GUIDELINES TO WRITE A RESEARCH PAPER

1. SELECTION OF TOPIC
This is the first step to writing a research paper and some may argue the most important too. The topic is to be selected
based on your interests and the field of law you want to join after graduating.
How to select a good topic?
Always remember we write the best research papers if we are writing about topics, we are interested in. But apart from
that, there are a few other things that need to be asked. Is the topic unique? Is the topic relevant? Has there been enough
research on that topic already? If so, do we have something more to add to the discussion?
We need to then consult with teachers, seniors, and colleagues and then move forward.
After starting to research on the subject, you might realize that this topic is not the right one, change the topic quickly
Page 2
then.
2. RESEARCH ON THE TOPIC.
This is undisputedly the most important part of writing a research paper.
Research, not just Google: Just Googling the research topic is not enough as we may end up finding nothing. Books should
be the primary area of research. We have to read a lot. Learn everything there is to learn about the topic. It will not only
give a better insight but also help in connecting things better and understanding whether there are any loopholes in our
research. It also helps us locate shortcomings with our research which otherwise the reviewing committee of the paper
would have noticed for sure.
Visit Library and use database: There are some specific Online Search Engine for specific subjects for example:
• SCC ONLINE, VAKILSEARCH: Case law
• KLUWER ARBITRATION: Arbitration
• MANUPATRA: Judgments across all subjects of law of Supreme Court, all Indian High Courts, Orders of the Tribunals,
bills, central and state Acts, notification and circulars, ordinances, committee reports, and more.
• CORPORATE LAW ADVISOR: To search, browse, view & print judgments contained in all journals published by All India
Reporter Private Limited for the years 2007 – 2013.
• ECONOMIC & POLITICAL WEEKLY: Economic & Political Weekly ﴾EPW﴿ publishes analysis of contemporary affairs side
by side with academic papers in the social sciences.
• JSTOR: JSTOR is a digital library of both multidisciplinary and discipline‐specific collections.
Because of JSTOR’s archival mission, there is a gap, typically from 1 to 5 years, between the most recently published
journal issue and the back issues available in JSTOR.
• LEXIS NEXIS: Books on your research topics can be found on Lexis Nexis online database which contains full‐text
judgments and Acts of Supreme Court of India, All High Courts,
All Tribunals & Central Acts and commentaries in corporate, commercial, banking & finance, intellectual property, ADR,
civil and criminal law.
It also contains US legal & all commonwealth cases.
3. ANALYSE AND PLAN
Certain types of writing call for a different approach. If you are writing exposition, you often need to describe a process. A
simple flowchart represents the stages in a process in sequence.
Identify the goal of the paper: There are two types of research paper
• argumentative research paper ‐ An argumentative research paper takes a position on a contentious issue and argues
for one point of view. The issue should be debatable with a logical counterargument.
• analytic research paper ‐ An analytic research paper offers a fresh look at an important issue. The subject may not be
controversial, but you must attempt to persuade your audience that your ideas have merit.
4. DRAFTING/EDITING
After we are done with all the preliminary research we need to start drafting. But researching does not end here.
Throughout the process of drafting the whole paper time and again we have to revert back to researching. But that is to be
expected.
We need to draft the whole body of our paper and try to divide them into headings and subheadings for it to be more
accessible to the readers.
Consider formatting guidelines: Most paper submission portals will provide you with their own guidelines. There might be
specific font size, line spacing, citation method, etc. We need to check very carefully as these are the technical details that
often get missed.
Citations: The Citation is added by using the keyboard shortcut: Alt + Ctrl + F. The citation style is usually mentioned in the
rules. Go through them once. The important citation styles you need to be familiar with are Bluebook 20th ED, OSCOLA,
Standard Indian Legal Citation.
5. PREPARING THE FINAL TEXT
• Usually, a buffer of one or two days before we go about revising our completed work is important as it helps us look
at our paper more objectively.
• Revising involves rethinking our ideas, refining our arguments, reorganizing paragraphs, and rewording sentences.
Some ideas may be needed to be developed in more detail, a few more evidences may be required to support our claims,
and a few unnecessary ideas may need to be deleted as well.
• Read our paper out loud helps sometimes. This makes it easier to identify writing that is awkward or unclear.
• Finally, we need to make others read our paper and tell us if everything is understandable and whether there is any
Page 3
need to revise anything else.
