Thirteen Thousand (P13,000.00) Philippine currency payable every
month ;

C. That the LESSEE shall give to the LESSOR two (2) months deposit and
one (1) month advance rental, a total of Thirty-Nine Thousand Pesos
(P39,000.00) upon signing of the contract ;

D. That the amount of Twenty-Six Thousand Pesos (P26,000.00) can be


applicable used for the last (2) two months remaining the initial contract,
and the remaining Thirteen Thousand Pesos (P13,000.00), one-month
advance rental ;

E. Government taxes – all applicable government charges shall be by the


account of the LESSEE ;

F. Cost of utilities that the Lessee shall be responsible for Telephone,


Electronic, Water, Etc. ;

G. That the improvement like repairs and renovation within the premises
during the start of the contract made by the Lessee upon the consent of the
Lessor, all the expenses incurred shall not be chargeable against the rental.
The improvement that will be introduced by the LESSEE in the lease
premises such as the Display Glass and Door shall not be removed after
termination of the lease contract, Fix items such as floor upgrade/fix vinyl's,
electrical outlets, switch covers, and ordinary electrical light receptacles,
must not be removed after the termination of lease contract. Otherwise
stated, the improvement shall be owned by the LESSOR ;

H. Responsibility answerable for whatever damage may be caused on the


leased premises for all acts and omissions of the listed employees, guests,
customers, intruders and person allowed by him to access to the leased
premises ;

I. The Lessee shall not keep, deposit or store in the leased premise to any of
obnoxious substance of inflammable material that may cause a fire hazard ;
J. Sanitations, maintenance and security which the Lessee shall be responsible
for the care and maintenance of the furnishings inside and outside the leased
premise and shall be responsible for the damages and loss of the
furnishings. In the event of Fire in the leased premise due to fault or
negligence of the Lessee member of his staff, visitor, or guests. The Lessee
shall take FULL responsibility in the paying of the damages ;

K. That the Lessee is not allowed to sublet the leases premise to any person or
entity ;

L. Environment - that the Lessee shall maintain a healthy and peaceful


environment ;

M. That the Lessee has received the leased premise is in good habitable
conditions ;

N. That the Lessor is may enter the area only upon prior notice and express
consent of the Lessee ;

O. That in case the Lessee, at his own expense, introduces improvements on


the lease premises, these improvements, which will cause damage to the
building if detached or removed, will become a property of the LESSOR.
Otherwise stated, improvements which will not cause damage to the
building if removed may be taken by the LESSEE whenever he decides not
to renew his contract with the LESSOR ;

P. Any breach of the contract i.e., Lessee evacuates the premise before the said
ending of the contract. The Lessee is obligated to pay the remaining
duration of the months accountable for. The LESSEE has the option to
vacate the lease premises in the event of breach of contract committed by
the LESSOR ;

Q. Any violation committed maybe brought for proper legal action in any
competent court in Tandag City, Surigao del Sur;

R. Failure to comply as determine by competent court any terms and


conditions stated here in, this contract shall be considered and rescinded
and the Lessor shall have the right to repossess to the leased premise.

S. That this contract shall take effect after signing hereof.

IN WITNESS WHEREOF, the premises hereto have caused this Contract of


Lease to be executed _____________________ at San Francisco, Agusan del Sur.

ACKNOWLEDGMENT

BEFORE ME, this _____________________ at San Francisco, Agusan del Sur,


personally appeared the above-named persons known to me to be the same persons who
executed the foregoing instrument, and they acknowledged to me that the same are their
free act and deed.

This instrument consisting of two (2) pages including this page has been signed by
the parties and their witnesses at the left margin of each and every page hereof.
