Ownership of Excavated Material, its Disposal, Recycling & Royalty

 The excavated materials may be in any form e.g. soil, rock, all debris including
concrete blocks, pile heads, bricks, waste material, generated muck, bentonite fluid
and bentonite contaminated material, etc.
 The excavated material shall be the property of Maha - Metro.
 The excavated material may be classified mainly into following two categories:

1. Convertible Material
2. Non-Convertible Material
a) Usable Material such as Soil
b) Non-Usable Material such as all debris

1. Convertible Material (such as Rock)

i. Maha-Metro shall provide land for stacking the same at Agricultural College ground.
ii. The transportation, loading, unloading, segregating of material as decided by the
Engineer, is the responsibility of Bidder and is included in the relevant item of
excavation.
iii. Maha-Metro’s preferred choice is that Bidder shall convert the material into usable
tiles/bricks/stone slabs/aggregates with approved process so as to reuse or recycle
the convertible material back into this project or any other Maha-Metro project
adjacent to site.
iv. Payment for converting the material shall be made to Bidder on measurement basis
as per items mentioned in Revised BOQ.
v. For use of such converted material, Bidder shall obtain the same from Maha-Metro,
which shall reflect in BOQ in the form of Rebate. During financial evaluation, the
rebate offered on convertible material shall be taken in to account. Adjustment shall
be made in RA Bills, based on rates quoted by Bidder.
vi. The royalty of this excavated convertible material, wherever applicable, shall be
deposited by the Bidder to the concerned government authorities.

2. Non-Convertible Material

a) Usable Material (such as excavated soil or good earth)


i. The Bidder shall be responsible for the provision of all classes of earthworks material
required for the Works, whether sourced from the excavations within the Contract
or obtained from any other sources, which are located outside the Site, for which the
Engineer has given the consent. Preference shall be given by the contractor for use of
the excavated soil for filling, etc.
ii. The transportation, loading, unloading, stacking, etc. is the responsibility of bidder.
iii. The royalty of this excavated usable material, wherever applicable, shall be deposited
by the Bidder to the concerned government authorities.

b) Non-Usable Material
i. Disposal of surplus materials including excavation spoils etc. to the dumping site
shall be proposed by bidder and approved by the engineer, irrespective of lead and
lift (ascent/descents).
ii. The non-usable excavated material shall be disposed off by the bidder at nominated
places (identified by contractor in consultation with local civic bodies) including lead
upto 20 Km and lift.
iii. All the relevant permissions for transporting the excavated materials, its dumping at
designated site shall be arranged by the bidder including all other associated
activities.
iv. All excavated material, including waste material, bentonite fluid and bentonite
contaminated material shall be disposed of at the nominated site only. This material
shall be placed and compacted in accordance with the Construction Specification for
Earth Works or as otherwise directed by the Engineer's Representative. The disposal
of waste material shall be the full responsibility of the Bidder and these materials
shall be disposed of by the Bidder at an approved location.
v. For fill or dumping sites, the Bidder shall prepare a land plan with details of surface
drainage requirements, final formation levels, spreading and compaction of the fill
