INSTRUMENTS ACT
The above named petitioner/appellant and respondent submit as
follows:-
01. This appellant was convicted by the Judicial First Class Magistrate,
(Proh & Excise) at Nalgonda, for the offence under Section 138 Negotiable
Instrument Act. And he was sentence to undergo imprisonment for
Simple imprisonment for a period of one year and to pay fine of
Rs.1,00,000/- to the respondent however while appeal is pending.
Thereafter the matter was compromised on the intervention of Village
elders and caste elders. The respondent have received the cheque amount
and agreed for compromise.
02. Therefore, the offence is to be compounded with the permission of
the Hon’ble Court as per Section 147 of NI Act, as the appeal is pending
with the Hon’ble Court and the leave of the Court is required.
03. The respondent has no objection for granting permission for
compounding the offence. The offence under section 138 NI Act is
compoundable under section 147 of the said Act.
04. It is submitted that the Hon’ble Court may be pleased to record the
compounding of the offence and acquit the appellant for the offence
under Section 138 Negotiable Instrument Act in view of the compromise
made by the parties herein.
Hence, it is prayed the Hon’ble Court may be pleased to permit the
petitioner/appellant to compound the offence with the respondent, in the
interest of justice.

The above named petitioner/appellant and respondent submit as


follows:-
01. This appellant was convicted by the Judicial First Class Magistrate,
Nalgonda, for the offence under Section 138 Negotiable Instrument Act.
And he was sentence to undergo imprisonment for Simple imprisonment
for a period 6 months and to pay fine of Rs.2,00,000/- to the respondent
however while appeal is pending. Thereafter the matter was compromised
on the intervention of Village elders and caste elders. The respondent
have received the cheque amount and agreed for compromise.
02. Therefore, the offence is to be compounded with the permission of
the Hon’ble Court as per Section 147 of NI Act, as the appeal is pending
with the Hon’ble Court and the leave of the Court is required.
03. The respondent have no objection for granting permission for
compounding the offence. The offence under section 138 NI is
compoundable under 147 of the said Act.
04. It is submitted that the Hon’ble Court may be pleased to record the
compounding of the offence and acquit the appellant for the offence
