CONTRACT OF LEASE

KNOW ALL MEN BY THERE PRESENTS:

This Contract of Lease made and entered into by and between:

EMELIA L. PADIN, of legal age, Filipino, and a resident of #26 Blue Marlin St.,
Aranai Village, Brgy. Ususan, Taguig City, hereinafter referred to as the “LESSOR”; and
JOY MARIE B. LLIDO, represented by: JIDO LASTIMADO, of legal age, Filipino,
and a resident of P-1, Lower Pisaan, San Francisco, Agusan del Sur, hereinafter called as
the “LESSEE”;

-WITNESSETH, that:

WHEREAS, the LESSOR is the exclusive owner of an apartment located at P-1,


Lower Pisaan, San Francisco, Agusan del Sur ;

WHEREAS, the LESSEE is desirous of leasing the said apartment under the terms
and conditions:

1. Duration of Lease – This contract of Lease shall be for a period of 3


months to begin on January 9, 2021 and shall be end on January 9, 2022
renewable upon its expiration for shorter or longer period at the options of
the LESSOR ;

2. Rentals – The LESSEE shall pay unto the LESSOR a NET monthly rental
for the leased premises the sum of Ten Thousand Pesos (P10,000.00) ;

3. Cash Deposit – The LESSEE shall execute one (1) month deposit, one (1)
month advance of this contract ;

a. Advance deposit is consumable before one month end of contract.


b. Deposit is guarantee by the LESSEE for all the unpaid rents, charges
for facilities, remaining electric and water bills for whatever damages
which may be incurred.

4. That the LESSEE shall pay all electric current and water consumed by the
LESSEE ;

5. That the LESSEE shall keep the leased premises in good and habitable
condition, making the necessary repairs but not make alterations and
improvements in the premises without the written consent of the LESSOR
and any improvements so introduced by the LESSEE shall belong and
pertain to the LESSOR by the end of this contract ;

6. Use of premises – The leased premises shall be used by the LESSEE during
the terms of lease for residential purposes and shall not be used for any
immoral and illegal purpose ;

7. That the LESSEE shall get through at least 3 months contract before they
can consume the cash advance deposit neither if they will not bridge / break
the contract the LESSOR shall not oblige to return the cash advance deposit
;

8. That the LESSEE shall not sort or keep in said apartment or its premises
any gasoline or other combustible materials ;

9. Failure of the LESSEE to faithful and diligently comply with the conditions
above set forth shall be grounds for the LESSOR cancel this agreement ;
10. Breach or Forced Termination of Contract – In case of breach of contract by
the LESSEE of any provision or condition herein stipulated, the LESSEE
hereby expressly agree that the LESSOR shall have the right to terminate
this Contract of Lease and the LESSEE hereby, further, expressly agree that
upon such termination one (1) month Deposit shall be forfeited in favor of
the LESSOR and furthermore the LESSEE shall still settle his/her
outstanding bills. In the event of any court litigation the LESSEE shall
submit to the jurisdiction of the Court and shall pay the LESSOR the
Attorney’s fee plus other judicial expenses.

ACKNOWLEDGMENT

BEFORE ME, this _____________________ at San Francisco, Agusan del Sur,


personally appeared the above-named persons known to me to be the same persons who
executed the foregoing instrument, and they acknowledged to me that the same are their
free act and deed.

This instrument consisting of two (2) pages including this page has been signed by
the parties and their witnesses at the left margin of each and every page hereof.
