Autocom Japan Inc. does not make provision for these. Due to the distance involved in shipment of the unit(s),
the customer must also note that the car battery may need to be recharged and tyre air pressure may also require to be attended to.

TERMS AND CONDITIONS
IMPORTANT NOTICE:
When ordering AUTOCOM JAPAN, LTD’s services, you as the ‘’Customer’’ are agreeing on your behalf and on behalf of anyone else with an interest in the shipment, that the Terms and Conditions below shall apply for
the time that AUTOCOM JAPAN,LTD undertakes the shipment unless otherwise agreed in writing by an authorised officer of AUTOCOM JAPAN, LTD
1. ROLL ON ROLL OFF (RORO)
Your vehicle is shipped via RORO, thus ensuring that the unit was functioning properly when loaded onto the ship. Once landed, the unit should not have any mechanical fault.
2. INSPECTION
As the requirement of the unit(s) undergoing inspection through QISJ (Quality Inspection Services Inc. Japan) is mandatory in Kenya, should the Customer waive or forego QISJ, AUTOCOM JAPAN.,LTD shall not be
responsible for any claims made thereof. Should any claims arise after the undertaking of QISJ, they shall be attended to in accordance with clauses 6 and 7.
3. SHIPMENT
Once receipt of payment made by the Customer is confirmed, AUTOCOM JAPAN, LTD will commence the shipping process. The estimated departure and arrival time of the ship may change without prior notice
at the instance of the shipping company and AUTOCOM JAPAN, LTD shall not be held liable or responsible for this. AUTOCOM JAPAN, LTD shall further not be held liable for any change in the shipping route
that may occur due to weather conditions. AUTOCOM JAPAN, LTD shall not be liable for any loss or damage arising out of circumstances beyond its control. These include but are not limited to acts of force majeure
such as, fire, floods, power cuts, acts of God, acts of the Public enemy, wars, insurrections, riots, strikes, lockouts, sabotage, any law, statute or ordinance order, actions or regulations of the Government
or any compliance therewith similar to the other or any other.
4. CONTAINER
The unit(s) can also be shipped by Container to any port if applicable depending on the port and country of departure.
5. COPYRIGHT AND TRADEMARK
The copyright of all information pertaining to AUTOCOM JAPAN, LTD described on the website belongs to and is the property of AUTOCOM JAPAN, LTD and cannot be used without the prior written permission of
AUTOCOM JAPAN, LTD. The act of using, reproducing and modifying such information without prior permission from AUTOCOM JAPAN, LTD is prohibited and any such use by any persons shall render them liable
to AUTOCOM JAPAN, LTD.
6. CLAIMS
AUTOCOM JAPAN, LTD shall only attend to claims pertaining to mechanical related issues. These shall be channeled by the Customer to the Customer Services Department. All such claims must be accompanied
with supporting evidence such as the Tally sheet from the Port Authority in the country of the port of destination, pictures and receipts. Upon receipt of all evidence in relation to a claim, AUTOCOM JAPAN, LTD will
attend to the claim within twenty - one (21) operational days*. AUTOCOM JAPAN.LTD shall only attend to claims from customers who purchased the unit(s) directly from AUTOCOM JAPAN.LTD.
Claims from third party or other purchasers shall not be attended to.
7. TIME LIMIT FOR CLAIMS
All claims must be submitted within five (5) days since collecting the vehicle; otherwise AUTOCOM JAPAN, LTD shall have no liability whatsoever.
8. INTERNET
AUTOCOM JAPAN, LTD shall not be responsible or liable for any loss or damage that may occur as a result of the delay, interruption or discontinuance of the provision of internet services on which it relies on to
undertake the sale of the unit(s).
9. ACTS DURING SHIPMENT
AUTOCOM JAPAN, LTD shall not be liable or responsible for any loss of parts or objects that may occur to the vehicle by way of theft or damage during transportation to the port of destination.
10. OTHER SERVICES
Clearing and forwarding services of the unit(s) are available upon request. AUTOCOM JAPAN, LTD will not be held liable or responsible for the undertaking of these services as the agreement shall be exclusively
between the Customer and the clearing and forwarding company. Any claims that may arise from the use of the services provided by the clearing and forwarding company shall be the responsibility of
the clearing and forwarding company.
