The City does not accept this letter of delay that has pushed out the substantial completion
of this project from November 9 2018 to November 29 2018. We believe that there are many
examples of work that could have been undertaken while CO's were going through the approval
process. We also believe that there are many instances where work could have been calculated
and performed parallel to other work instead of sequentially.
The City still recognizes November 9 2018 as the substantial completion date from which
Liquidated Damages will be Determined from. If a more realistic date is proposed we may
reconsider this position.
