A DRAFT ORDINANCE PRESCRIBING ONE-TIME PAYMENT IN SECURING

BARANGAY CLEARANCE AND CERTIFICATION OR A COMBINATION OF BOTH


UP TO THREE (3) COPIES FOR A PERIOD OF SIX (6) MONTHS WITHIN THE SAME
YEAR

Explanatory Note
WHEREAS, pursuant to Section 391 (a) (2) of RA 7160 otherwise known as the
Local Government Code of 1991, the Sangguniang Barangay shall enact tax and
revenue ordinances, subject to the limitations imposed by the Code;
WHEREAS, vested with the power to create its own sources of revenue and levy
taxes, fees and charges which shall accrue exclusively to the needs and programs of
the barangay;
WHEREAS, there is a need raise revenue to augment the limited Barangay
budget to finance its operational expenses, activities and various projects;

WHEREAS, alongside with the revenue raising power vested in the barangay, is
the appreciation and recognition of the humane and the general welfare of its
constituents;

WHEREAS, to respond to the said needs of the residents in consideration of


their means and abilities of producing payment in securing barangay clearance or
certification more than once but as the need arises in complying with the requirements
of their personal transactions;

NOW THEREFORE, be it ordained as it is hereby ordained by the Sangguniang


Barangay of San Ramon, Magsingal, Ilocos Sur that:

Section 1. Coverage. This Ordinance shall govern residents who are securing
Barangay Clearance and Certification or a combination of both of more than One (1)
copy but not exceeding Three (3) copies within Six (6) months of the same year from
the date of payment appearing on the Official Receipt.

Section 2. Objective. This Ordinance aims to save and support the residents in
exhausting more on the same documents.

Section 3. Definition of Terms. Terms are understood and interpreted as adopted in


Section 3, Ordinance No. 001-2021:

Barangay Clearance – refers to a document issued by the barangay to its


constituent who are eligible for its issuance.
Barangay Certification – refers to a document issued by the barangay to attest
the legibility of its constituents.

Section 4. Payment. Residents securing Barangay Clearance and Certification or


combination of both shall only pay once until the third copy for the period of Six (6)
months in the same year.

In any case that a resident was able to secure Three (3) copies of the said documents
before the lapse of Six (6) months from the date of payment, resident will pay the
corresponding fee to secure a new copy. The counting of the Six (6) months will reckon
from the date of payment for the new document. Said date of payment will cover the
issuance of Three (3) copies of Barangay Clearance and Certification or a combination
of both.

Section 5. Separability Clause. – If for any reason or reasons, any part or provision of
this Ordinance shall be held to be unconstitutional or invalid, other parts or provisions
hereof which are not affected thereby shall continue to be in full force and effect.

Section 6. Repealing Clause. All Ordinances, Resolutions, Orders and other


Issuances inconsistent with this Ordinance are repealed.

Section 7. Effectivity Clause. This Ordinance shall take effect   upon approval.
