March 14, 2007 - Last days Ruby Rose was seen

Ruby Rose opened up to her sister, Rochelle Barrameda, about her custody battle against her
husband, Manuel Jimenez III (Third) which stemmed from their marital problems because it was
alleged by her family that Third was physically hurting Ruby Rose, and thus, they separated.

She received a letter from the court denying her temporary protection order. When she received
the court order, she wanted to meet with her lawyer but she was not able to contact her lawyer.
On the same day at around 12:30 pm, she boarded her car because she was supposed to run
errands and visit her 2 children, 7 years old and 3 months old respectively, to her in-laws’
residence.

At around 4 pm, Ruby Rose’s friend called Rochelle because they were not able to reach Ruby
Rose which Roselle found unusual because Ruby Rose usually carries with her 3 cellular
phones. Rochelle tried reaching her sister but she too can not get a hold of her. Worried that
she was not able to reach her sister, she instructed their house helper to ask the Jimenez
Family, who were then residing in BF Homes las pinas, on Ruby Rose’s whereabouts because
that was where she was supposed to go.

The house helper was able to talk to Atty. Manuel Jimenez Jr, Ruby Rose’s father-in-law,
claimed that Ruby Rose was not there and that she never showed up. Rochelle reported that
her sister is officially missing. They asked the public for help to look for her and inform them of
her whereabouts by offering rewards.

On June 10, 2009 or 2 years later, a tip was received by the police claiming to know Ruby’s
whereabouts. The tipper, Manuel Montero, his statements, claimed that: he was a former
Operations Manager in Buena Suerte Jimenez Fishing Corporation which is owned by Lope
Jimenez, uncle of Third Jimenez; that Lope Jimenez and Atty Jimenez planned to kill Ruby
Rose even before she disappeared; o Ruby rose was kidnapped in Jimenez residence and
Montero accused Ereneo Fernandez, Norberto Ponce and Lennard “Spyke” Descalso of
strangling Ruby Rose to death and cementing her upon the orders of the Jimenezes. He
accused Lope Jimenez, Jimenez Jr.’s brother, of giving them P50,000 for the killing; they went
to Navotas using Ruby Rose’s car. Ruby Rose was strangled to death by Montero himself; that
after they killed her, they put her inside a drum and poured cement in it, and locked it.
Afterwards, they put the drum inside a steel box, poured cement in it, and dumped the steel box
in the sea; and that Montero even testified that Montero said that Lope Jimenez mentioned that
Atty Jimenez said that Ruby Rose was an embarrassment to the family. Manuel Montero even
gave detailed instructions on how to open the steel case.

The police went into the said area to confirm and there they saw a huge steel box were a steel
drum is cemented inside containing a female body. The cadaver was handcuffed and her feet
were bound. The medico legal conducted the investigation on the body to identify who it was

and the cause of their death. Using DNA dental records and the last clothing that was worn by
the victim, the body was positively identified by the authorities as that of Ruby Rose’s.

The Jimenezes claim that identity of the body is questionable due to several errors in the
autopsy as Ruby Rose no longer has tooth number 14 yet the report of the medico legal showed
that the said tooth was still intact in the body recovered. However, the Barrameda family refuted
the same as Ruby Rose had braces which caused her tooth 12 and 16 to move forward. Thus,
the tooth 14 was actually tooth 15. While the face of the body was no longer recognizable, the
Barrameda's family was able to confirm that the body recovered was that of Ruby Rose as they
were able to identify the clothes she was last seen wearing which is a khaki pants, her top and
earrings.

. August 15, 2009 – DOJ filed a case against Lope, Atty Jimenez, Lope Jinenez,
Lennard Descalso, Norberto Ponce, Eric Fernandez and Manuel Montero

· Against Manuel Jimenez III (Third) was dismissed for lack of


evidence

· Atty Jimenez Jr surrendered but was admitted in a hospital


because of heart issues

· Lope Jimenez was in hiding

· Eric Fernandez, Delcalso, Ponce – were also in hiding

· Ponce was later on found in Meycauayan and said that he has


been receiving Php 7000 from Jimenez family

· March 2013 – Montero later denied and retracted his previous testimonies and said
that they were all lies. He was later said escape Camp bagoing Diwa and declared to be
missing

· July 10, 2015 – Malabon RTC acquitted Atty Jimenez JR because of Montero’s
retracted testimonies

o Judge Edwin Larrida Jr “there is a dearth of evidence on the


record that would associate the accused to the criminal agency
responsible to the crime committed.”