11. INVOICES
Standard Payments
Reservation made throughout an AUTOCOM JAPAN Account manager, payment must be completed “ONLY” by Telegraphic Transfer only to the designated AUTOCOM JAPAN, LTD bank account in Japan,
as indicated on the invoice. In the interests of avoiding fraudulent invoices, the Customer is required to verify the account number by contacting AUTOCOM JAPAN, LTD.
Payments must be done directly to Autocom Japan bank accounts in Japan. Autocom Japan will not refund or be responsible in any case of cash/cheque payments to its branch offices or any other representatives.
All telegraphic transfer fees must be paid solely by the applicant/customer at one's bank. Autocom Japan will not bear the telegraphic transfer fees/charges or any other fee shared methods.
12. PART PAYMENT AND BALANCES DUE
Balances due on the invoice must be paid fifteen (15) days after the departure of the vessel, failure to which AUTOCOM JAPAN, LTD has the right to re-sell the unit(s) without any notice. This does not apply to
customers who in the event of their demise, illness, or inability to complete the balance of the payment due, have a referral contact person who comes forward to complete the purchase.
Proof of death, illness or inability of the original purchaser to complete the sale in that regard, must be provided by the alternate person. If a Customer makes a part payment of 50% of the invoice and
fails to pay the pending balance, AUTOCOM JAPAN, LTD will not refund any part payment made as this payment will be considered as a cancellation fee to cover expenses undertaken between AUTOCOM JAPAN, LTD
and the shipping company. Any further costs incurred by AUTOCOM JAPAN, LTD from the time that part payment was effected until crystallization of the due date of the balance shall accordingly be recovered
by AUTOCOM JAPAN, LTD from the Customer.
13. FEES
Re-sold unit(s) is sold on an as-is-basis. Where a Customer purchases a re-sold unit(s) as is basis that already landed at the port of destination, the Customer agrees to attend to the payment of any demurrage fees,
consignee name amendment fee and any other local fees that may apply**. Any other costs and expenses that the Customer may incur in getting possession of the unit(s) at the port of destination shall be
the responsibility of the Customer only.
14. SEVERABILITY
The invalidity or unenforceability of any provision herein shall not affect any other part of these Terms and Conditions.
15. GOVERNING LAW
Any dispute arising under or in any way connected with these Terms and Conditions shall be subject to the non- exclusive jurisdiction of the courts of, and be governed by the law of Japan
and the Customer agrees to submit to the said jurisdiction.
16. INDEMNITY
The Customer hereby agrees to indemnify AUTOCOM JAPAN,LTD from any claims or actions whatsoever that may arise as a result of the Customer at its own instance entering into other agreements based on the sale
between AUTOCOM JAPAN,LTD and the Customer. The Customer shall further keep indemnified AUTOCOM JAPAN, LTD from any claims, suits or actions that may arise as a result of the Customer failing to comply
with any applicable laws or regulations in the country of the port of destination, or in Kenya.
17. VALIDITY OF THE AGREEMENT
This Agreement shall remain valid until completion of the payment of the consideration price as stipulated herein.
18. AMENDMENT
AUTOCOM JAPAN, LTD may amend these Terms and Conditions when necessary and as is deemed fit and the Customer shall accordingly be bound by the revised Terms and Conditions.
19. IMPORT REGULATION & TARIFF
In respect of the regulations and laws pertaining to the importation of second hand vehicles and related tariffs in Kenya, AUTOCOM JAPAN, LTD shall not be liable or responsible for any actions or claims
whatsoever that may arise as a result of any changes, effected to but not limited to, such restrictions and/or laws.

* Operational days means the normal working days from which the sale under this invoice shall be processed and shall exclude weekends as well as public holidays recognized in Japan and Kenya.
** Any amendments that need to be effected to correct consignee details shall be done at the Customer’s cost if the error was occasioned at the Customer’s instance. If the error was occasioned
at AUTOCOM JAPAN, LTD’s instance, then the cost of effecting the amendment shall be borne by AUTOCOM JAPAN,LTD.
