LO4: Explain the legal standing of the Treaty of Waitangi, establishing its impact on the
construction industry.

Task 4 The Building Act 2004


A neighbour has built, as a DIY project, a 55m² sleepout. This small structure was complete
with kitchen facilities, shower, and a toilet. The council found out and advised that the
building would have to be demolished.
To complete this task, write an explanation for each of the following:
• Why the council came to this decision.
• What the neighbour could do in that situation to avoid demolishing the sleepout.
• How the sleepout might have been designed and built differently to avoid this problem.

Task 5 Health and Safety at Work Act 2015


A builder describes a panic at their worksite after an incident when a workmate fell down a
foundation hole and broke his leg.

Task 10: Licensing Building Practitioners (LBP)


Your client will be required to employ several suitably qualified professionals to undertake
the project. These will include designers’ carpenters, roofers etc. Under the Building Act
2004 Part 4 sets up LBP for Restricted building Work (RBW).
